Price Order No. 441 (Amending Price Order No. 135) (Candles)

PURSUANT to the powers conferred on it by the Control of Prices Emergency Regulations 1939,* the Price Tribunal, acting with the authority of the Minister of Industries and Commerce, doth hereby make the following amending Price Order:—

  1. This Order may be cited as Price Order No. 441, and shall be read together with and deemed part of Price Order No. 135† (hereinafter referred to as the principal Order).

  2. This Order shall come into force on the 24th day of September, 1945.

  3. The principal Order is hereby amended as follows:—

(a) By omitting from clause 4 the price figures “1 5”, “1 5½”, and “0 3” where they appear in paragraphs (a), (b), and (c) respectively, and substituting the price figures “1 6”, “1 6½”, and “0 3½”.

(b) By adding the following clause:—

“5. Notwithstanding anything in the foregoing provisions of this Order and subject to such conditions, if any, as it thinks fit, the Tribunal, on application by any retailer, may authorize special maximum retail prices in respect of any candles to which this Order applies where for any reason extraordinary freight charges are incurred by the retailer in obtaining delivery from the source of supply that is nearest or most convenient of access to him. Any authority given by the Tribunal under this clause may apply with respect to a specified lot or consignment of candles or may relate generally to all candles to which this Order applies sold by the retailer while the approval remains in force.”

Price Order No. 442 (Second-hand Sacks and Bags) (other than Vegetable Sacks and Bags)

PURSUANT to the powers conferred on it by the Control of Prices Emergency Regulations 1939*, the Price Tribunal, acting with the authority of the Minister of Industries and Commerce, doth hereby make the following Price Order:—

PRELIMINARY

  1. This Order may be cited as Price Order No. 442, and shall come into force on the 24th day of September, 1945.

  2. (1) Price Order No. 265† is hereby revoked.

(2) The revocation of the said Price Order shall not affect the liability of any person for any offence in relation thereto committed before the coming into force of this Order.

  1. (1) In this Order—

“The said specification” means the New Zealand Emergency Standard Specification (No. N.Z.S.S. E. 154) entitled “Second-hand Sacks and Bags”, issued by the New Zealand Standards Institute under the authority of the Minister of Industries and Commerce:

“Distributor”, in relation to sacks or bags, means a person who has purchased empty sacks or bags and resells them to any person for purposes of resale:

“Reseller”, in relation to sacks or bags, means a person who has purchased empty sacks or bags and resells them to any person for purposes other than resale.

(2) References in this Order to the class, description, grade, or type of any second-hand sacks or bags shall be deemed respectively to be references to the class, description, grade, or type of such sacks or bags within the meaning and for the purposes of the said specification.

APPLICATION OF THIS ORDER

  1. (1) Nothing in this Order shall apply with respect to sales of any empty second-hand vegetable sacks or bags of any of the classes, descriptions, grades, or types comprised in Class F of the said specification.

(2) Except as provided in subclause (1) hereof this Order applies with respect to all sales of empty second-hand sacks and bags of any of the classes, descriptions, grades, or types specified in the Schedule hereto.

FIXING MAXIMUM SELLING-PRICE OF SECOND-HAND SACKS AND BAGS TO WHICH THIS ORDER APPLIES

  1. (1) Subject to the following provisions of this clause, the maximum price that may be charged or received by any person for any second-hand sacks or bags to which this Order applies shall be the appropriate price fixed in the Schedule hereto.

(2) Where any reseller incurs transport charges into his store with respect to any sacks or bags purchased by him, the maximum prices fixed in the Schedule hereto may be increased by a proportionate amount of such charges, they being not more in any case than the charges that would have been incurred if delivery into the reseller’s store had been effected by a common carrier at current freight rates.

(3) The maximum prices fixed as aforesaid are fixed as for delivery by the vendor free-on-board or free-on-rail at the port or railway-station (as the case may be) that is nearest or most convenient of access to the vendor’s premises.

(4) Where any sacks or bags to which this Order applies are delivered by a vendor otherwise than free-on-board or free-on-rail as aforesaid, the maximum price that may be charged by the vendor shall be the maximum price fixed as aforesaid, increased by any transport charges incurred by the vendor in effecting delivery and then reduced by the amount of the transport charges that would have been incurred if he had delivered the sacks or bags free-on-board or free-on-rail as aforesaid.

  1. Subject to such conditions, if any, as it thinks fit, the Tribunal, on application by any person concerned, may authorize special prices or margins of profit in respect of any sacks or bags to which this Order applies where for any reason extraordinary freight charges are incurred by any distributor or reseller in obtaining delivery from the source of supply that is nearest or most convenient of access to him. Any authority given by the Tribunal under this clause may apply with respect to a specified lot or consignment of sacks or bags or may relate generally to all sacks or bags to which this Order applies sold while the approval remains in force.
