Exemption Order under the Transport Legislation Emergency Regulations 1940.

PURSUANT to the Transport Legislation Emergency Regulations 1940, the Minister of Transport doth hereby order and declare that the provisions of clause (1) of Regulation 7 of the Motor-drivers Regulations 1940, so far as they relate to drivers of heavy trade motors, shall not apply to Joseph Beaumont, of Nongotaha.

Registered Medical Practitioner prohibited from dealing in Dangerous Drugs.

PURSUANT to the provisions of the Dangerous Drugs Regulations 1928, I, Arnold Henry Nordmeyer, Minister of Health, being satisfied that Henry Scott Buckland, of Kia-Toa, at Waikouaiti, in the Provincial District of Otago, a registered medical practitioner, has committed a breach of the terms of the license deemed to be held by him under the said regulations, and acting on the recommendation of the Medical Council, do hereby revoke the license deemed to be held by the said Henry Scott Buckland under the said regulations.

Registered Medical Practitioner prohibited from dealing in or issuing Prescriptions for Dangerous Drugs.

PURSUANT to the provisions of the Dangerous Drugs Regulations 1928, I, Arnold Henry Nordmeyer, Minister of Health, being satisfied that Arthur Edward Gladstone, of Alexandra, a registered medical practitioner, has committed a breach of the terms of the license deemed to be held by him under the said regulations, and acting on the recommendation of the Medical Council, do hereby revoke the license deemed to be held by the said Arthur Edward Gladstone under the said regulations, and do hereby prohibit the said Arthur Edward Gladstone from issuing prescriptions for the dispensing of dangerous drugs.

The Lemon Marketing Regulations 1940.—Notice fixing Prices of certain Grades.

Internal Marketing Division,
Wellington, 30th September, 1942.

PURSUANT to Regulation 5:1 of the Lemon Marketing Regulations 1940, I hereby fix the following prices per bushel to be paid by the Marketing Department for lemons of Fancy Grade and Commercial Grade respectively, delivered to the Department during the undermentioned period.

The prices are fixed on an average basic price of 6s. 4½d. for sufficient fruit which when cured will pack a bushel case.

Period of delivery (both days inclusive): 1st October to 31st October, 1942:—
Loose packed fresh lemons, Fancy Grade . . 4 6
Loose packed fresh lemons, Commercial Grade . . 4 0

The Non-ferrous Metals Control Notice 1942, Amendment No. 1.

PURSUANT to the Factory Emergency Regulations 1939, I, George Augustus Pascoe, Factory Controller, hereby direct and give notice as follows:—

  1. This notice may be cited as the Non-ferrous Metals Control Notice 1942, Amendment No. 1, and shall be read together with and deemed part of the Non-ferrous Metals Control Notice 1942* (hereinafter called the principal notice).

  2. This notice shall come into force on the day next following the date of the publication hereof in the Gazette.

  3. The Schedule to the principal notice is hereby amended by adding the following thereto:—

“50. Bowls.
“51. Buckets.
“52. Buttons.
“53. Chains for basins, baths, cistern pulls, and fire-extinguishers.
“54. Checks and tallies.
“55. Gongs.
“56. Oil-cans.
“57. Paper-weights.
“58. Salts for the preservation of foodstuffs.”

The Lighting Restrictions Orders 1942, Amendment No. 1.

PURSUANT to the Lighting Restrictions Emergency Regulations 1941, the Dominion Lighting Controller doth hereby make the following Order:—

  1. This Order may be cited as the Lighting Restrictions Orders 1942, Amendment No. 1, and shall be read together with and deemed part of the Lighting Restrictions Orders 1942* (hereinafter referred to as the principal Orders).

  2. This Order shall come into force on the day following the date of publication thereof in the Gazette.

  3. Clause 6 of Order No. 1 is hereby amended by inserting, before the definition of the expression “Area visible from the open sea”, the following new definition:—

“‘Approaches’, in relation to any premises, includes any way or passage over private property giving access to any building or to any part of a building, but does not include any way or passage giving direct access from a road or street to any doorway that is situated in any part of a building fronting, and adjoining or contiguous to, the road or street;”

  1. Clause 6 of Order No. 1 of the principal Orders is hereby further amended by omitting from the definition of the expression “coastal area” the words “each of the local authorities in that coastal area” at the end of the said definition, and substituting the words “every County Council, City Council, Borough Council, and Town Board having any part of its district included in that coastal area.”

  2. Clause 6 of Order No. 1 of the principal Orders is hereby further amended by adding the following definition:—

“References to any regulations cited by their title include references to all subsequent regulations made in amendment thereof or in substitution therefor and for the time being in force.”

  1. Clause 1 of Order No. 2 of the principal Orders is hereby amended by omitting the words “any light-source”, and substituting the words “any external light-source.”

  2. Order No. 2 of the principal Orders is hereby further amended by omitting from paragraph (a) of clause 2 the words “or electric-discharge tube”, and by inserting, after the said clause 2, the following new clause:—

“2A. Except as hereinafter expressly provided, no electric-discharge tube shall be used as an external light-source.”

  1. Clause 4 of Order No. 2 of the principal Orders is hereby amended by inserting in paragraph (a), after the word “signs”, the words “of any description including electric-discharge tubes”.

  2. Clause 5 of Order No. 2 of the principal Orders is hereby amended by inserting in paragraph (a), after the word “description”, the words “including electric-discharge tubes.”

  3. Order No. 2 of the principal Orders is hereby further amended by inserting in clauses 6 and 8, in each case after the word “Timaru”, the word “Nelson”.

  4. Clause 1 of Order No. 18 of the principal Orders is hereby amended by inserting, after the word “Wellington”, the word “Nelson”.

  5. Order No. 18 of the principal Orders is hereby further amended by revoking clause 2, and substituting the following clause:—

“2. (1) All road and street lights, and all harbour, wharf, ship, and railway yard lights in any of the places mentioned in clause 1 of this Order shall, immediately upon the giving of an order to that effect by the officer of the Army or Navy in charge of the area in which that place is situated, be disconnected and extinguished and remain extinguished until that officer permits the display of such lights.

“(2) Where the street and harbour lights in any such place are extinguished in accordance with the foregoing provisions of this clause, no driver or person in charge of any vehicle in that place shall, during hours of darkness, cause or permit the vehicle to be moved, or any light to be displayed on or in the vehicle, at any time while the street and harbour lights remain so extinguished:

“Provided that nothing in this paragraph shall apply:—

“(a) With respect to any vehicle, so long as no light displayed from any lamp on or in the vehicle, whether directly or by reflection from any premises, structure, or object, can be seen from any point in any harbour;—

“(b) With respect to the movement or lighting of any vehicle in accordance with the provisions of the Lighting Restrictions Emergency Regulations 1941, and of every order, direction, restriction, and condition made, given, and imposed under or by virtue of those regulations and for the time being in force, relating to the display of light from the vehicle, or from vehicles of the class to which it belongs, during periods of emergency.”

IN pursuance of the powers conferred on it by the Control of Prices Emergency Regulations 1939, the Price Tribunal, acting with the authority of the Minister of Industries and Commerce, doth hereby make the following Price Order:—
