THE eastern side of all that portion of road situated in the Nelson

Kaiteriteri Survey District. As the said portion of road is more
particularly delineated on the plan marked P.W.D. 118844, deposited
in the office of the Minister of Works at Wellington, and thereon
coloured red.

the Provisions of Section 128 of the Public Works Act, 1928,
subject to a Condition as to the Building-line

ORDER IN COUNCIL
At the Government House at Wellington, this 5th day of
April, 1944
Present :
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL
IN pursuance and exercise of the powers conferred by the Public
Works Act, 1928, and of every other power in anywise enabling
him in this behalf, His Excellency the Governor-General of the
Dominion of New Zealand, acting by and with the advice and
consent of the Executive Council of the said Dominion, doth hereby
approve of the following resolution passed by the Otaki Borough
Council on the tenth day of November, one thousand nine hundred
and forty-three, viz. :
“ That the Otaki Borough Council, being the local authority
having control of the streets in the Borough of Otaki, by resolu-
tion declares that the provisions of section one hundred and
twenty-eight of the Public Works Act, 1928, shall not apply
to the north-western side of the portion of street known as
Dunstan Street, Otaki, adjoining those parcels of land con-
taining in all three roods thirty perches (0 acres 3 roods 30·0
perches), more or less, situated in the Borough of Otaki, being
Lots 34, 35, 36, and 37 on the plan of subdivision of Hanganoaiho
No. 1, deposited in the District Land Registry Office, No.
633, and being the balance of the land comprised and described
in Certificate of Title, Volume 77, folio 90 (Wellington Register) ”;
subject to the condition that no building or part of a building shall
at any time be erected on the land fronting the north-western side
of the portion of Dunstan Street (described in the Schedule hereto)
within a distance of thirty-three feet from the centre-line of the
said portion of street.

Street, and fronting Lots 34, 35, 36, and 37 on the plan of the sub-
division of Hanganoaiho No. 1, deposited in the Land Registry

of the Minister of Works at Wellington, and thereon coloured red.

Sections 5 and 6, all in Block XXIII, Town of Balclutha ”;
subject to the condition that no building or part of a building shall
at any time be erected on the land fronting portions of Yare Lane
(described in the Schedule hereto) within a distance of thirty-three
feet from the centre-lines of the said portions of street.

Lands permanently reserved in the Auckland, Taranaki, Marlborough,
and Otago Land Districts
———

WHEREAS by the three-hundred-and-fifty-ninth section of the
Land Act, 1924, it is enacted that the Governor-General
may from time to time set apart temporarily as reserves, notwith-
standing that the same may be then held under pastoral license,
any Crown lands which in his opinion are required for any of the
purposes in the said section mentioned :
And whereas by the three-hundred-and-sixtieth section of the
said Act it is provided that land temporarily reserved under the
said three-hundred-and-fifty-ninth section may, at the expiration of
one month, but not later than six months, after the publication in
the Gazette of notice of such temporary reservation, be permanently
reserved, and that notice of such permanent reservation shall be
published in the Gazette :
And whereas by the seventy-first section of the Land for
Settlements Act, 1925, it is further provided that the Governor-
General may from time to time, as he thinks fit, set aside reserves
for any specified public purpose out of lands acquired under the last-
mentioned Act, provided that no land so acquired shall be set aside
for endowments :
