The Overtime and Holidays Labour Legislation Suspension Order 1941, Variation No. 24

IN pursuance of the Labour Legislation Emergency Regulations 1940, the Minister of Labour doth hereby order as follows:—

  1. This Order may be cited as the Overtime and Holidays Labour Legislation Suspension Order 1941, Variation No. 24.

  2. This Order shall be read together with and deemed part of the Overtime and Holidays Labour Legislation Suspension Order 1941 (hereinafter referred to as “the principal Order”).

  3. The principal Order is varied as follows, namely, the provisions of the principal Order shall not apply—

(a) To the workers coming within the scope of the New Zealand Painters and Decorators’ award dated the 1st day of October, 1942, and recorded in 42 Book of Awards 1089, except those employed on ship or ship-repair work; or

(b) To the workers coming within the scope of the awards specified in the following Schedule, namely:—

The Auckland Milk Pasteurizing and Distributing Depot Employees’ Labour Legislation Suspension Order 1943, No. 2

IN pursuance of the Labour Legislation Emergency Regulations 1940, the Minister of Labour doth hereby order as follows:—

  1. This Order may be cited as the Auckland Milk Pasteurizing and Distributing Depot Employees’ Labour Legislation Suspension Order 1943, No. 2.

  2. This Order applies to Amburys Limited and Stonex Bros., Limited, both of Auckland, and to female workers employed by those companies on work which is subject to New Zealand (except Marlborough and Wellington Twenty-mile Radius) Milk Pasteurizing and Bottling Factories’ Employees’ award, dated the 31st day of March, 1941, and recorded in 41 Book of Awards 200.

  3. The provisions of the Factories Act, 1921–22, and its amendments, shall be and are hereby suspended in so far as they operate to prevent or restrict the employment of the workers mentioned in clause 2 between the hours of 8 a.m. and 11 p.m. on ordinary working-days, Sundays, holidays, and half-holidays, subject to the following conditions, namely:—

(1) The employment of the said workers shall be in accordance with the provisions of the above-mentioned award;

(2) Where female workers are employed after dark the employer shall, if public transport is not available, provide at his own expense a suitable conveyance for the transport of such workers;

(3) The employer shall keep a copy of this Order posted up in the changing-room provided for the female workers.

  1. This Order shall be deemed to have come into effect on the 1st day of May, 1943.

NOTES.

(1) Section 44 of the Factories Act, 1921–22, provides, inter alia, that sufficient privy accommodation shall be provided for all persons employed in the factory, and where members of both sexes are employed, not being members of the same family, the accommodation shall be entirely separate for each sex, so as to ensure privacy.

(2) Clause 12 of the award provides that accommodation to the satisfaction of the Inspector of Factories shall be provided for the workers to change and dry their clothes and have their meals.

The additions, removals, and changes set out in the Schedules hereto are those made prior to 1st May, 1943.

Except as set out in the Second Schedule hereto all the licenses included in the main list referred to above have been renewed until 31st March, 1944.
