The North-eastern Side of Portions of Clover Road, in the County of Waimea, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line

At the Government House at Wellington, this 13th day of October, 1943

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of every other power in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Waimea County Council on the ninth day of July, one thousand nine hundred and forty-three, viz.:

“ The Waimea County Council, being the local authority having control of the roads in the County of Waimea, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to the north-eastern side of the portions of Clover Road adjoining parts Section 138, Waimea East, Block X, Waimea Survey District, C.T. 44/242 ”;

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the north-eastern side of portions of Clover Road (described in the Schedule hereto) within a distance of thirty-five feet from the centre-line of the said portions of road.

SCHEDULE

THE north-eastern side of all those portions of road situated in the Nelson Land District, County of Waimea, known as Clover Road, adjoining parts Section 138, Waimea East, Block X, Waimea Survey District. As the same are more particularly delineated on the plan marked P.W.D. 117576, deposited in the office of the Minister of Works at Wellington, and thereon coloured red.

The North-western Side of Unnamed Public Road and the South-western Side of Portion of Circle Hill Road, in the County of Bruce, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line

ORDER IN COUNCIL

At the Government House at Wellington, this 13th day of October, 1943

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Bruce County Council on the sixth day of July, one thousand nine hundred and forty-three, viz.:

“ The Bruce County Council, being the local authority having control of the roads in the County of Bruce, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to—Firstly, the north-western side of that portion of the District Road which adjoins all that piece of land situate in the Tokomairiro District, containing two hundred and fifty-nine acres and twenty-six and five-tenths poles (259 acres 0 roods 26·5 poles), more or less, being Sections Nine (9), Ten (10), Eleven (11), and Sixteen (16), and part of Section Fifteen (15), Block Two (II), on the map of the said district, and being part of the land included in Certificates of Title, Dunedin Register-books, Volume 245, folio 69, and Volume 291, folio 125 ; and, secondly, the south-western side of the District Road known as the Circle Hill Road, which adjoins all that piece of land situate in the Tokomairiro District, containing one hundred acres and eight poles (100 acres 0 roods 8 poles), more or less, being parts of Sections Twenty-one (21) and Twenty-two (22), Block Three (III), on the map of the said district, and being the whole of the land included in Certificate of Title, Dunedin Register-book, Volume 252, folio 163 ”;

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the north-western side of portion of unnamed public road and the south-western side of portion of Circle Hill Road (described in the Schedule hereto) within a distance of thirty-three feet from the centre-lines of the said portions of roads.

SCHEDULE

THE north-western side of all that portion of unnamed public road situated in the Otago Land District, County of Bruce, fronting Sections 9, and 10, and 11, Block II, Tokomairiro District.

Also the south-western side of all that portion of road situated in the said land district and county, known as Circle Hill Road, fronting part Section 22, Block III, Tokomairiro District.

As the same are more particularly delineated on the plan marked P.W.D. 117647, deposited in the office of the Minister of Works at Wellington, and thereon coloured red.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of every other power in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Main Highways Board on the fifteenth day of September, one thousand nine hundred and forty-three, viz.:

“ The Main Highways Board, being the local authority having control of the highways in the County of Waimea, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to the north-western side of portion of the Nelson-Westport Main Highway adjoining all the land on D.P. 886, being Section 138 and part Section 134, Waimea East, Block X, Waimea Survey District ”;

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the north-western side of portion of Nelson-Westport Main Highway (described in the Schedule hereto) within a distance of thirty-five feet from the centre-line of the said portion of road.

THE north-western side of all that portion of the Nelson-Westport Main Highway situated in the Nelson Land District, County of Waimea, adjoining all the land on D.P. 886, being Section 138 and part Section 134, Waimea East, Block X, Waimea Survey District. As the same is more particularly delineated on the plan marked P.W.D. 117575, deposited in the office of the Minister of Works at Wellington, and thereon coloured red.

At the Government House at Wellington, this 13th day of October, 1943

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of every other power in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Dunedin City Council on the thirtieth day of August, one thousand nine hundred and forty-three, viz.:

“ That the Dunedin City Council, being the local authority having control of the streets in the City of Dunedin, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to the south-western side of the portion of Braeview Crescent adjoining Lot 27, D.P. 394, Township of Cannington, being part Section 3, Block VIII, Upper Kaikorai District, such land being comprised and described in Certificate of Title 137/279 ”;

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the south-western side of portion of Braeview Crescent (described in the Schedule hereto) within a distance of thirty-three feet from the centre-line of the said portion of street.
