Portion of Road, known as “Sand Track”, in the Hutt County,
exempted from the Provisions of Section 128 of the Public Works
Act, 1928, subject to a Condition as to the Building-line

ORDER IN COUNCIL
At the Government Buildings at Wellington, this 7th day of
June, 1944
Present:
THE HON. D. G. SULLIVAN PRESIDING IN COUNCIL
IN pursuance and exercise of the powers conferred by the Public
Works Act, 1928, and of every other power in anywise enabling
him in this behalf, His Excellency the Governor-General of the
Dominion of New Zealand, acting by and with the advice and
consent of the Executive Council of the said Dominion, doth hereby
approve of the following resolution passed by the Hutt County
Council on the thirty-first day of March, one thousand nine hundred
and forty-four, in so far as it affects the side and portion of the road
described in the Schedule hereto:-
“ The Hutt County Council, being the local authority having
control of the roads in the County of Hutt, by resolution
declares that the provisions of section one hundred and twenty-
eight of the Public Works Act, 1928, shall not apply to the
road known as ‘Sand Track’, Paekakariki, adjoining the
land containing two roods fourteen decimal two perches, being
part Section 45, Wainui District, and being Lots 48 and 50
on Deposited Plan 2009, and being all the land in Certificate of
Title, Volume 216, folio 50”;
subject to the condition that no building or part of a building shall
at any time be erected on the land fronting the southern side of the
portion of road known as “ Sand Track ” (described in the Schedule
hereto) within a distance of thirty-three feet from the centre-line
of the said portion of road.
SCHEDULE
THE southern side of all portion of road situated in the Wellington
Land District, Hutt County, known as “ Sand Track ”, and fronting
part Section 45, Wainui District, being Lot 50, D.P. 2009. As the
same is more particularly delineated on the plan marked P.W.D.
119364, deposited in the office of the Minister of Works at Wellington,
and thereon coloured red.

Portions of Roads, in the County of Wairarapa South, exempted from
the Provisions of Section 128 of the Public Works Act, 1928,
subject to a Condition as to the Building-line.

June, 1944

His Excellency the Governor-General in Council
IN pursuance and exercise of the powers conferred by the Public
Works Act, 1928, and of all other powers in anywise enabling
him in this behalf, His Excellency the Governor-General of the
Dominion of New Zealand, acting by and with the advice and consent
of the Executive Council of the said Dominion, doth hereby approve
of the following resolution passed by the Wairarapa South County
Council on the sixteenth day of March, one thousand nine hundred
and forty-four, the said portions of roads being more particularly
described in the Schedule hereto, viz.:—
“ The Wairarapa South County Council, having control
of portion of Cornwall Road between Sections 71, 70, Taratahi
Plain Block, and 72, Taratahi Plain Block, also portion of Dorset
Road between Sections 73 and 47, Taratahi Plain Block, Sections
72 and 48, Taratahi Plain Block, and Sections 72 and 49,
Taratahi Plain Block, and Sections 70 and 49, Taratahi Plain
Block, and running through Section 350, Taratahi Plain Block,
and the road between Sections 73 and 157, Taratahi Plain Block,
Sections 73 and 158, Taratahi Plain Block, Sections 72 and 158,
Taratahi Plain Block, Sections 72 and 159, Taratahi Plain Block,
Sections 71 and 160, Taratahi Plain Block, and running through
Section 349, Taratahi Plain Block, and being all the land com-
prised and described in Certificates of Title, Volume 157, folio
165, Volume 400, folio 290, Volume 163, folio 95, and Volume
204, folio 105, by resolution declares that the provisions of
section one hundred and twenty-eight of the Public Works Act,
1928, shall not apply to the above-described portions of the
said roads”;
subject to the condition that no building or part of a building shall
at any time be erected on the land fronting the portions of roads
(described in the Schedule hereto) within a distance of thirty-three
feet from the centre-lines of the said portions of roads.
SCHEDULE
ALL that portion of road situated in the Wellington Land District,
County of Wairarapa South, known as Dorset Road, adjoining or
passing through Sections 47, 48, 49, 70, 72, 73 and 350, Taratahi
Plain Block.
Also all that portion of road situated in the said land district
and county known as Cornwall Road, adjoining or passing through
Sections 70, 71, and 72, Taratahi Plain Block.
Also all that portion of unnamed land situated in the said land
district and county adjoining or passing through Sections 157, 158,
159, 160, 71, 72, 73 and 349, Taratahi Plain Block.
As the same are more particularly delineated on the plan marked
p.w.d. 119142, deposited in the office of the Minister of Works at
Wellington, and thereon coloured red.

exempted from the Provisions of Section 128 of the Public Works
- Act, 1928, subject to a Condition as to the Building-line

ORDER IN COUNCIL
At the Government Buildings at Wellington, this 7th day of
June, 1944
Present:
THE HON. D. G. SULLIVAN PRESIDING IN COUNCIL
IN pursuance and exercise of the powers conferred by the Public
Works Act, 1928, and of every other power in anywise enabling
him in this behalf, His Excellency the Governor-General of the
Dominion of New Zealand, acting by and with the advice and consent
of the Executive Council of the said Dominion, doth hereby approve
of the following resolution passed by the Otaki Borough Council on
the eighth day of December, one thousand nine hundred and forty-
three, viz.:—
“ That the Otaki Borough Council, being the local authority
having control of the streets in the Borough of Otaki, by resolution
declares that the provisions of section one hundred and
twenty-eight of the Public Works Act, 1928, shall not apply
either to the north-western side of the portion of street known
as Matene Street, Otaki (shown on the undermentioned certificates of title as No. 2 Street), adjoining those parcels of land
containing-firstly, one rood four perches (1 rood 4 perches),
more or less, situated in the Town of Hadfield, or Otaki; and
named by the Native Land Court on partition 'Otaki Section
51,' and being all the land comprised and described in Certificate
of Title, Volume 102, folio 175 (Wellington Register); and,
secondly, twenty-two perches (22 perches), more or less, being
Section 52A, Township of Otaki, and being all the land comprised
and described in Certificate of Title, Volume 86, folio 102 (Well-
ington Register), or to the south-western side of the portion of
street known as Mill Road, Otaki, adjoining the parcel of land
secondly above described”;
subject to the condition that no building or part of a building shall
at any time be erected on the land fronting the north-western side
of the portion of Matene Street or the south-western side of the
portion of Mill Road (described in the Schedule hereto) within a
distance of thirty-three feet from the centre-lines of the said portions
of streets.
