Revoking the Declaration of a Main Highway and declaring Public Highways to be Main Highways

ORDER IN COUNCIL

At the Government Buildings at Wellington, this 15th day of November, 1944

Present:

THE HON. W. NASH PRESIDING IN COUNCIL.

IN pursuance and exercise of the powers and authorities vested in him by section three of the Main Highways Act, 1922, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby declare that, on and after the date of publication of this Order in Council in the Gazette, the portion of main highway described in the First Schedule hereto shall cease to be a main highway, and that the road described in the Second Schedule hereto shall be a main highway within the meaning and for the purposes of the Main Highways Act, 1922; and doth further declare that, as from the first day of April, one thousand nine hundred and forty-four, the roads described in the Third Schedule hereto shall be main highways within and for the purposes of the Main Highways Act, 1922.

FIRST SCHEDULE

HIGHWAY DISTRICT NO. 1

Birkenhead–Maungaturoto.—All that portion of the Birkenhead–Maungaturoto Main Highway, in the Otamatea County, commencing at a subway adjacent to Lot 2, D.P. 22850, Block VII, Otamatea Survey District, and proceeding thence generally in a northerly direction to and terminating at a point near the eastern boundary of Lot 9, D.P. 22991, Block III, Otamatea Survey District, being a distance of 1 mile 64 chains, more or less; as the same is more particularly delineated on plan P.W.D. 117590, deposited in the office of the Main Highways Board at Wellington, and thereon coloured yellow.

SECOND SCHEDULE

HIGHWAY DISTRICT NO. 1

Birkenhead–Maungaturoto.—All that road or portion of road in the Otamatea County, commencing at a subway adjacent to Lot 2, D.P. 22850, Block VII, Otamatea Survey District, and proceeding thence generally in a northerly direction on the eastern side of the North Auckland Main Trunk Railway-line and terminating at a point near the eastern boundary of Lot 9, D.P. 22991, Block III, Otamatea Survey District, being a distance of 1 mile 60 chains, more or less; as the same is more particularly delineated on plan P.W.D. 117590, deposited in the office of the Main Highways Board at Wellington, and thereon coloured green.

THIRD SCHEDULE

HIGHWAY DISTRICT NO. 3

Waiouru–Tokaanu.—All that road or portion of road in the Taupo County, commencing at its junction with the National Park–Taupo Main Highway near the Rangipo Prison Farm, and proceeding thence generally in a southerly direction and terminating at a point on the northern boundary of the Waimarino County two miles south of the Waikato River Bridge, being a distance of 20 miles 60 chains, more or less; as the same is more particularly delineated on plan P.W.D. 120162, deposited in the office of the Main Highways Board at Wellington; and thereon coloured green.

HIGHWAY DISTRICT NO. 8

Waiouru–Tokaanu.—All that road or portion of road in the Waimarino County, commencing at a point on the northern boundary of the said county two miles south of the Waikato River Bridge, and proceeding thence generally in a southerly direction and terminating at its junction with the Horopito–Bulls via Taihape Main Highway at Waiouru, being a distance of 12 miles 40 chains, more or less; as the same is more particularly delineated on plan P.W.D. 120162, deposited in the office of the Main Highways Board at Wellington, and thereon coloured green.

Warden under the Mining Act, 1926, appointed

ORDER IN COUNCIL

At the Government House at Wellington, this 6th day of December, 1944

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

WHEREAS by section nine of the Mining Act, 1926, it is enacted that the Governor-General may from time to time, by Order in Council, appoint fit persons to be Wardens, who shall hold office during the Governor-General’s pleasure:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the power and authority conferred by the said section nine of the Mining Act, 1926, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby appoint

Archibald Albany McLachlan, Esquire,

to be a Warden, to hold and exercise the duties of such office under and subject to the provisions of the said Act during pleasure, on and from the seventh day of November, one thousand nine hundred and forty-four.

Warden under the Mining Act, 1926, appointed

WHEREAS by section nine of the Mining Act, 1926, it is enacted that the Governor-General may from time to time, by Order in Council, appoint fit persons to be Wardens, who shall hold office during the Governor-General’s pleasure:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the power and authority conferred by the said section nine of the Mining Act, 1926, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby appoint

William Carrol Harley, Esquire,

to be a Warden, to hold and exercise the duties of such office under and subject to the provisions of the said Act during pleasure, on and from the eleventh day of September, one thousand nine hundred and forty-four.

At the Government House at Wellington, this 13th day of December, 1944

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

WHEREAS in pursuance of section one hundred and thirty-six of the Municipal Corporations Act, 1933, a petition was presented to the Governor-General praying that a certain area of land be excluded from the County of Heathcote and included in the City of Christchurch:

And whereas it is deemed expedient to make such alteration of boundaries:

Now, therefore, in pursuance and exercise of the powers and authorities vested in him by the said Municipal Corporations Act, 1933, and of all other powers and authorities enabling him in that behalf, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby declare that as on and from the first day of April, one thousand nine hundred and forty-five, the area described in the Schedule hereto shall be excluded from the County of Heathcote and included in the City of Christchurch.
