The Feilding Milk District Constitution Order 1945

ORDER IN COUNCIL

At the Government House at Wellington, this 27th day of June, 1945

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

IN pursuance and exercise of the powers conferred on him by the Milk Act, 1944, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby order and declare as follows:—

  1. This Order may be cited as the Feilding Milk District Constitution Order 1945.

  2. The Borough of Feilding is hereby constituted and declared a milk district under the Milk Act, 1944, as from the fifteenth day of July, one thousand nine hundred and forty-five, with the name of the “Feilding Milk District”.

  3. The Milk Authority of the said milk district shall be the Feilding Borough Council.

The Palmerston North Metropolitan Milk District Constitution Order 1945

ORDER IN COUNCIL

At the Government House at Wellington, this 27th day of June, 1945

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

IN pursuance and exercise of the powers conferred on him by the Milk Act, 1944 (hereinafter referred to as the said Act), His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby order and declare as follows:—

  1. This Order may be cited as the Palmerston North Metropolitan Milk District Constitution Order 1945.

  2. Those parts of New Zealand comprising the City of Palmerston North and the County of Kairanga are hereby constituted and declared a milk district under the said Act as from the fifteenth day of July, one thousand nine hundred and forty-five, with the name of the “Palmerston North Metropolitan Milk District”.

  3. The Milk Authority of the said milk district shall be a Metropolitan Milk Board, to be known as the “Palmerston North Metropolitan Milk Board” (hereinafter referred to as the Milk Board).

  4. The Milk Board shall, subject to the provisions of section twenty of the said Act, consist of seven representatives of the constituent districts, of whom five shall be representatives of the City of Palmerston North and two shall be representatives of the County of Kairanga.

  5. The first election of members of the Milk Board shall be held on the fourteenth day of August, one thousand nine hundred and forty-five, and J. R. Hardie, Town Clerk, of Palmerston North, shall be the Returning Officer to conduct the first election; and for the purposes of that election—

(a) The offices of the Palmerston North City Council shall be deemed to be the offices of the Milk Board:

(b) Clause (1) of Regulation 7 of the Milk Board Election Regulations 1945 shall be read as if the words “twenty-eight days” were substituted for the words “forty-two days”.

The Southern Side of Portion of Picardy Street, the Western Side of Portion of Lesney Street, and the Northern Side of Portion of Maryhill Terrace, in the City of Dunedin, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Dunedin City Council on the ninth day of June, one thousand nine hundred and forty-one,

the portions of streets affected by such resolution being more particularly described in the Schedule hereto, viz.:—

“That the Dunedin City Council, being the local authority having control of the streets in the City of Dunedin, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to the undermentioned portions of streets, viz.:—

“(a) The southern side of the portion of Picardy Street adjoining subdivision of parts Lots 94 and 95, D.P. 1527, Glen Estate, being part Section 71, Block VI, Town District, such land being comprised and described in Certificates of Title, Register-book, Volume 156, folio 69, and Volume 261, folio 67, respectively:

“(b) The western side of the portion of Lesney Street adjoining subdivision of part Lot 95, D.P. 1527, Glen Estate, and part Lot 70, D.P. 866, Glen Estate, being parts Sections 70 and 71, Block VI, Town District, such land being comprised and described in Certificates of Title, Register-book, Volume 261, folio 67, and Volume 223, folio 150, respectively:

“(c) The northern side of the portion of Maryhill Terrace adjoining subdivision of parts Lots 70 and 71, D.P. 866, Glen Estate, being part Section 70, Block VI, Town District, such land being comprised and described in Certificate of Title, Register-book, Volume 223, folio 150”;

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the southern side of the portion of Picardy Street, or the western side of the portion of Lesney Street, or the northern side of the portion of Maryhill Terrace (described in the Schedule hereto) within a distance of thirty-three feet from the centre-lines of the said portions of streets.


SCHEDULE

THE southern side of all that portion of street situated in the Otago Land District, City of Dunedin, known as Picardy Street, fronting parts Lots 94 and 95, D.P. 1527, Glen Estate.

Also the western side of all that portion of street situated in the said land district and city, known as Lesney Street, fronting part Lot 95, D.P. 1527, Glen Estate, and part Lot 70, D.P. 866, Glen Estate.

Also the northern side of all that portion of street situated in the said land district and city, known as Maryhill Terrace, fronting parts Lots 70 and 71, D.P. 866, Glen Estate.

As the same are more particularly delineated on the plan marked P.W.D. 111434, deposited in the office of the Minister of Works at Wellington, and thereon coloured red.

PURSUANT to the authority conferred upon me by the three-hundred-and-first section of the Justices of the Peace Act, 1927, I, Cyril Louis Norton Newall, the Governor-General of the Dominion of New Zealand, do hereby notify and declare that Jack Leopold Gaelic, being an officer in the service of the Crown holding the office of Resident Officer, State Advances Corporation, at Timaru, is authorized to take and receive statutory declarations under the three-hundred-and-first section of the Justices of the Peace Act, 1927.

As witness the hand of His Excellency the Governor-General, this 21st day of June, 1945.
