Constituting the Borough of Kaitaia

A PROCLAMATION

WHEREAS, in accordance with the provisions of section one hundred and thirty-five of the Municipal Corporations Act, 1933, a petition was presented to the Governor-General praying that the area described in the said petition be constituted a new borough:

And whereas the provisions of the said section one hundred and thirty-five have been complied with in respect thereto, and the result of the poll taken on the proposal that the area should be constituted a new borough was in favour thereof:

Now, therefore, in pursuance and exercise of the powers and authorities vested in me by the Municipal Corporations Act, 1933, I, Cyril Louis Norton Newall, the Governor-General of the Dominion of New Zealand, do hereby proclaim and declare that the area described in the Schedule hereto shall be constituted a borough under the said Act on and from the first day of September, one thousand nine hundred and forty-five, that the name of such borough shall be the Borough of Kaitaia, and that the number of Councillors to be elected to the Council of the said borough shall be six, exclusive of the Mayor:

And I do further proclaim and declare that William Harold Atkins, J.P., of Kaitaia, shall be the Returning Officer to conduct the first election of Mayor and Councillors of the said borough; and that the said William Harold Atkins shall be the Town Clerk and the person to prepare the district electors’ roll for the purposes of the said first election:

And, lastly, I do proclaim and declare that the first election of Mayor and Councillors of the said borough shall be held on Saturday, the twenty-seventh day of October, one thousand nine hundred and forty-five, and that the first meeting of the Council of the said borough shall be held on Wednesday, the fourteenth day of November, one thousand nine hundred and forty-five, at eight o’clock in the afternoon, in the Redan Chambers, Kaitaia.

SCHEDULE

BOROUGH OF KAITAIA

ALL that area in the North Auckland Land District of approximately 1,300 acres, bounded by a line commencing at the easternmost corner of part Lot 4B on D.P. 24412, and running south-easterly along the south-western side of the Great North Road to its intersection with a right line, being the production westward of the northern boundary of Lot 1 on Deeds Plan 678; thence easterly along the said right line, across the said Great North Road, to and along the north boundary of Lots 1 and 4 on the said Deeds Plan 678, parts of Lot 6 comprised in Certificate of Title, Volume 756, folios 96 and 95, and along the northern boundary of Lot 5 on the said Deeds Plan 678; thence southerly along the eastern boundary of the said Lot 5 and a right line, being the production of the said eastern boundary, across Donald’s Road to its southern side, the aforesaid lots being part of Old Land Claim 214; thence easterly along the southern side of the aforesaid road to the north-western corner of Lot 2 on D.P. 9413, being part of Allotment 23, Awanui Parish; thence again generally southerly along the western boundary of the said Lot 2, the western, south-western, and south-eastern boundaries of part Lot 23 on D.P. 405, and the south-western boundary of Lot 4 on D.P. 15252 to the south-eastern corner of Lot 6 on the said D.P. 15252; thence along a right line, across a public road to the angle opposite, and along the western side of that road to the point in line with the eastern boundary of Lot 2 on D.P. 393, along a right line, across the said road, to and along the generally south-western boundary of Lot 4 on D.P. 15252 aforesaid to the angle in Church Road on the southern boundary of Lot 7 on D.P. 393; thence along a right line, across Church Road aforesaid to the angle opposite, and along the western side of the aforesaid road to and along the northern boundary of Lot 24 on D.P. 405, and a right line, being its production across the Awanui River, and along its left bank to the north-western boundary of Lot 28 on the said D.P. 405; thence along the north-western boundary of the said Lot 28, across a public road, to and along the north-western boundary of Lot 30 on the said D.P. 405 to a public road; thence north-westerly along the north-eastern side of that road to the westernmost corner of Lot 29 on the said D.P. 405, the aforesaid lots being part of Old Land Claim 242; thence generally southerly and westerly along a right line, across the said public road, to and along the north-western and northern boundaries of Allotment 60, Ahipara Parish, to the westernmost corner of Allotment 81 of the said parish; thence along a right line, being the production of the last-mentioned boundary, across another public road, and along a right line bearing 295° 29′ distant 1046·1 links; thence northerly generally along another right line, bearing 14° 22′ 30″ distant 1753·1 links, to the westernmost corner of Section 17, Block V, Takahue Survey District; thence along the north-western boundary of the said Section 17 and along a right line from its northern corner to the intersection of the left bank of Tarawhatura Stream with the north-eastern boundary of part Old Land Claim 7, as shown on D.P. 11562; thence along the said north-eastern boundary, crossing the said Tarawhatura Stream and a public road, and along the north-eastern boundary of another part of Old Land Claim 7, as shown on D.P. 13320, to its northern corner; thence along a right line, bearing 38° 30′, along the south-eastern boundary of Lot 1, D.P. 19912, and passing through Lots 3,

4, and 2 on D.P. 29054, to and across the Awanui River, and along its right bank to the southern corner of part Lot 4B on D.P. 24412, being part of Old Land Claim 214; thence along the south-eastern boundary of the said Lot 4B to the point of commencement.

Given under the hand of His Excellency the Governor-General of the Dominion of New Zealand, and issued under the Seal of that Dominion, this 21st day of August, 1945.

Authorizing R. and W. Hellaby, Limited, to erect certain Electric Lines in Portion of the Mount Wellington Road District

At the Government House at Wellington, this 15th day of August, 1945

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby authorize R. and W. Hellaby, Limited, a company duly incorporated under the Companies Act, 1933, and having its registered office in the City of Auckland (hereinafter referred to as “the licensee”), to lay, construct, put up, place, and use the electric lines described in the Schedule hereto on the following conditions.

CONDITIONS

  1. IMPLIED CONDITIONS

THE conditions directed to be implied in all licenses by the Electrical Supply Regulations 1935 shall be incorporated herein and shall form part of this license except is so far as the same may be inconsistent with the provisions hereof.

  1. LICENSE TO BE SUBJECT TO REGULATIONS

The license hereby conferred is subject to compliance by the licensee with the Electrical Wiring Regulations 1935 and the Electrical Supply Regulations 1935, and with all regulations made or to be made in amplification or amendment thereof or in substitution therefor.

  1. SYSTEM OF SUPPLY

The system of supply shall be three-wire alternating current. Electrical energy shall be transmitted at a pressure of 32 volts alternating current between terminals.

  1. DURATION OF LICENSE

Unless lawfully determined this license shall continue in force until the 31st day of March, 1966.

SCHEDULE

LINES adapted for supply as prescribed in these presents for the transmission of electrical energy commencing from the licensee’s engine-room situated in Lot 1, L.T. plan 26507, being part Hamlin’s Grant, Block VI, Otahuhu Survey District, and proceeding thence in a north-easterly direction generally across the Great South Road, Lot 2, L.T. plan 26508, the Mount Wellington Highway, Lot 10, D.P. 8491, and Lot 106, D.P. 8491, to the licensee’s well; the same being more particularly delineated by means of a dotted line on plan marked P.W.D. 121798, deposited in the office of the Minister of Works at Wellington.

Altering and redefining the Boundaries of the Hawke’s Bay Rabbit District.—(Notice No. Ag. 4210)

ORDER IN COUNCIL

At the Government House at Wellington, this 15th day of August, 1945

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

WHEREAS by section thirty-one of the Rabbit Nuisance Act, 1928, it is enacted that the Governor-General, at the request of the Board of any rabbit district, may, by Order in Council, alter and redefine the boundaries of its district:

And whereas the district known as the Hawke’s Bay Rabbit District has been constituted under and for the purposes of the said Act:

And whereas the Board of the said district has, pursuant to the said section thirty-one of the said Act, requested that the boundaries of its district be altered and redefined by excluding an area therefrom:

And whereas it is deemed expedient to alter and redefine the boundaries of the said district accordingly:
