ORDER IN COUNCIL
At the Government House at Wellington, this 25th day of July, 1945
Present:
His Excellency the Governor-General in Council
P URSUANT to the Harbours Act, 1923, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby license and permit the Hokianga Co-operative Dairy Company, Limited, of Kohukohu (hereinafter called “the company,” which term shall include its successors or assigns, unless the context requires a different construction), to use and occupy a part of the foreshore at Motukaraka, Wairupe Creek, Hokianga Harbour, as shown on approved plan marked M.D. 8399, and deposited in the office of the Marine Department at Wellington, for the purpose of maintaining thereon a produce store as shown on the said plan, such license to be held and enjoyed by the company upon and subject to the terms and conditions set forth in the Schedule hereto.
SCHEDULE
CONDITIONS

  1. This license is subject to the Foreshore License Regulations 1940, and the provisions of those regulations shall, so far as applicable, apply hereto.
  2. The premium payable by the company shall be two pounds ten shillings (£2 10s.), and the annual sum so payable two pounds ten shillings (£2 10s.).
  3. The term of the license shall be fourteen years from the 1st day of July, 1945.

    The South-eastern Side of Portion of Beach Road and the North-eastern and South-western Sides of Portions of an Unnamed Street, in the Borough of Richmond, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line

    ORDER IN COUNCIL
    At the Government House at Wellington, this 25th day of July, 1945
    Present:
    His Excellency the Governor-General in Council
    N pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Richmond Borough Council on the thirteenth day of February, one thousand nine hundred and forty-five, viz. :
    “The Richmond Borough Council, being the local authority having control of the roads in the Borough of Richmond, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to the south-eastern side of portion of Beach Road and the north-eastern and south-western sides of portion of public road fronting subdivision of part Sections 81 and 222, Waimea East, Block VII, Waimea Survey District, and contained in the Certificate of Title, Volume 23, folio 90”;
    subject to the condition that no building or part of a building shall at any time be erected on the land fronting the south-eastern side of the portion of Beach Road or the north-eastern side of the portion of the unnamed street or the south-western side of the portion of the unnamed street (described in the Schedule hereto) within a distance of thirty-three feet from the centre-lines of the said portions of streets.
    SCHEDULE
    THE south-eastern side of all that portion of street situated in the Nelson Land District, Borough of Richmond, known as Beach Road, fronting part Sections 81 and 222, District of Waimea East, Block VII, Waimea Survey District.
    Also the north-eastern side of portion of an unnamed street situated in the said land district and borough, fronting part Section 222, District of Waimea East, Block VII, Waimea Survey District.
    Also the south-western side of portion of an unnamed street situated in the said land district and borough, fronting part Section 81, District of Waimea East, Block VII, Waimea Survey District.
    As the same are more particularly delineated on the plan marked P.W.D. 121592, deposited in the office of the Minister of Works at Wellington, and thereon coloured red.

    The North-eastern Side of Portion of Springfield Road, in the County of Bruce and Borough of Milton, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line

    Present:
    His Excellency the Governor-General in Council
    N pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Bruce County Council on the first day of May, one thousand nine hundred and forty-five, viz. :-
    “The Bruce County Council, being the local authority having control of that part of Springfield Road lying to the south-east of the boundary of the Borough of Milton, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to the north-eastern side of the portion of the said Springfield Road under the control of the Bruce County Council which adjoins all that piece of land situate in the Tokomairiro District containing thirty-four acres two roods and one pole (34 acres 2 roods 1 pole), more or less, being part of Section One Hundred and One (101), Block Eleven (XI), on the map of the said district, and being the whole of the land included in Certificate of Title, Dunedin Register-book, Volume 252, folio 121”;
    and of the following resolution passed by the Milton Borough Council on the sixteenth day of May, one thousand nine hundred and forty-five, viz. :-
    “The Milton Borough Council, being the local authority having by virtue of a Warrant under the hand of His Excellency the Governor-General of the Dominion of New Zealand dated the sixteenth day of April, one thousand nine hundred and twenty-five, control of the road known as Springfield Road from its junction with Johnston Street to the terminating point of the boundary between the Borough of Milton and the County of Bruce along the said Springfield Road, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to the north-eastern side of the portion of the said Springfield Road under the control of the Milton Borough Council which adjoins all that piece of land situate in the Tokomairiro District containing thirty-four acres two roods and one pole (34 acres 2 roods 1 pole), more or less, being part of Section One Hundred and One (101), Block Eleven (XI), on the map of the said district, and being the whole of the land included in Certificate of Title, Dunedin Register-book, Volume 252, folio 121”;
    subject to the condition that no building or part of a building shall at any time be erected on the land fronting the north-eastern side of the portion of Springfield Road (described in the Schedule hereto) within a distance of thirty-three feet from the centre-line of the portion of the said road.
    SCHEDULE
    The north-eastern side of all that portion of Springfield Road situated in the Otago Land District, County of Bruce and Borough of Milton, fronting part Section 101, Block XI, and Farm 1, Deeds Plan 309, Tokomairiro District. As the same is more particularly delineated on the plan marked P.W.D. 121843, deposited in the office of the Minister of Works at Wellington, and thereon coloured red.

    Officers authorized to take and receive Statutory Declarations

    P URSUANT to the authority conferred upon me by the three-hundred-and-first section of the Justices of the Peace Act, 1927, I, Cyril Louis Norton Newall, the Governor-General of the Dominion of New Zealand, do hereby notify and declare that the persons whose names are set out in the Schedule hereto, being officers in the service of the Crown holding the offices stated opposite their names respectively in the said Schedule, are authorized to take and receive statutory declarations under the three-hundred-and-first section of the Justices of the Peace Act, 1927.
