The Servicemen’s Settlement and Land Sales Act, 1943.—Notice declaring Land taken for the Settlement of a Discharged Serviceman


WHEREAS an application has been made for the consent of the Land Sales Court to a transaction which relates to the land described in the Schedule hereto and to which Part III of the Servicemen’s Settlement and Land Sales Act, 1943, applies:

And whereas the Land Sales Committee to which the application has been referred is of opinion that the land to which the application relates is farm land suitable for the settlement of a discharged serviceman:

And whereas the said committee, not being satisfied that the Crown had decided not to acquire or arrange for the acquisition of the land, did on the 14th day of December, 1944, make an order determining the basic value of the land and no appeal from the said order was made within the time prescribed by the said Act or within any further time allowed by the Court:

And whereas the said land is not the land of any serviceman who is for the time being serving outside New Zealand in any of His Majesty’s Forces or in any British ship:

Now, therefore, the Minister of Lands, acting in pursuance of section 51 of the said Act, doth hereby declare that the said land is taken for the settlement of a discharged serviceman, and hereby specifies the 1st day of March, 1945, as the date on which the said land shall be deemed to be vested in His Majesty the King.


SCHEDULE

CANTERBURY LAND DISTRICT

ALL those pieces or parcels of land containing one hundred and forty-three (143) acres, more or less, being Rural Section 9788, District of Ellesmere, and Rural Sections 8783 and 9540, Block XIII, Leeston Survey District, and being all of the land comprised in certificates of title, Vol. 4, folio 146, and Vol. 366, folio 157 (limited as to parcels) (Canterbury Registry).

ALL that parcel of land containing fifty-nine (59) acres three (3) roods and thirty (30) perches, more or less, situated in Block XVI, Cloudy Bay Survey District, being part of Section 44, District of Opawa, and the whole of the land comprised in certificate of title, Vol. 32, folio 47 (Marlborough Registry) (limited as to parcels), subject to Grant of Easement No. 11730 creating drainage rights and the aforementioned agreement to lease dated the 1st day of August, 1944, from the Public Trustee to Edward Vernon Frost, of Blenheim, Farmer.
