At the Government House at Wellington, this 30th day of June,
1943

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

IN pursuance and exercise of the powers vested in him by
the Public Works Act, 1928, and of all other powers in
anywise enabling him in this behalf, His Excellency the
Governor-General of the Dominion of New Zealand, acting
by and with the advice and consent of the Executive Council
of the said Dominion, doth hereby order and declare that
the portion of road described in the Schedule hereto shall,
on and after the date of this Order in Council, become
Government road.


SCHEDULE

APPROXIMATE area of the piece of road declared to be
Government road: 1 rood 35·2 perches.
Adjoining or passing through part Section 22.

Situated in Block XIII, Ngaere Survey District (Taranaki R.D.). (S.O. 7988.)

In the Taranaki Land District; as the same is more

Delegating Powers under the Cemeteries Act, 1908

At the Government House at Wellington, this 23rd day of June,
1943

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

PURSUANT to the Cemeteries Act, 1908, His Excellency the
Governor-General, acting by and with the advice and consent
of the Executive Council, doth hereby delegate to the Mangonui
County Council the powers conferred on him by section four of the
said Act of appointing and removing trustees in respect of the
Waipapakauri Cemetery, as described in the Schedule hereto.


SCHEDULE

WAIPAPAKAURI CEMETERY

ALL that area in Mangonui County containing by admeasurement
4 acres 0 roods 29 perches, more or less, being portion of Section 7,
Block VIII, Opoe Survey District, bounded: Commencing at the
south-western corner of Lot 8 on D.P. 27209, being a subdivision of
Maxwell’s Grant, in a westerly direction generally along a public
road for a distance of 824·6 links and 100 links; thence along right
lines bearing 51° 56′ distance 669·6 links, bearing 356° 19′ distance
538·7 links, bearing 86° 20′ distance 368·4 links, to the western
boundary of Lot 8 on D.P. 27209 aforesaid; and thence in a southerly
direction along the western boundary of Lot 8 aforesaid to the south-
western corner of that lot, the point of commencement. As the
same is more particularly delineated on the plan marked L: and S.
2/615A, deposited in the Head Office, Department of Lands and
Survey, at Wellington, and thereon bordered red. (North Auckland

Revoking a License held by William Oliver Rutherford authorizing the Use of Water for the Purpose of generating Electricity

At the Government House at Wellington, this 30th day of June,
1943

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

PURSUANT to the Public Works Act, 1928, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and with the consent of the licensee, doth hereby revoke the Order in Council dated the tenth day of June, one thousand nine hundred and thirty-seven, and published in the New Zealand Gazette No. 42 of the seventeenth day of the same month, authorizing William Oliver Rutherford to use water for the purpose of generating electricity.

The South-western Side of Portion of Bright Street and the South-eastern Side of Portion of Preston Crescent, in the City of Dunedin, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line

At the Government House at Wellington, this 30th day of June,
1943

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of every other power in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Dunedin City Council on the tenth day of May, one thousand nine hundred and forty-three, viz.:—

“That the Dunedin City Council, being the local authority having control of the streets in the City of Dunedin, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to the undermentioned portions of streets, viz.:—

“(a) The south-western side of the portion of Bright Street, adjoining Allotment 16, Block II, Belleknowes Estate;

“(b) The south-eastern side of the portion of Preston Crescent, adjoining Allotment 16, Block II, Belleknowes Estate”;

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the south-western side of portion of Bright Street and south-eastern side of portion of Preston Crescent (described in the Schedule hereto) within a distance of thirty-three feet from the centre-lines of the said portions of streets.


SCHEDULE

THE south-western side of all that portion of street situated in the Otago Land District, City of Dunedin, known as Bright Street, fronting Allotment 16, Block II, D.P. 444, Belleknowes Estate.

Also the south-eastern side of all that portion of street situated in the said land district and city, known as Preston Crescent, fronting Allotment 16, Block II, D.P. 444, Belleknowes Estate.

As the same are more particularly delineated on the plan marked P.W.D. 117070, deposited in the office of the Minister of Works at Wellington, and thereon coloured red.
