Lands permanently reserved in the Wellington, Westland, and Otago Land Districts

WHEREAS by the three-hundred-and-fifty-ninth section of the Land Act, 1924, it is enacted that the Governor-General may from time to time set apart temporarily as reserves, notwithstanding that the same may be then held under pastoral license, any Crown lands which in his opinion are required for any of the purposes in the said section mentioned:

And whereas by the three-hundred-and-sixtieth section of the said Act it is provided that land temporarily reserved under the said three-hundred-and-fifty-ninth section may, at the expiration of one month, but not later than six months, after the publication in the Gazette of notice of such temporary reservation, be permanently reserved, and that notice of such permanent reservation shall be published in the Gazette:

And whereas the lands described in the Schedule hereto were, by the Warrant dated the twenty-eighth day of April, one thousand nine hundred and forty-five, and published in the Gazette of the third day of May, one thousand nine hundred and forty-five, temporarily reserved under the authority of the said Act for the purposes in the Schedule of the said Warrant specified at the end of the respective descriptions of the lands so intended to be temporarily reserved:

Now, therefore, I, Cyril Louis Norton Newall, the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the powers and authorities conferred upon me by the said Act, do hereby permanently reserve the lands described in the Schedule hereto for the purposes in the said Schedule specified at the end of the respective descriptions of the lands so intended to be permanently reserved for which purposes the said lands were so temporarily reserved as aforesaid.

SCHEDULE

WELLINGTON LAND DISTRICT

SECTIONS 22 and 23, Block III, Retaruke Survey District: Area, 15 acres, more or less. (Roadman’s cottage-site.)

WESTLAND LAND DISTRICT

Reserve 1829, Block VIII, Mawheranui Survey District: Area, 1 acre, more or less. (Addition to a public-school site, Nelson Creek.)

OTAGO LAND DISTRICT

Section 127, Block I, Fraser Survey District: Area, 4 acres 3 roods 13·7 perches, more or less. (Gravel-pit.)

Notice of Intention to issue an Order in Council revoking the Reservation for Recreation Purposes over a Reserve in the City of Christchurch, Canterbury Land District

WHEREAS by subsection one (b) of section seven of the Public Reserves, Domains, and National Parks Act, 1928 (hereinafter referred to as “the said Act”), it is provided that the Governor-General may, from time to time, by Order in Council, revoke the reservation over any public reserve or part thereof, and thereupon the land comprised therein shall, if vested in the Crown or in any local authority or trustees deriving title from the Crown, become Crown land available for disposal under the Land Act, 1924, and in any other case may, subject to the provisions of subsection five of the said section seven of the said Act, be disposed of in such manner and for such purposes as may be stated in such Order in Council:

And whereas the land described in the Schedule hereto is a recreation reserve which on the subdivision of private property for residential purposes was conveyed, in trust, for recreation purposes to the body corporate called the Mayor, Councillors, and Citizens of the City of Christchurch:

And whereas the reserve is not required for recreation purposes, and it is expedient that the reservation over the said land be revoked:

And whereas the said body corporate has passed a resolution consenting to such revocation, and has in all respects complied with the provisions of subsections three and four of the said section seven of the said Act:

Now, therefore, I, Cyril Louis Norton Newall, the Governor-General of the Dominion of New Zealand, do hereby give notice, pursuant to subsection two of section seven of the said Act, that it is my intention to issue an Order in Council under the provisions of subsection one (b) of the said section seven revoking the reservation for recreation purposes over the land described in the Schedule hereto, and declaring that the said land may be disposed of by the said body corporate by way of sale by public auction or private contract at such price and on such terms and conditions as the said body corporate shall determine, but so that the proceeds of any such sale shall be used and applied in or towards the purchase of other land for recreation purposes.

SCHEDULE

CANTERBURY LAND DISTRICT

ALL that area containing by admeasurement 32·8 perches, more or less, being Lot 5 on plan deposited in the Land Registry Office, Christchurch, as No. 8251, and being part Rural Section 64, situated in the City of Christchurch. As the same is more particularly delineated on the plan marked L. and S. 1/975N, deposited in the Head Office, Department of Lands and Survey, at Wellington, and thereon bordered red.

As witness the hand of His Excellency the Governor-General, this 13th day of August, 1945.

Sub-Lieutenant (E) William Hutton Peterson, promoted to the rank of Acting-Lieutenant (E), with seniority of 1st November, 1944, and reappointed, to date 1st December, 1944.

Mr. John George Ward Draper, Temporary Acting-Gunner, confirmed in rank, with original seniority of 12th March, 1944.

Mr. Ben Gordon Moody, Temporary Acting Warrant Engineer, confirmed in rank, with original seniority of 24th February, 1944.

William Corbet Laventure, Chief Petty Officer, N.Z. 2013, promoted to the rank of Temporary Acting-Boatswain and appointed H.M.N.Z. ship as directed, to date 10th July, 1945.

Hiram William Harris, Chief Engine-room Artificer, N.Z. 687, promoted to the rank of temporary Acting Warrant Engineer and appointed H.M.N.Z. ship as directed, to date 4th July, 1945.

CORRIGENDUM

With reference to the list of appointments approved on the 2nd August, 1945, the rank of Temporary Sub-Lieutenant John Brian Tinney, on promotion, should read “Temporary Acting-Lieutenant.”
