At the Government Buildings at Wellington, this 22nd day of April, 1942.

THE RIGHT HON. P. FRASER PRESIDING IN COUNCIL.
WHEREAS by the thirty-fifth section of the Public Works Act, 1928 (hereinafter termed “the said Act”), it is enacted that if it is found that any land held, taken, purchased, or acquired at any time under this or any other Act or Provincial Ordinance, or otherwise howsoever, for any public work, is not required for such public work the Governor-General may, by Order in Council publicly notified and gazetted, cause the same to be sold under the conditions set forth in the said Act:
Now, therefore, His Excellency, the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the powers and authorities conferred upon him by the said Act, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby order and direct the sale of the said land described in the Schedule hereto.
SCHEDULE.
APPROXIMATE area of the piece of land: 7 acres 1 rood 30 perches.
Part of Railway land (originally part Section 2), Block I, Maruwhenua Survey District, Waitaki County. (S.O. 9235.)
In the Otago Land District; as the same is more particular delineated on the plan marked L.O. 6691, deposited in the office of the Minister of Railways at Wellington, and thereon coloured blue.

Authorizing the Laying-off of a Street (Extension of John Street), in the Borough of Upper Hutt, of a Width of less than 66 ft. but not less than 50 ft. subject to a Condition as to the Building-line.

THE RIGHT HON. P. FRASER PRESIDING IN COUNCIL.
IN pursuance and exercise of the powers vested in him by the Municipal Corporations Act, 1933, and the Public Works Act, 1928, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby authorize the Upper Hutt Borough Council to permit the laying off of the proposed street, described in the Schedule hereto, of a width of less than sixty-six feet but not less than fifty feet, subject to the condition that no building or part of a building shall at any time be erected on the land shown edged green on the plan marked P.W.D. 113483, referred to in the said Schedule, and fronting the said street within a distance of forty-eight feet from the centre-line of the said street,

That proposed street in the Wellington Land District, Borough of Upper Hutt, being an extension of John Street, containing by admeasurement 2 roods 2·65 perches, more or less, being part Lot 13 on D.P. 9446 (part being part Lot 3 on plan 11598), being part Section 94, Hutt District, Block I, Rimutaka Survey District. As the same is more particularly delineated on the plan marked P.W.D. 113483, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured red.

The Eastern Side of Portion of York Street, in the Borough of Picton, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line.

ORDER IN COUNCIL.
At the Government Buildings at Wellington, this 22nd day of April, 1942.
Present:
THE RIGHT HON. P. FRASER PRESIDING IN COUNCIL.
IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of every other power in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Picton Borough Council on the twelfth day of February, one thousand nine hundred and forty-two, viz.:—
“ The Picton Borough Council, being the local authority having control of the streets in the Borough of Picton, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to the eastern side of the portion of York Street adjoining Sections 429, 430, and 431, Town of Picton, and contained in Certificate of Title, Volume 27, folio 202 ”;
subject to the condition that no building or part of a building shall at any time be erected on the land fronting the eastern side of the portion of York Street (described in the Schedule hereto) within a distance of thirty-three feet from the centre-line of the said portion of street.
SCHEDULE.
The eastern side of all that portion of York Street, situated in the Borough of Picton, fronting Sections 429, 430, and 431, Town of Picton, D.P. 1039. As the same is more particularly delineated on the plan marked P.W.D. 113873, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured red.

“ That the Blenheim Borough Council, being the local authority having the control of the streets in the Borough of Blenheim, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to the southern side of the portion of Alfred Street adjoining the subdivision of Lot 1, D.P. 1053, being part Allotment 85 and part Allotment 86 (D.P. 135), being part Section 1, Omaka, Borough of Blenheim, and contained in Certificates of Title, Volumes 5 and 27, folios 26 and 164 ”;
