His Majesty for the purposes of the Westport-Inangahua Railway by virtue of a Proclamation dated the second day of June, one thousand nine hundred and thirty-one, and published in the New Zealand Gazette No. 46 of the eleventh day of the same month at page 1726.

SCHEDULE.

ALL that parcel of land comprising 16 acres, being Railway land (formerly part Scenery Preservation Reserve No. 7), Block V, Inangahua Survey District. As the said portion of land is more particularly delineated on the plan marked 55084 (S.O. 8621, Nelson), deposited in the office of the Minister of Railways at Wellington, and thereon bordered green.

Authorizing the Laying-off of Portion of a Street (Locking Street Extension), City of Nelson, of a Width less than 66 ft. but not less than 40 ft.

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

IN pursuance and exercise of the powers vested in him by the Municipal Corporations Act, 1933, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby authorize the Nelson City Council to permit the laying-off of the portion of street described in the Schedule hereto of a width less than sixty-six feet but not less than forty feet.

SCHEDULE.

That proposed street in the Nelson Land District, City of Nelson, known as Locking Street, containing by admeasurement 24-6 perches, more or less, being part Section 1118, City of Nelson. As the same is more particularly delineated on the plan marked P.W.D. 110231, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured red.

The Eastern Side of Portion of Victoria Heights, in the City of Nelson, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line.

At the Government House at Wellington, this 4th day of March, 1942.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of every other power in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Nelson City Council on the twenty-ninth day of May, one thousand nine hundred and forty-one, viz.:

“That the Nelson City Council, being the local authority having control of the streets in the City of Nelson, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to the eastern side of the portion of Victoria Heights adjoining part Section 1181, City of Nelson, as shown on the plan annexed to this resolution in the Council’s minute-book ”;

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the eastern side of the portion of Victoria Heights (described in the Schedule hereto) within a distance of thirty-five feet from the centre-line of the said portion of street.

SCHEDULE.

The eastern side of all that portion of street situated in the Nelson Land District, known as Victoria Heights, and fronting part Section 1181, City of Nelson. As the same is more particularly delineated on the plan marked P.W.D. 111374, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured red.

The Western Side of Portion of Victoria Heights and the South-western Side of Portion of an Unnamed Street, in the City of Nelson, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line.

IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of every other power in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Nelson City Council on the sixteenth day of October, one thousand nine hundred and forty-one, viz.:

“The Nelson City Council, being the local authority having control of the streets in the City of Nelson, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to the western side of the portion of Victoria Heights and the south-western side of the portion of the unnamed public road adjoining part Section 1181, City of Nelson, as shown on the plan annexed to this resolution in the Council’s minute-book ”;

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the western side of the portion of Victoria Heights (described in the Schedule hereto) within a distance of thirty-five feet from the centre-line of the said portion of street or the south-western side of the portion of an unnamed street (described in the Schedule hereto) within a distance of seventeen feet six inches from the centre-line of the said portion of street.

SCHEDULE.

The western side of all that portion of street situated in the Nelson Land District, known as Victoria Heights, fronting part Section 1181, City of Nelson, and the south-western side of all that portion of an unnamed street situated in the said land district and fronting part of the said Section 1181, City of Nelson. As the same are more particularly delineated on the plan marked P.W.D. 112661, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured red.

“The Wellington City Council, being the local authority having control of the streets in the City of Wellington, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to that portion of the western side of Sydenham Street fronting Lot 71, Deeds Plan 108 ”;

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the western side of portion of Sydenham Street (described in the Schedule hereto) within a distance of thirty-five feet from the centre-line of the said portion of street.

SCHEDULE.

The western side of all that portion of street situated in the Wellington Land District, City of Wellington, known as Sydenham Street, fronting Lot 71, Deeds Plan 108, being part Section 31, Karori District. As the same is more particularly delineated on the plan marked P.W.D. 113538, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured red.
