Proclaiming Native Land to be vested in His Majesty the King

A PROCLAMATION

PURSUANT to section four hundred and fifty of the Native Land Act, 1931, I, Cyril Louis Norton Newall, the Governor-General of the Dominion of New Zealand, do hereby proclaim and declare that the Native land described in the Schedule hereto is vested in His Majesty the King.

SCHEDULE

ALL that area in the Auckland Land District containing 337 acres 0 roods 16 perches, more or less, being Karuotewhenua 3D 3E 2B Block, situated in Blocks II and III, Otanake Survey District, and being all the land comprised and described in Certificate of Title, Volume 270, folio 36 (Auckland Registry).

Given under the hand of His Excellency the Governor-General of the Dominion of New Zealand, and issued under the Seal of that Dominion, this 7th day of June, 1944.

Consenting to the Borrowing of Moneys by the King Country Electric-power Board by Way of Bank Overdraft

ORDER IN COUNCIL

At the Government Buildings at Wellington, this 31st day of May, 1944

Present:

THE HON. D. G. SULLIVAN PRESIDING IN COUNCIL

WHEREAS by Order in Council made on the ninth day of June, one thousand nine hundred and forty-three (hereinafter referred to as “the said Order in Council”), and subject to the determinations as to borrowing and repayment therein set out, consent was given to the borrowing of moneys by the King Country Electric-power Board (hereinafter referred to as “the said local authority”), by way of bank overdraft under section seventy-one of the Electric-power Boards Act, 1925 :

And whereas it was provided by the said Order in Council that the total amount owing (including unpaid interest, if any) of moneys borrowed thereunder should not on the thirty-first day of March, one thousand nine hundred and forty-four, exceed the sum of two thousand pounds (£2,000):

And whereas it was also provided by the said Order in Council that no moneys should be borrowed under the authority contained therein after the thirty-first day of March, one thousand nine hundred and forty-four:

And whereas the amount outstanding of moneys borrowed under the said Order in Council as at the thirty-first day of March, one thousand nine hundred and forty-four, amounted to one thousand and twenty-seven pounds sixteen shillings and eleven-pence (£1,027 16s. 11d.) :

And whereas it is expedient to authorize the said local authority to borrow further moneys by way of bank overdraft under the said section seventy-one, but so that the total amount outstanding by way of bank overdraft under the said section seventy-one as at the thirty-first day of March, one thousand nine hundred and forty-five (including unpaid interest, if any), shall not exceed the sum of two thousand pounds (£2,000) :

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in pursuance and exercise of the powers and authorities conferred on him by section eleven of the Local Government Loans Board Act, 1926, as set out in section twenty-nine of the Finance Act, 1932 (No. 2), and of all other powers and authorities enabling him in this behalf, doth hereby consent to the borrowing of moneys by the said local authority under the said section seventy-one, and in giving such consent doth determine as follows :—

(1) Such borrowing may be from time to time by way of bank overdraft.

(2) The rate of interest payable from time to time shall not exceed the current bank overdraft rate of interest to best customers.

(3) No moneys shall be borrowed under this authority at any time after the thirty-first day of March, one thousand nine hundred and forty-five.

(4) The total amount owing (including unpaid interest, if any) of moneys borrowed by way of bank overdraft under the said section seventy-one shall not on the thirty-first day of March, one thousand nine hundred and forty-five, exceed the sum of two thousand pounds (£2,000).

Domain Board appointed to have Control of the Te Aroha Sports Domain

THE HON. D. G. SULLIVAN PRESIDING IN COUNCIL

IN pursuance and exercise of the powers conferred by section forty-four of the Public Reserves, Domains, and National Parks Act, 1928, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby appoint

John David Mackay, Walter Edward Smith, Francis Thomas Halligan, Gerard Henry Nicholls, James Johnson, George Hedge, and William Alexander Clark

to be the Te Aroha Sports Domain Board, having control of the land described in the Schedule hereto; and doth hereby appoint Monday, the third day of July, one thousand nine hundred and forty-four, at eight o'clock p.m., as the time when, and the Te Aroha News Board-meeting Room, Te Aroha, as the place where, the first meeting of the Board shall be held.

TE AROHA SPORTS DOMAIN.—AUCKLAND LAND DISTRICT SECTION 113, Block IX, Aroha Survey District: Area, 68 acres, more or less. Also Section 8, Block XI, Aroha Survey District: Area, 39 acres 1 rood, more or less.
