district under the Milk Act, 1944, as from the twenty-fourth day
of August, one thousand nine hundred and forty-five, with the
name of the “Hamilton Milk District”.

  1. The Milk Authority of the said district shall be the Hamilton
    Borough Council.

  2. The Waikato County Council and the Waipa County Council
    shall each be entitled to have a representative on the Milk Committee
    of the Hamilton Borough Council and from time to time to nominate
    one person each for that purpose.

  3. The Hamilton Borough Council shall from time to time
    appoint to the Milk Committee of the Borough Council the two
    persons nominated by the Waikato and Waipa County Councils
    pursuant to clause four hereof.

SCHEDULE

ALL that area comprising the Borough of Hamilton and portions
of the Waikato and Waipa Counties, bounded by a line commencing
at a point on the left bank of the Waikato River, and being the
south-eastern corner of Allotment 293, Pukete Parish, and running
south-easterly generally up the said left bank to a point being the
production south-westerly of the south-eastern boundary of Allot-
ment 160, Kirikiriroa Parish; thence easterly generally along a
right line across the said Waikato River, to and along the south-
eastern boundary of Allotment 160 aforesaid, to and up a stream
forming the southern boundaries generally of Lots 3 and 4 on
D.P. 15895, being parts Allotments 161 and 152, Kirikiriroa Parish
aforesaid, and part Lot 8 on D.P. 12777, being part of Allotment 142
of the said parish, to and along the south-western and southern
boundaries of Lots 5 and 4 on D.P. 8603, being parts Allotments 143
and 132 of the said parish, and a right line, being the production
of the eastern end of the last-mentioned boundary, across a public
road to its eastern side; thence southerly along the said eastern
side to the south-western corner of Lot 1 on D.P. 16401, being
parts Allotments 201 and 201A of the said Kirikiriroa Parish, and
again easterly generally along the south-eastern boundary of the
said Lot 1 and the south-eastern boundaries of Lots 35 and 36 on
D.P. 16401 and Lots 4 and 5 on D.P. 24745, being parts of
Allotments 201, 198, and 198A of the said parish, to and along the
south-western and south-eastern boundaries of Lots 9 and 10 on
D.P. 24974, being part of the land granted to the New Zealand
Loan and Mercantile Company by grant of 1876, to the western
corner of Lot 60 on D.P. 12021, being portion of Allotment 302 of
the said Kirikiriroa Parish; thence south-easterly along the south-
eastern boundary of the said Lot 60, a right line across a public
road, to and along the south-eastern boundaries of Lots 38 and 13
on D.P. 18626, being part of the said Allotment 302, and a right
line being that boundary produced across a public road, railway
land at Ruakura Junction, and another public road to its south-
eastern side; thence south-westerly along the said south-eastern
side to the south-western boundary of part Allotment 302 of the
said parish, again south-easterly along the said south-western
boundary and the south-western boundary of Allotment 291, and
a right line, being the production of that boundary across Allot-
ment 291A, to the north-western boundary of Allotment 290 of the
said parish; thence south-westerly along the north-western boundary
of the said Allotment 290 and the north-western boundary of
Allotment 247 of the said Kirikiriroa Parish, and a right line, being
the production of the last-mentioned boundary, to the north-eastern
side of a public road, again south-easterly along the said north-
eastern side to the southern corner of part Allotment 263 of the
said parish, as shown on D.P. 3501; thence along a right line across
the Hamilton–Paeroa Main Highway, to and along the south-eastern
boundary of Lot 2 on D.P. 9272, being another part of the said
Allotment 263, to the right bank of the Mangaonua Stream; thence
again south-westerly down the said right bank and westerly generally
down the right bank of the Waikato River to a point being the
production north-easterly of the north-western boundary of part
Allotment 56, Te Rapa Parish; thence along a right line across the
said Waikato River, to and along the north-western boundary of
the said Allotment 56, to and up a stream running through the said
Allotment 56 and Allotments 55, 46, 47, 48, and 49, all of the said
Te Rapa Parish, and crossing the Great South Road, to and southerly
along its western side to its junction with the southern side of the
road forming the north-western boundary of Lot 4 of D.P. 6673,
being part of Allotment 39 of the said Te Rapa Parish, and westerly
along the southern side of the last-mentioned road to the north-
eastern corner of part Allotment 371, Tuhikaramea Parish; thence
north-westerly along the north-eastern boundaries of that Allotment,
being the boundary of the aforesaid parish, and a right line, being
the production of the last-mentioned boundary, across a public road
to its western side; thence northerly along the said western side to
and along the south-western, western, and north-western sides of
the road forming the north-eastern, eastern, and south-eastern
boundaries of Allotments 90, 88, 110, 109, 111, 55, and 53, Pukete
Parish, to and along the eastern boundaries of part Allotments 53
and 52, being the land comprised in Certificate of Title, Volume 291,
folio 24 (Auckland Land Registry), to and along the south-western
boundaries of Lot 2 on D.P. 19747, being part of Allotment 215
and another part of Allotment 215 of the said Pukete Parish, to
the north-western side of a public road; thence along the north-
western side of the said road, to and along the south-western side
of another public road, and the last-mentioned side produced across
another public road to its north-western side; thence north-easterly
generally along the said north-western side forming the south-
eastern boundaries generally of parts Allotment 215, Allotment 18,
and Lot 3 on D.P. 29312, being parts Allotments 14 and 18A, all
of the said Pukete Parish, to a point being the eastern corner of
Lot 3 aforesaid; thence along a right line across a public road, to
and along the south-eastern boundary of Allotment 293 of Pukete
Parish aforesaid, to the point of commencement. As the same is
more particularly delineated on the plan marked 77/15, deposited
in the office of the Milk Marketing Division of the Marketing
Department, Wellington, and thereon edged red.

ORDER IN COUNCIL

At the Government House at Wellington, this 15th day of
August, 1945

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

IN pursuance and exercise of the powers conferred on him by the
Milk Act, 1944, His Excellency the Governor-General, acting
by and with the advice and consent of the Executive Council, doth
hereby order and declare as follows:—

  1. This Order may be cited as the Napier Milk District
    Constitution Order 1945.

  2. Those parts of New Zealand consisting of the Borough of
    Napier, the Town District of Taradale, and part of the Hawke’s Bay
    County, described in the Schedule hereto, are hereby constituted and
    declared a milk district under the Milk Act, 1944, as from the twenty-
    fourth day of August, one thousand nine hundred and forty-five,
    with the name of the “Napier Milk District”.

  3. The Milk Authority of the said district shall be the Napier
    Borough Council.

  4. The Taradale Town Board and the Hawke’s Bay County
    Council shall each be entitled to have one representative on the
    Milk Committee of the Napier Borough Council, and from time to
    time shall be entitled to nominate one person each for that purpose.

  5. The Napier Borough Council shall from time to time appoint
    to the Milk Committee of the Borough Council the two persons
    nominated by the Taradale Town Board and the Hawke’s Bay County
    Council pursuant to clause four hereof.

SCHEDULE

ALL that area in the Hawke’s Bay Land District, bounded by a line
commencing at a point on the Western Spit on the mean high-water
mark of the ocean, being the north-eastern corner of the Borough of
Napier, as described in the New Zealand Gazette, 1942, page 950;
thence southerly along the mean high-water mark of the ocean to a
point at which the western mole of the entrance to Port Ahuriri
crosses the mean high-water mark of the ocean in Section 664, Town
of Napier; thence easterly by a right line to a point where the eastern
mole crosses the mean high-water mark of the ocean; thence easterly
and southerly along the mean high-water mark of the ocean to a
point in line with the northern side of the Awatoto – Meeanee Road;
thence generally westerly along the northern side of the Awatoto–
Meeanee Road to and across Riverbend Road; thence westerly
along the northern side of the Meeanee–Taradale Road to a point
in line with Johns Road; thence across Meeanee–Taradale Road,
and southerly along the western side of Johns Road, to and across a
public road to a point on the left bank of the Tutaekuri River in
line with the western side of Johns Road; thence generally westerly
along the bank of that river to the western boundary of the Taradale
Town Board District, described in the New Zealand Gazette, 1941,
page 245; thence generally northerly and easterly along that
boundary to and across the Napier–Taradale Road; thence north-
easterly along the south-eastern side of the Napier–Taradale Road
to the Napier Borough boundary, as described in the New Zealand
Gazette, 1942, page 950; thence generally easterly and northerly
along that boundary to the eastern boundary of Lot 1, D.P. 6339;
thence south-westerly and northerly along the south-western
boundary of Lot 1, D.P. 6339, to its intersection with Meeanee Quay;
thence westerly and northerly and easterly along the Napier Borough
Boundary, as described in the New Zealand Gazette, 1942, page 950,
to the point of commencement. As the same is more particularly
delineated on the plan marked 81/15, deposited in the office of the
Milk Marketing Division of the Marketing Department, Wellington,
and thereon edged red.
