(described in the Schedule hereto) within a distance of thirty-three
feet from the centre-lines of the said portions of streets.
SCHEDULE
THE southern side of all that portion of street situated in the Otago
Land District, City of Dunedin, known as Neidpath Road, fronting
Lot 309, Deeds Plan 253, Glen Estate, being part Sections 94 and 95,
Block VI, Town District.
Also the southern side of all that portion of street situated in
the said land district and city, known as Dalry Street, fronting
Lots 309, 310, and 311, Deeds Plan 253, Glen Estate, being parts
Sections 94 and 95, Block VI, Town District.
As the same are more particularly delineated on the plan marked
P.W.D. 120386, deposited in the office of the Minister of Works at
Wellington, and thereon coloured red.

Portions of Maxwell Cross Road and the Western Side of Portion of
Handley Road, in the County of Waitotara, exempted from the
Provisions of Section 128 of the Public Works Act, 1928, subject
to Conditions as to the Building-lines

ORDER IN COUNCIL
At the Government House at Wellington, this 13th day of
December, 1944
Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL
IN pursuance and exercise of the powers conferred by the Public
Works Act, 1928, and of all other powers in anywise enabling
him in this behalf, His Excellency the Governor-General of the
Dominion of New Zealand, acting by and with the advice and consent
of the Executive Council of the said Dominion, doth hereby approve
of the following resolution passed by the Waitotara County Council
on the fourteenth day of November, one thousand nine hundred
and forty-four, viz. :
“ That the Waitotara County Council, being the local
authority having control of the roads in the County of Wait-
totara, by resolution declares that the provisions of section
one hundred and twenty-eight of the Public Works Act, 1928,
shall not apply to the western side of the portion of Handley
Road adjoining parts Sections 42 and 56 (C.T. 339/40), and to
both sides of Maxwell Cross Road adjoining parts Sections 42
and 56 and through Sections 57, 58, 59, and part Section 50,
and to the north-western side of Maxwell Cross Road adjoining
part Section 50 from a point opposite the north-east corner
of D.P. 5974 to the sea-coast, all in Blocks XIII and XIV,
Nukumaru Survey District, and adjacent to C.T. 311/211 and
C.T. 339/40 ” ;
subject to the condition that no building or part of a building shall
at any time be erected on the land fronting the western side of
portion of Handley Road or the side or portion of Maxwell Cross
Road (described in the Schedule hereto) within a distance of thirty-
three feet from the centre-lines of the said portions of roads.
SCHEDULE
FIRST, the western side of all that portion of road situated in the
Wellington Land District, County of Waitotara, known as Handley
Road, adjoining or passing through part Sections 42 and 56, Waito-
tara District, Block XIV, Nukumaru Survey District.
Secondly, all that portion of road situated in the said land
district and county, known as Maxwell Cross Road, adjoining or
passing through Sections 57 and 58 and part Sections 42, 50, 56,
and 59, Waitotara District, Blocks XIII and XIV, Nukumaru
Survey District.
Thirdly, the north-western side of all that portion of road
situated in the said land district and county, known as Maxwell
Cross Road, adjoining or passing through part Section 50, Wai-
totara District, Block XIII, Nukumaru Survey District.
As the same are more particularly delineated on the plan
marked P.W.D. 120344, deposited in the office of the Minister of
Works at Wellington, and thereon coloured red.

IN pursuance and exercise of the powers conferred by the Public
Works Act, 1928, and of all other powers in anywise enabling
him in this behalf, His Excellency the Governor-General of the
Dominion of New Zealand, acting by and with the advice and consent
of the Executive Council of the said Dominion, doth hereby approve

the twenty-sixth day of October, one thousand nine hundred and
forty-four, viz. :
“ The Auckland City Council, being the local authority
having control of the streets in the City of Auckland, by
resolution declares that the provisions of section one hundred
and twenty-eight of the Public Works Act, 1928, shall not apply
to that portion of Awatea Road adjoining Lots 6, 7, and 8,
D.R.O. 35, being portion of Allotments 8, 9, 16, and 23A,
Section 2, Suburbs of Auckland ” ;

any time be erected on the land fronting either side of portion of
Awatea Road (described in the Schedule hereto) within a distance
of thirty-three feet from the centre-line of the said portion of street.
SCHEDULE
ALL that portion of street situated in the North Auckland Land
District, City of Auckland, known as Awatea Road, adjoining parts
Lot 6 and Lots 7 and 8, on plan lodged in the Deeds Registry Office
at Auckland as No. 35, being parts of Allotments 8, 9, 16, and 23A,
Section 2, Suburbs of Auckland. As the same is more particularly
delineated on the plan marked P.W.D. 120530, deposited in the
office of the Minister of Works at Wellington, and thereon coloured
red.

Regulations under the Naval Defence Act, 1913, amended

on him by section twenty-five of the Naval Defence Act, 1913,
and of all other powers and authorities enabling him in that behalf,
His Excellency the Governor-General, with the advice of the Execu-
tive Council, doth hereby amend and supplement the regulations
referred to in the Schedule hereto as shown therein.
SCHEDULE
Regulations for the Government and Payment of the Royal New
Zealand Navy, 1939
ARTICLE 144, paragraph 2 : Cancel and substitute :
“ 2. Notwithstanding that a good-conduct badge has been
awarded or restored on an incorrect date, badge pay will, in all
cases, be payable from the due date and adjustments in badge pay
are to be made accordingly, if necessary. ”
