Revoking a Proclamation taking Land for Road in Block XVI, Mangaoporo Survey District, Waiapu County

A PROCLAMATION
IN pursuance and exercise of the powers and authorities vested in me by the Public Works Act, 1928, and of every other power and authority in anywise enabling me in this behalf, I, Cyril Louis Norton Newall, the Governor-General of the Dominion of New Zealand, do hereby revoke the Proclamation dated the third day of April, one thousand nine hundred and forty-three, and published in the New Zealand Gazette No. 24 of the eighth day of the same month, at page 423, taking land for road in Block XVI, Mangaoporo Survey District, Waiapu County.
Given under the hand of His Excellency the Governor-General of the Dominion of New Zealand, and issued under the Seal of that Dominion, this 23rd day of February, 1944.

IN pursuance and exercise of the powers conferred by section twelve of the Land Act, 1924, I, Cyril Louis Norton Newall, the Governor-General of the Dominion of New Zealand, do hereby proclaim as road the land described in the Schedule hereto.

Authorizing Thomas Lawrence Lowther, of Hokitika, Farmer, to use Water for the Purpose of generating Electricity and to erect certain Electric Lines

ORDER IN COUNCIL
At the Government House at Wellington, this 1st day of March, 1944
Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL
PURSUANT to the Public Works Act, 1928, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby grant to Thomas Lawrence Lowther, of Hokitika, Farmer (hereinafter referred to as “the licensee”), a license subject to the conditions hereinafter set forth to obstruct, impound, or divert the waters of the unnamed creek situated in Section 2372, Block XV, Wataroa Survey District, in the Land District of Westland, and to take and use therefrom for the purposes hereinafter set forth a stream of water not exceeding 2 cubic feet per second at any one time, and to erect the electric lines hereinafter described.
CONDITIONS
- IMPLIED CONDITIONS
The conditions directed to be implied in all licenses by the Water-power Regulations 1934 and the Electrical Supply Regulations 1935 shall be incorporated in and shall form part of this license, except in so far as the same may be inconsistent with the provisions hereof.
- LICENSE SUBJECT TO REGULATIONS
This license is issued under the Water-power Regulations 1934, the Electrical Supply Regulations 1935, and the Electrical Wiring Regulations 1935, and is subject thereto and to any regulations made or to be made in amplification or amendment thereof or in substitution therefor.
- UTILIZATION OF WATER AND LOCATION OF HEADWORKS
Water shall be used under this license solely for the purpose of generating electricity, and shall be taken from the said creek at a point in Section 2372, Block XV, Wataroa Survey District, in the Westland Land District, as indicated on the plan marked P.W.D. 117551, deposited in the office of the Minister of Works.
- GENERAL DESCRIPTION OF WORKS
The licensee is hereby authorized, subject to the conditions hereof, to construct, maintain, and use the following works for the purposes of this license, the positions of the said works being indicated on the said plan P.W.D. 117551:—
(a) Headworks consisting of a dam and intake giving a static head of approximately 10 ft.:
(b) Water-wheel and power-house with all necessary equipment for generating electricity:
(c) Electric lines leading from the power-house aforesaid across Section 2372, Block XV, Wataroa Survey District, and the adjoining Main South Road to the licensee’s dwelling in the aforesaid Section 2372, Block XV, Wataroa Survey District, the said lines being more particularly delineated on the aforementioned plan P.W.D. 117551.
- DURATION OF LICENSE
This license shall, unless sooner determined, continue in force until the 31st day of March, 1964, or until electrical energy is available from an Electric-power Board or other public source of supply, whichever is the earlier.
