Price Order No. 443 (Second-hand Sacks and Bags) (Vegetable)
PURSUANT to the powers conferred on it by the Control of Prices Emergency Regulations 1939,* the Price Tribunal, acting with the authority of the Minister of Industries and Commerce, doth hereby make the following Price Order:—
PRELIMINARY
- This Order may be cited as Price Order No. 443, and shall come into force on the 24th day of September, 1945.
- (1) In this Order—
“ The said specification ” means the New Zealand Emergency Standard Specification (No. N.Z.S.S. E. 154) entitled “Second-hand Sacks and Bags”, issued by the New Zealand Standards Institute under the authority of the Minister of Industries and Commerce:
“ Distributor ”, in relation to sacks or bags, means a person who has purchased empty sacks or bags and resells them to any person for purposes of resale:
“ Reseller ”, in relation to sacks or bags, means a person who has purchased empty sacks or bags and resells them to any person for purposes other than resale:
“ Retailer ”, in relation to sacks or bags, means a person who in the ordinary course of business purchases vegetables or produce contained in sacks or bags and sells those sacks or bags after the vegetables or produce has been removed.
(2) References in this Order to the class, description, grade, or type of any second-hand sacks or bags shall be deemed respectively to be references to the class, description, grade, or type of such sacks or bags within the meaning and for the purposes of the said specification.
APPLICATION OF THIS ORDER
- This Order applies only with respect to sales of second-hand vegetable sacks and bags of any of the classes, descriptions, grades, or types comprised in Table 11 of Class F of the said specification.
FIXING MAXIMUM SELLING-PRICE OF SECOND-HAND VEGETABLE SACKS AND BAGS TO WHICH THIS ORDER APPLIES
- (1) Subject to the following provisions of this clause, the maximum price that may be charged or received by any vendor for any second-hand vegetable sacks or bags to which this Order applies shall be determined as follows:—

For empty sacks where delivery is made from
a retailer’s shop .. 0 5 ,,
For empty sacks where delivery is made by a
retailer to a sack depot .. 0 6 ,,
For empty sacks sold by a distributor .. 7 6 per dozen.
For empty sacks sold by a reseller.. .. 7 9 ,,
Sugar-bags and Hessian Utility Bags
For bags containing vegetables .. 0 3 each.
For empty bags where delivery is made from a
retailer’s shop .. 0 2 ,,
For empty bags where delivery is made by a
retailer to a sack depot .. 0 3 ,,
For empty bags sold by a distributor .. 4 6 per dozen.
For empty bags sold by a reseller .. .. 4 9 ,,
(2) Where any reseller incurs transport charges into his store with respect to any sacks or bags purchased by him, the maximum price fixed in subclause (1) hereof may be increased by a proportionate amount of such charges, being not more in any case than the charges that would have been incurred if delivery into the reseller’s store had been effected by a common carrier at current freight rates.
(3) The maximum prices fixed by the foregoing provisions of this clause with respect to sales by a distributor or by a reseller are fixed as for delivery by the vendor free-on-board or free-on-rail at the port or railway-station (as the case may be) that is nearest or most convenient of access to the vendor’s premises.
(4) Where any sacks or bags to which this Order applies are delivered by a distributor or by a reseller otherwise than free-on-board or free-on-rail as aforesaid, the maximum price that may be charged by the vendor shall be the maximum price fixed in accordance with the foregoing provisions of this clause, increased by any transport charges incurred by the vendor in effecting delivery and then reduced by the amount of the transport charges that he would have incurred if he had delivered the sacks or bags free-on-board or free-on-rail as aforesaid.
(5) Subject to such conditions, if any, as it thinks fit, the Tribunal, on application by any person concerned, may authorize special prices or margins of profit in respect of any sacks or bags to which this Order applies where for any reason extraordinary freight charges are incurred by any distributor or reseller in obtaining delivery from the source of supply that is nearest or most convenient of access to him. Any authority given by the Tribunal under this subclause may apply with respect to a specified lot or consignment of sacks or bags or may relate generally to all sacks or bags to which this Order applies sold while the approval remains in force.

Including Additional Land in the Bay of Islands Development Scheme
PURSUANT to section 4 of the Native Land Amendment Act, 1936, the Board of Native Affairs hereby declares the land described in the Schedule hereto to be subject to Part I of the said Act, and to be included in the Bay of Islands Development Scheme.
SCHEDULE
ALL that area of land in the Tokerau Native Land Court District containing 90 acres 2 roods 32 perches, more or less, situate in Block XII, Russell Survey District, and called or known as Ramaroa D Block.

Fixing the Rates of the Levy on Wool produced in New Zealand
PURSUANT to section 12 (2) of the Wool Industry Act, 1944, the New Zealand Wool Board doth hereby fix the rates of the levy to be charged on wool in accordance with the provisions of the said Act for the season commencing on the 1st day of October, 1945, as follows:—
(1) In respect of all wool purchased from a wool-grower before the 1st day of October, 1945—
(a) For each bale, 6d.
(b) For each fadge, 3d.
(c) For each bag or sack, 1d.
(2) In respect of all wool purchased from a wool-grower on or after the 1st day of October, 1945—
(a) For each bale, 1s.
(b) For each fadge, 6d.
(c) For each bag or sack, 2d.

The Factory Controls Revocation Notice 1945 (No. 3)
PURSUANT to the Factory Emergency Regulations 1939, the Factory Controller doth hereby give notice as follows:—
- This notice may be cited as the Factory Controls Revocation Notice 1945 (No. 3).
- The Factory Controller hereby revokes the control notices referred to in the Schedule hereto, and any notices amending the same, which were issued by him under the said regulations.

The Paint Control Notice 1943, Amendment No. 1
PURSUANT to the Factory Emergency Regulations 1939, I, George Augustus Pascoe, Factory Controller, hereby direct and give notice as follows:—

This notice may be cited as the Paint Control Notice 1943, Amendment No. 1, and shall be read together with and deemed part of the Paint Control Notice 1943* (hereinafter referred to as the principal notice).

The principal notice is hereby amended by revoking clauses 4, 6, 7, 8, and 9 thereof, and the Schedule thereto.

The principal notice is hereby further amended by revoking clause 5 and substituting the following new clause:—
“ 5. Except with the prior consent in writing of the Factory Controller, no person shall use any of the following materials in the manufacture of paint or for any other purpose whatsoever:—
“ Butyl acetate. Amyl acetate.
Cellosolve acetate. Butyl alcohol (Butanol).
Methyl ethyl ketone. Ethyl acetate.”
