Domain Board appointed to have Control of the Taneatua Domain

Present:

THE HON. D. G. SULLIVAN PRESIDING IN COUNCIL

IN pursuance and exercise of the powers conferred by section forty-four of the Public Reserves, Domains, and National Parks Act, 1928, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby appoint

Alexander Fraser McGougan,
Neil Stewart Reid,
Alan Kirkland Prince,
Frederick John Hayward, and Bernard Fletcher Grace

to be the Taneatua Domain Board, having control of the land described in the Schedule hereto ; and doth hereby appoint Wednesday, the thirty-first day of May, one thousand nine hundred and forty-four, at eight o'clock p.m., as the time when, and the Domain Pavilion, Taneatua, as the place where, the first meeting of the Board shall be held.

Section 11, Block IX, Whakatane Survey District : Area, 10 acres, more or less.
Also Allotment 376, Waimana Parish : Area, 3 acres 1 rood 21 perches, more or less.

IN pursuance and exercise of the powers conferred by section forty-four of the Public Reserves, Domains, and National Parks Act, 1928, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby appoint

Thomas Davidson,
Reuben Charles Porter,
Oscar Edinborough Chamberlain, Gordon James Carlyle Bennett, and George Boswell

to be the Beachlands Domain Board, having control of the land described in the Schedule hereto; and doth hereby appoint Wednesday, the seventh day of June, one thousand nine hundred and forty-four, at eight o'clock p.m., as the time when, and the residence of Mr. T. Davidson, 7 Rahiri Road, Mount Eden, as the place where, the first meeting of the Board shall be held.

BEACHLANDS DOMAIN.—NORTH AUCKLAND LAND DISTRICT

ALL that area in the Manukau County, containing by admeasurement 7 acres 1 rood 38.2 perches, more or less, being Lots 40 and 1130 on Deeds Plan 619, being portion of Allotment 44, Parish of Maraetai; Lots 108, 114, 157, 167, 175, and 1131 on Deeds Plan 619, being portion of Allotment 17, Parish of Maraetai. As the same is more particularly delineated on the plan marked L. and S. 1/875, deposited in the Head Office, Department of Lands and Survey, at Wellington, and thereon edged red.

Revoking the Reservation over a Reserve in the Town of Milton, Otago Land District

IN pursuance and exercise of the powers and authorities conferred upon him by subsection one (b) of section seven of the Public Reserves, Domains, and National Parks Act, 1928, His Excellency the Governor-General of the Dominion of New Zealand,

acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby revoke the reservation for a site for a courthouse and police purposes over the land described in the Schedule hereto; and doth hereby declare that the said land, being vested in the Crown, is Crown land available for disposal under the Land Act, 1924.

Licensing the Benara Timber Company, Limited, to use and occupy a Part of the Foreshore and Land below Low-water Mark at Mangarakau, in Westhaven Inlet, as a Site for a Wharf, and prescribing Dues for the Use of same

At the Government Buildings at Wellington, this 7th day of June, 1944

Present:

THE HON. D. G. SULLIVAN PRESIDING IN COUNCIL

PURSUANT to the Harbours Act, 1923, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby license and permit the Benara Timber Company, Limited, of Nelson (hereinafter called "the company", which term shall include its successors or assigns, unless the context requires a different construction), to use and occupy a part of the foreshore and land below low-water mark at Mangarakau, in Westhaven Inlet, as shown on approved plan marked M.D. 8278, and deposited in the office of the Marine Department at Wellington, for the purpose of maintaining thereon a wharf as shown on the said plan, such license to be held and enjoyed by the company upon and subject to the terms and conditions set forth in the First Schedule hereto, and doth prescribe that the dues and rates specified in the Second Schedule hereto shall be charged and taken by the company for the use of the said wharf.

FIRST SCHEDULE

CONDITIONS

  1. THIS license is subject to the Foreshore License Regulations 1940, and the provisions of those regulations shall, so far as applicable, apply hereto.
  2. The term of the license shall be fourteen years from the date hereof.
  3. The premium payable by the company shall be two pounds ten shillings (£2 10s.), and the annual sum so payable two pounds (£2).
  4. The master of every vessel discharging ballast at the said wharf shall deposit such ballast above high-water mark, or at such place as may be approved by the Minister or by any person appointed by the Minister for that purpose.

SECOND SCHEDULE

DUES

EVERY person loading cargo on or shipping cargo from the said wharf shall pay to the company wharfage dues as follows:—

Dunning, of Motukaraka (hereinafter called "the licensee", which term shall include his executors, administrators, or assigns, unless the context requires a different construction), to use and occupy a part of the foreshore at Motukaraka, Wairupe Creek, Hokianga Harbour, as shown on approved plans marked M.D. 6791 and 8179, and deposited in the office of the Marine Department at Wellington, for the purpose of maintaining thereon a piggery as shown on the said plans, such license to be held and enjoyed by the licensee upon and subject to the terms and conditions set forth in the Schedule hereto.
