ORDER IN COUNCIL

At the Government House at Wellington, this 13th day of October, 1943

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of every other power in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Upper Hutt Borough Council on the twenty-seventh day of September, one thousand nine hundred and forty-three, viz. :

“ The Upper Hutt Borough Council, being the local authority having control of the streets in the Borough of Upper Hutt, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to the western side of portion of Logan Street adjoining part Section 120, Hutt Registration District, situated in Block I, Rimutaka Survey District, and being the land included in Certificate of Title, Volume 348, folio 241 (Wellington Registry) ”; subject to the condition that no building or part of a building shall at any time be erected on the land fronting the western side of the portion of Logan Street (described in the Schedule hereto) within a distance of thirty-three feet from the centre-line of the said portion of street.


SCHEDULE

THE western side of all that portion of street situated in the Wellington Land District, Borough of Upper Hutt, known as Logan Street, fronting part Section 120 of the Hutt District, and being the land comprised and described in Certificate of Title, Volume 348, folio 241 (Wellington Registry). As the same is more particularly delineated on the plan marked P.W.D. 114204, deposited in the office of the Minister of Works at Wellington, and thereon coloured red.

Notifying the proposed Exchange of Crown Land in the North Auckland Land District for other Land

WHEREAS by section one hundred and sixty of the Land Act, 1924, it is enacted that it shall be lawful for the Governor-General, whenever he deems it expedient in the public interest, to grant in fee-simple any area of Crown land which is subject to the provisions of the Land Act, 1924, in exchange for the fee-simple of any other land, and on any such exchange to pay or receive any sum by way of equality of exchange :

And whereas, in the opinion of the Governor-General, it is expedient to exchange the Crown land described in the First Schedule hereto for the land of equal value described in the Second Schedule hereto, and the owner of the land described in the Second Schedule has agreed to such exchange :

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in exercise of the aforesaid powers and authorities, doth hereby declare it is his intention to grant in fee-simple the area of Crown land described in the First Schedule hereto in exchange for the fee-simple of the land described in the Second Schedule.


FIRST SCHEDULE

DESCRIPTION OF CROWN LAND TO BE EXCHANGED

North Auckland Land District

ALL that area in the Waitemata County situated in Block VII, Waiwera Survey District, containing by admeasurement, 1 rood and 24 perches, more or less, being Lots 111 and 112 of part Allotment 297, Parish of Waiwera. As the same is more particularly delineated on the plan marked L. and S. 4/417B, deposited in the Head Office, Department of Lands and Survey, at Wellington, and thereon edged red. SECOND SCHEDULE

DESCRIPTION OF LAND TO BE OBTAINED IN EXCHANGE THEREFOR

North Auckland Land District

ALL that area in the Bay of Islands County, containing by admeasurement 84 acres 14 perches, more or less, being Section 7, Block III, Kawakawa Survey District. As the same is more particularly delineated on the plan marked L. and S. 4/417B, deposited in the Head Office, Department of Lands and Survey, at Wellington, and thereon edged blue. (S.O. plan 19817.)

As witness the hand of His Excellency the Governor-General, this 7th day of October, 1943.
