PURSUANT to the powers conferred on it by the Control of Prices Emergency Regulations 1939,* the Price Tribunal, acting with the authority of the Minister of Industries and Commerce, doth hereby make the following amending Price Order :—

This Order may be cited as Price Order No. 435, and shall be read together with and deemed part of Price Order No. 366† (hereinafter referred to as the principal Order).

This Order shall come into force on the 31st day of August, 1945.

Subclause (1) of clause 4 of the principal Order is hereby amended as follows :—
(1) By omitting in paragraph (a) the figures and words “1s. 11½d. per pound” and substituting the figures and words “2s. 0½d. per pound” :
(2) By omitting in paragraph (b) the figures and words “1s. 8¼d. per pound” and substituting the figures and words “1s. 9½d. per pound.”

Price Order No. 436 (Milk and Cream)
SALES TO ICE-CREAM MANUFACTURERS AND TO MILK-VENDORS
PURSUANT to the powers conferred on it by the Control of Prices Emergency Regulations 1939,* the Price Tribunal, acting with the authority of the Minister of Industries and Commerce, doth hereby make the following Price Order :—
PRELIMINARY

This Order may be cited as Price Order No. 436, and shall come into force on the 1st day of September, 1945.

(1) In this Order, unless the context otherwise requires,—
“Ice-cream mix” means any mixture or compound containing milk or cream for use in the manufacture of ice-cream :
“Gallon,” when used with reference to milk, means 10¼ lb. by weight or 160 fluid ounces by measure ; and, when used with reference to cream, means 9·95 lb. by weight or 160 fluid ounces by measure :
“Milk” and “cream” have the same meanings respectively as in regulations made under the Sale of Food and Drugs Act, 1908 :
“Milk-vendor” means a person who sells milk or cream by way of retail sale but does not include—
(a) A person occupying a shop where milk or cream is sold for consumption or use off the premises and not otherwise and where the milk or cream is sold in the form in which it is received into the shop ; or
(b) A person who sells milk or cream for consumption on his premises (whether in the form in which it is received by him or otherwise and whether separately or in combination with any other substance or substances).
(2) References in this Order to milk districts are references to the districts defined in the Price Orders in force from time to time in those districts.
PART I
APPLICATION OF THIS PART
- This Part of this Order applies only with respect to sales of milk and cream to an ice-cream manufacturer anywhere in New Zealand for use in the manufacture of ice-cream or ice-cream mix.
FIXING PRICES OF MILK AND CREAM TO WHICH THIS PART APPLIES
- (1) The maximum price that may be charged or received for any milk or cream to which this Part applies shall be determined as follows :—
