The Stratford Milk District Constitution Order 1945

ORDER IN COUNCIL
At the Government House at Wellington, this 15th day of August, 1945
Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL
IN pursuance and exercise of the powers conferred on him by the Milk Act, 1944, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby order and declare as follows :—

This Order may be cited as the Stratford Milk District Constitution Order 1945.

The Borough of Stratford is hereby constituted and declared a milk district under the Milk Act, 1944, as from the twenty-fourth day of August, one thousand nine hundred and forty-five, with the name of the “Stratford Milk District”.

The Milk Authority of the said milk district shall be the Stratford Borough Council.

IN pursuance and exercise of the powers conferred on him by the Milk Act, 1944, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby order and declare as follows :—

This Order may be cited as the Timaru Milk District Constitution Order 1945.

The Borough of Timaru is hereby constituted and declared a milk district under the Milk Act, 1944, as from the seventeenth day of August, one thousand nine hundred and forty-five, with the name of the “Timaru Milk District”.

The Milk Authority of the said milk district shall be the Timaru Borough Council.

PURSUANT to section twenty-eight of the Marketing Act, 1936, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby appoint William Ernest Scott, Esquire,
to be a member of the New Zealand Dairy Board, and doth hereby declare that the appointment hereby made shall take effect on and from the first day of August, one thousand nine hundred and forty-five.

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL
PURSUANT to the Harbours Act, 1923, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby license and permit the Nelson Harbour Board (hereinafter called “the Board,” which term shall include its successors or assigns, unless the context requires a different construction) to use and occupy a part of the foreshore at Mapua, Waimea River, as shown on approved plans marked M.D. 4773 and 5407, and deposited in the office of the Marine Department at Wellington, for the purpose of maintaining a wharf thereon as shown on the said plans, such license to be held and enjoyed by the Board upon and subject to the terms and conditions set forth in the Schedule hereto.
SCHEDULE
CONDITIONS

This license is subject to the Foreshore License Regulations 1940, with the exception of clause 21 of the said regulations, which for the purpose of this Order in Council is hereby excluded, and the provisions of those regulations shall, so far as applicable, apply hereto.

The annual sum payable by the Board shall be one shilling (1s.), payable on demand.

The term of the license shall be fourteen years from the 22nd day of July, 1945.

The master of every vessel discharging ballast at the said wharf shall have all such ballast taken away and deposited above high-water mark, or at such place as may be approved by the Minister or by any person appointed by the Minister for that purpose.

Vesting the Management of the Building at Whakapirau, Kaipara Harbour, in Trustees

Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL
PURSUANT to the Harbours Act, 1923, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby vest in Guy Henry Jackman, Robert Heatley, and Charles Edward Upton (as trustees for the settlers of the district) (hereinafter called “the trustees,” which term shall include their executors, administrators, or assigns, unless the context requires a different construction), the management of the building at Whakapirau, Kaipara Harbour, as shown on approved plans marked M.D. 2719 and 2721, and deposited in the office of the Marine Department, for the purpose of maintaining the building thereon as shown on the said plans, such vesting to be held and enjoyed by the trustees upon and subject to the terms and conditions set forth in the Schedule hereto.
SCHEDULE

This vesting of the building in the trustees is subject to the Foreshore License Regulations 1940, and the provisions of those regulations shall, so far as applicable, apply hereto.

The term of the vesting shall be fourteen years from the 1st day of August, 1945.

The annual sum payable by the trustees shall be 1s., payable on demand.

PURSUANT to the authority conferred upon me by the three-hundred-and-first section of the Justices of the Peace Act, 1927, I, Cyril Louis Norton Newall, the Governor-General of the Dominion of New Zealand, do hereby notify and declare that Jack Grant A’Court, being an officer in the service of the Crown holding the office of Senior Clerk in the office of the Registrar-General at Wellington, is authorized to take and receive statutory declarations under the three-hundred-and-first section of the Justices of the Peace Act, 1927.
As witness the hand of His Excellency the Governor-General, this 7th day of August, 1945.
