And whereas, in pursuance of the provisions of the said section thirty of the said Act, a petition has been received praying that the area of land described in the Schedule hereto be constituted and declared a rabbit district under and for the purposes of Part II of the said Act:

And whereas the said petition is signed by a majority of the persons in the said area of land qualified to be enrolled on the ratepayers’ list for the said proposed district, and it is deemed expedient to give effect to the prayer of the petitioners accordingly:

Now, therefore, in pursuance and exercise of the powers and authorities conferred upon him by the said Act, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby constitute by the specific name of the “Opihi Rabbit District” and declare that area of land defined in the Schedule hereto to be a rabbit district under and for the purpose of Part II of the said Act; and doth hereby further declare that the basis on which the Board to be established for the said district shall first levy its general rate shall be on the basis of the acreage of the rateable property in the said district.

SCHEDULE

BOUNDARIES OF THE OPIHI RABBIT DISTRICT

ALL that area in the Counties of Mackenzie, Geraldine, and Levels, of the Canterbury Land District, containing 68,500 acres, more or less, bounded by a line commencing at a point on the centre-line of Gudex Road at its intersection with the centre-line of Cattle Valley Road in Block V, Opihi Survey District; then proceeding in a north-easterly direction generally along the said centre-line of Gudex Road to and across a bridge over the Opuha River at the western boundary of Rural Section 27300; then south-easterly generally along the Beautiful Valley Road to its junction with a public road at the south-western boundary of Rural Section 19980; then along that road to its junction with Howe’s Road; then along that road to its junction with Gapes Valley Road; then along that road to its junction with Patrick Road; then along that road to its junction with a public road on the western boundary of Rural Section 15818; then southerly along the said public road to its junction with Hilton Road; then south-westerly along that road to its junction with Beattie’s Road; then south-easterly generally along that road to its junction with Toomey’s Road; then along that road to its junction with Chapman’s Road and a public road; then southerly along the said public road to its junction with Boundary Road; then along that road to its junction with a public road in the centre portion of Rural Section 7160; then southerly along the said public road to its junction with a road at the southernmost corner of Rural Section 36396; and along that road to the left bank of the Hae Hae Te Moana River at the south-western corner of Rural Section 11474; then southerly generally by the said left bank of that river and the left bank of the Temuka River to the centre of the Main South Road; then south-westerly generally along that road to its junction with Point Temuka Road; then along that road to the south-eastern boundary of the Pleasant Point Town District; then north-westerly generally along that boundary to a public road at the south-western corner of Rural Section 7406; then north-westerly along that road to its junction with Aitken’s Road; then along that road to the right bank of the Opihi River at the north-western corner of Rural Section 5442; then north-westerly generally by the right bank of that river to and across Raincliff Bridge over the Opihi River to a public road at the southern boundary of Rural Section 36592; then north-easterly along that road to its junction with Burke’s Pass Road; then north-westerly along that road to its junction with Gudex Road; then along the centre of that road to the point of commencement.

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

IN pursuance and exercise of the powers conferred upon him by the Soil Conservation and Rivers Control Act, 1941, and of every other power in anywise enabling him in that behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby constitute and declare the parts of New Zealand described in the Schedule hereto a catchment district under the said Act as from this twenty-second day of September, one thousand nine hundred and forty-three, and doth hereby assign to such catchment district the name of the “Hawke’s Bay Catchment District.”

SCHEDULE

ALL those areas in the Hawke’s Bay Land District comprising:—

The Borough of Napier (New Zealand Gazette, 1942, page 950).

The Borough of Hastings (New Zealand Gazette, 1930, page 1145).

The Taradale Town District (New Zealand Gazette, 1941, page 245).

The Havelock North Town District (New Zealand Gazette, 1913, pages 973 and 1347).

That portion of the County of Hawke’s Bay, bounded by a line commencing at a point on the boundary of the County of Hawke’s Bay (New Zealand Gazette, 1942, page 950), being Trigonometrical Station 65A; then southerly along the summit of the Kaweka Range to Trigonometrical Station J at the intersection of the watershed between the Makahu River and the headwaters of the Donald River in Block XXI, Kaweka Survey District; then easterly along the said watershed through the said Block XXI to the southernmost corner of Block 131, Patoka Crown Grant District; then north-easterly and north-westerly along the south-eastern and north-eastern boundaries of the said Block 131 to the western boundary of Block XIII, Pohui Survey District; then north-easterly by a right line to Trigonometrical Station I in Block XIII, Pohui Survey District; then south-easterly by a right line to the intersection of the western boundary of Lot I, D.P. 3290, and a public road, and continuing along the southern side of that road for a distance of 40 chains; then north-easterly by a right line to the north-western corner of Section 103 (closed road), Block XIV, Pohui Survey District; then by a right line to the northernmost corner of Section 50, Block XIV aforesaid; then southerly and easterly along the eastern and northern boundaries of the said Section 50 to its north-eastern corner; then in a general southerly direction along the eastern boundary of the said Section 50, the northern and eastern boundaries of Section 52, Block XIV, Pohui Survey District, to and across Colyer’s Road, and along the southern and western sides of that road to a road forming the southern boundary of Section 21, Block XIV, Pohui Survey District; then across the last-mentioned road, to and along the western and southern sides of a public road, to and across the Hawkestone–Puketitiri Road to its eastern side; then easterly by a right line through Trigonometrical Station A to the north-eastern corner of Section 4, Block II, Patoka Survey District; then by a right line to Trigonometrical Station A in Block XV, Pohui Survey District; then north-easterly along the watershed between the Inangatahi Stream and Camp Stream, through Trigonometrical Station C in Block XVI, Pohui Survey District, to the north-western corner of Section 12, Block XVI, Pohui Survey District; then easterly along the northern boundary of the said Section 12, to and across to the eastern side of a public road; then generally north-easterly along the eastern side of that road, across the Napier–Taupo Road, to and along the north-western boundaries of Lot 1, D.P. 3831, Lots 3, 2, and 1, D.P. 3832, Maungaharuru Block (Education Reserve), and Section 4, Block XI, Waitara Survey District, to the southernmost corner of Section 6, Block V, Waitara Survey District; then south-easterly by a right line to the intersection of the western side of the Pohokura–Tutira Road with the eastern boundary of Section 6, Block XI, Waitara Survey District; then south-easterly along the western side of the aforesaid Pohokura–Tutira Road, to and along the north-eastern boundary of the Maungaharuru Block (Education Reserve), to its easternmost corner; then in a general south-easterly direction along the watershed between the Waionga Wahine Stream and the Pupakiri Stream through Blocks IV and VIII, Maungaharuru Survey District, to the westernmost corner of Section 3, Block VIII, Maungaharuru Survey District; then along the western boundary of the said Section 3 to a point due east of Trigonometrical Station YI in Block VIII, Maungaharuru Survey District; then by a right line to Trigonometrical Station Y in the aforesaid Block VIII; then by a right line across the Gisborne–Napier State Highway, continuing to the intersection of the southern side of the East Coast Main Trunk Railway and the western boundary of Section 3, Block X, Moeangiangi Survey District; then southerly along the western boundary of the said Section 3 to Trigonometrical Station V; then north-easterly by a right line towards Trigonometrical Station XXIX in Block VI, Moeangiangi Survey District, to a point approximately within 30 chains of the said Trigonometrical Station XXIX; then south-easterly by a right line to a public road abutting on Section 4, Block X, Moeangiangi Survey District; then generally easterly along the southern side of that road and the Mohaka Coast Road, to and along the northern boundary of Education Reserve 42N and its production to the sea-coast; then in a southerly, westerly, and northerly direction along the boundary of the County of Hawke’s Bay (New Zealand Gazette, 1942, page 950) to the point of commencement.

That portion of the County of Patangata, bounded by a line commencing at a point on the boundary of the County of Patangata (New Zealand Gazette, 1927, page 2929) at its intersection with the produced southern boundary of Arataura No. 2 in Block VIII, Tautane Survey District; then proceeding westerly along the said produced boundary and the southern boundaries of Sections Arataura Nos. 2 and 3 to and across to the western side of Porangahau–Wainui Road; then northerly along the western side of the last-named road to its intersection with the southern side of a public road in Section 2, Block III, Tautane Survey District; then westerly along the southern side of the last-mentioned public road and the southern side of Siteman’s Road to a point on the boundary of the County of Patangata aforesaid; then generally in westerly, northerly, easterly, and southerly directions along the boundary of the County of Patangata to the point of commencement.

Those portions of the County of Dannevirke, (a) bounded by a line commencing at a point on the boundary of the County of Dannevirke (New Zealand Gazette, 1926, page 126) at its intersection with the northern boundary of Block II, Norsewood Survey District; then proceeding easterly along the northern boundary of the said Block II to its intersection with the western boundary of Block III, Norsewood Survey District; then by a right line to the northernmost point of Lot 5, D.P. 2363; then in a general easterly direction along the northern boundary of the said Lot 5 on the said D.P. 2363 and the northern side of a public road to its intersection with the western side of the Norsewood–Makaretu Road; then southerly along the western side of the said Norsewood–Makaretu Road to a point in line with the southern boundary of Rakautatahi 1/2 Block; then easterly across the last-mentioned road, to and along the
