Appointing a Commission to inquire into and report on certain Proposed Developmental Works near the Mouth of the Hutt River

To all unto whom these present shall come, and to The Honourable Sir Francis Vernon Frazer, Knight, of Wellington, John Wood, Esquire, C.M.G., M.Inst.C.E., of Wellington, Civil Engineer, and Drummond Holderness, Esquire, M.Inst.C.E., of Auckland, Civil Engineer: GREETING.
WHEREAS replacement of the pipe bridge over the Hutt River has become an urgent necessity:
And whereas the location and design of the necessary new bridge will affect vitally the future development of the lands and the harbour and transport facilities in the vicinity:
And whereas developmental works that have been suggested include—
(a) The diversion of the Hutt River from a point near Gear Island to permit the construction of a harbour for overseas shipping within the present mouth of the river:
(b) As an alternative the construction of a harbour for such shipping between Point Howard and the present mouth of the river:
(c) In addition, the construction of a spurline of railway to serve such harbour works, as well as industries which may be established in the vicinity:
And whereas certain of these matters have previously been the subject of investigations and are referred to in a report on the Hutt Valley Development Scheme by J. W. Mawson, Esquire, Dip.C.D., F.R.I.B.A., M.T.P.I., Town-planning Officer of the Department of Internal Affairs, in the year one thousand nine hundred and forty:
And whereas it is desirable that inquiries should be made as to the necessity or desirability of the several suggested works:
And whereas legislation may be desirable to make special provision in respect of the several foregoing matters or any of them:
Now, therefore, I, Cyril Louis Norton Newall, the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the powers and authorities vested in me by the Commissions of Inquiry Act, 1908, and of all other powers and authorities enabling me in this behalf, and acting by and with the advice and consent of the Executive Council of the said Dominion, and for the purposes herein set forth, do hereby appoint you, the said
Francis Vernon Frazer,
John Wood, and
Drummond Holderness
to be a Commission to inquire into and report upon the following matters:—
(1) Is the construction of a harbour at or near the mouth of the Hutt River necessary in the public interest?
(2) If so, where should it be located? If at the mouth of the Hutt River, should the river be diverted, and, if so, where should the diversion be located?
(3) For what classes of shipping should it provide berthage, and what depth of water at the wharves do you consider necessary for such shipping?
(4) What would be the general nature of such a harbour? What class of construction do you recommend for the proposal and what means of obtaining and maintaining the depth of water is recommended?
(5) What facilities, including rail and road access, should be provided for its efficient operation?
(6) What should be the approximate cost of such a harbour?
(7) How soon should it be constructed?
(8) If the construction of such a harbour is recommended, but not as a scheme for early construction, what action is necessary at the present time, in case harbour facilities should be required at some later date?
(9) If the diversion of the Hutt River is recommended, in what respects and to what extent is the diversion likely to affect the Petone foreshore?
(10) What provision, if any, should be made in the design and construction and location of a new bridge to replace the existing pipe bridge over the Hutt River to facilitate developmental works, such as rail service to industries which may be established in the vicinity and to any harbour works which the Commission may recommend, as well as to facilitate the diversion of the river, if recommended, and, in any event, the use of it as a waterway?
(11) If a harbour is not considered necessary in the near future, what transport facilities should be provided to enable the residential, commercial, and industrial life of the area to be carried on efficiently and economically?
(12) What is your view of the proposals relating to harbour and transport facilities generally included in the report on the Hutt Valley Development Scheme referred to in the recitals to this Warrant?
And generally upon such other matters arising thereout as may come to your notice in the course of your inquiries and which you consider should be investigated in connection therewith, and upon any matters affecting the position which you consider should be brought to the attention of the Government:
And, with the like advice and consent, I do further appoint you, the said
Francis Vernon Frazer,
to be Chairman of the said Commission:
And you are hereby authorized to conduct any inquiry in these presents at such times and places as you deem expedient, with power to adjourn from time to time and place to place as you think fit, and to call before you and examine on oath or otherwise such persons as you think capable of affording you information as to the matters aforesaid, and to call for and examine such books, papers, writings, documents, and records as you deem likely to afford you the fullest information on any such matters:
And, using all due diligence, you are required to report to me under your hands and seals not later than the thirtieth day of June, one thousand nine hundred and forty-four:
And you are hereby strictly charged and directed that you shall not at any time publish or otherwise disclose, save to me in pursuance of these presents or by my direction, the contents or purport of any report so made or to be made by you:
And it is hereby declared that this Commission shall continue in full force and virtue although the inquiry be not regularly continued from time to time or from place to place by adjournment:
And, lastly, it is hereby further declared that these presents are issued under and subject to the provisions of the Commissions of Inquiry Act, 1908.

PURSUANT to the authority vested in me by section sixty-five of the Cook Islands Act, 1915, and by an Order in Council of the twenty-first day of March, one thousand nine hundred and sixteen, providing for the constitution of Island Councils in the Cook Islands, I, Cyril Louis Norton Newall, the Governor-General of the Dominion of New Zealand, do hereby nominate and appoint
Hunuki Ikihagai and Talaiti
to be members of the Island Council of Niue, to hold office during my pleasure as from the thirteenth day of March, one thousand nine hundred and forty-four, vice Paihele Hagatau and Kalotuki, deceased.
As witness the hand of His Excellency the Governor-General of the Dominion of New Zealand, this 19th day of April, 1944.

Allocating Land reserved and taken for a Railway to the Purposes of a Road at Whangamarino

A PROCLAMATION
WHEREAS the land described in the Schedule hereto forms part of land taken for the purposes of the Kaipara–Waikato Railway, and it is considered desirable to allocate such land to the purposes of a road:
Now, therefore, I, Cyril Louis Norton Newall, the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the powers and authorities vested in me by section two hundred and twenty-six of the Public Works Act, 1928, and of every other power and authority in anywise enabling me in this behalf, do hereby proclaim and declare that the land described in the Schedule hereto shall, upon the publication hereof in the New Zealand Gazette, become a road, and that the said road shall be under the control of the Waikato County Council, and shall be maintained by the said Council in like manner as other public highways are controlled and maintained by the said Council.
