and being additional land taken for the purposes of a lighthouse by Proclamation dated 7th April, 1927, published in the Gazette of 14th April, 1927 (No. 21), at page 937.

  1. Portland Island.—All that area of land referred to in deed registered at the Deeds Registry Office at Napier, in the Hawke's Bay Land District, under No. 10685. As the same is more particularly delineated on the plan endorsed on the said deed.

  2. Castle Point.—All that area of land being part of Section 852 of Block X of the Castlepoint Survey District, in the Wellington Land District, and being a reserve for public purposes, bounded as follows: Commencing at the eastern end of the lighthouse footbridge by a line in a northerly direction to the sea; thence by a line in a north-easterly, easterly, and south-westerly direction along low-water mark of the sea to a point in line with the northern side of the lighthouse footbridge; and thence along a right line in a westerly direction to the eastern end of the said footbridge.

  3. Cape Palliser.—All that area of land containing approximately 54 acres 3 roods 14 perches, being part of the Matakitaki Block, situated in Block X, Kaiwaka Survey District, in the Land District of Wellington. As the same is more particularly delineated on a plan marked P.W.D. 17996, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured red; and being the land taken for Cape Palliser Lighthouse by Proclamation dated 4th October, 1897, published in the Gazette of 7th October, 1897 (No. 86), at page 1746.

  4. Cape Campbell.—All that area of land containing approximately 45 acres, being part of Section 17, Block IV, Cape Campbell Survey District. As the same is more particularly delineated on a plan marked S.G. 55389, deposited in the Head Office of the Lands and Survey Department at Wellington, and thereon edged red; and being the land taken for lighthouse purposes and referred to in the second column of the Schedule to Order in Council dated 7th February, 1907, published in the Gazette of 14th February, 1907 (No. 15), at page 567.

  5. The Brothers.—All the islands known as “The Brothers,” situated in Cook Strait, being the lands reserved as a site for a lighthouse by Order in Council dated 16th February, 1875, published in the Gazette of 18th February, 1875 (No. 9), at page 138.

  6. Farewell Spit.—All that area of land containing approximately 600 acres, situated at the extremity of Farewell Spit, in the Province of Nelson; bounded towards the north-east and south-west by high-water line on the shores of the said Spit; and towards the west-north-west by a line drawn at right angles to a line bearing west-north-west from Bush End Point, and distant therefrom 16000 links, together with a road one chain wide along the whole length of the said Spit; and being the land reserved as a site for a lighthouse by Order in Council dated 16th September, 1868, published in the Gazette of 17th September, 1868 (No. 54), at page 453.

  7. Cape Egmont.—All that area of land containing approximately 50 acres, being Section 1, Block XII, Cape Survey District, in the Taranaki Land District, and being the land reserved as a site for a lighthouse by Warrant dated 26th November, 1898, published in the Gazette of 8th December, 1898 (No. 87), at page 1948.

DUNEDIN DISTRICT.

  1. Taiaroa Head.—All that area of sea bordering upon the Taiaroa Head Defence area (as defined in the Gazette of the 26th June, 1941, No. 54, at page 2033), and bounded to seaward by the following lines: Commencing from Harrington Point on a line 10° true, distant 6·5 cables; thence 65° true, 2·9 cables; thence 125½ true, 7 cables; thence 152° true, 7·2 cables; thence 214½° true, 4·3 cables, with Te Pari O Te Matahua Point, bearing 279° true, distant 2·2 cables.

The Shipping Safety (Bay of Islands) Order 1942.

PURSUANT to Regulation 4a of the Shipping Safety Emergency Regulations 1940,* the Minister of Defence doth hereby make the following Order:—

  1. This Order may be cited as the Shipping Safety (Bay of Islands) Order 1942.

  2. This Order shall take effect on the day following the date of the publication thereof in the Gazette.

  3. This Order shall apply with respect to all small craft, as defined in the Shipping Safety Emergency Regulations 1940†, to which the Shipping Control Emergency Regulations 1939‡ do not apply.

  4. Except in accordance with the terms and conditions of a written permit granted by an officer at Russell, authorized in that behalf by the Naval Board or the Army Board,—

(a) No master or person in charge of any small craft engaged in fishing, being a craft to which this Order applies, shall cause or permit the craft while so engaged to be in any part of the waters described in the First Schedule hereto;

(b) No master or person in charge of any small craft to which this Order applies shall cause or permit the craft to enter, leave, move in, or anchor in any part of the waters described in the Second Schedule hereto.

FIRST SCHEDULE.

PROHIBITED FISHING AREA.

The waters in and near the Bay of Islands within the following limits:—

From Cape Brett Lighthouse (lat. 35° 10′ 24″ S., long. 174° 19′ 30″ E.) in a 045° direction for thirteen miles; thence, by an arc of a circle with the lighthouse as centre, to the shore northward of Cape Wiwiki; thence along the shore by way of Cape Wiwiki to the mouth of the Waitangi River; thence in a 045° direction to Taureka Point; thence along the shore to Cape Brett Lighthouse.

SECOND SCHEDULE.

PROHIBITED PASSAGE.

The waters in the Bay of Islands within the following limits:—

From Cape Wiwiki (lat. 35° 09′ 18″ S., long. 174° 07′ 45″ E.) in a 000° direction for one mile; thence in a 102° direction to Cape Brett; thence along the shore to Taureka Point; thence in a 225° direction to the mouth of the Waitangi River; thence along the shore to Cape Wiwiki.

The Shipping Control (Bay of Islands) Notice 1942.

PURSUANT to the Shipping Control Emergency Regulations 1939* the Naval Board hereby gives notification as follows:—

  1. This notification may be cited as the Shipping Control (Bay of Islands) Notice 1942.

  2. This notification shall take effect on the day following the date of publication thereof in the Gazette.

  3. In this notice, unless the context otherwise requires,—

“Local small craft” means any small craft for the time being kept in the Bay of Islands;

“Small craft” has the same meaning as in the Shipping Safety Emergency Regulations 1940†.

  1. Except in accordance with the terms and conditions of a written permit granted by an officer at Russell, authorized in that behalf by the Naval Board or Army Board,—

(a) No master or person in charge of any ship engaged in fishing, being a ship to which the Shipping Control Emergency Regulations 1939 for the time being apply, shall cause or permit the ship while so engaged to be in any part of the waters described in the First Schedule thereto;

(b) No master or person in charge of any local small craft to which the Shipping Control Emergency Regulations 1939 for the time being apply shall cause or permit the craft to enter, leave, move in, or anchor in any part of the waters described in the Second Schedule hereto.

  1. Except in accordance with the terms and conditions of a written permit granted by an officer at Auckland, authorized in that behalf by the Naval Board, no master or person in charge of any ship to which the Shipping Control Emergency Regulations 1939 for the time being apply, other than a local small craft, shall cause or permit the ship to enter, leave, move in, or anchor in any part of the waters described in the Second Schedule hereto.

FIRST SCHEDULE.

From Cape Brett Lighthouse (lat. 35° 10′ 24″ S., long. 174° 19′ 30″ E.) in a 045° direction for thirteen miles; thence, by an arc of a circle with the lighthouse as centre, to the shore northward of Cape Wiwiki; thence along the shore by way of Cape Wiwiki to the mouth of the Waitangi River; thence in a 045° direction to Taureka Point; thence along the shore to Cape Brett Lighthouse.

Notice of Adoption under Part IX of the Native Land Act, 1931.

IT is hereby notified that an order of adoption as set out in the Schedule hereunder was made by the Native Land Court at Masterton on the 27th day of May, 1942, under the provisions of the Native Land Act, 1931.
