The Northern and Southern Sides of Portions of Unnamed Roads, in the County of Waimea, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line.

ORDER IN COUNCIL.

At the Government House at Wellington, this 4th day of March, 1942.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of every other power in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Waimea County Council on the twelfth day of December, one thousand nine hundred and forty-one, viz. :—

“ The Waimea County Council, being the local authority having control of the roads in the Waimea County, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to the southern side of the road fronting the northern boundary of Part 16, Square 9, contained in C/T. 64/165, and northern side of the road fronting the southern boundary of Part 16, Square 9, and part Section 2, contained in C/Ts. 64/165 and 70/214 ” ;

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the northern and southern sides of the portions of unnamed roads (described in the Schedule hereto) within a distance of thirty-three feet from the centre-line of the said portions of roads.

SCHEDULE.

THE southern side of all that portion of an unnamed road situated in the Nelson Land District, County of Waimea, fronting part Section 16, Square 9, and the northern side of all that portion of an unnamed road fronting the said part Section 16 and part Section 2, Block XII, Kaiteriteri Survey District. As the same are more particularly delineated on the plan marked P.W.D. 113252, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured red.

IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of every other power in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Tahunanui Town Board on the eleventh day of November, one thousand nine hundred and forty-one, viz. :—

“ The Tahunanui Town Board, being the local authority having control of the streets in the Town District of Tahunanui, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to the north-western side of the portion of Edward Street adjoining subdivision of parts Lots 17 and 18, D.P. 1413, being part Section 1, Suburban South, Block IV, Waimea Survey District (C/T. 61/38 and C/T. 53/108) ” ;

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the north-western side of the portion of Edward Street (described in the Schedule hereto) within a distance of thirty-three feet from the centre-line of the said portion of street.

SCHEDULE.

THE north-western side of all that portion of Edward Street, situated in the Nelson Land District, Tahunanui Town District, fronting part Lot 17 and Lot 18, D.P. 1413, being part Section 1, Suburban South, Block IV, Waimea Survey District. As the same is more particularly delineated on the plan marked P.W.D. 112861, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured red.

At the Government House at Wellington, this 11th day of March, 1942.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

IN pursuance and exercise of the powers and authorities conferred upon him by the Public Works Act, 1928, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby direct the sale of the land described in the Schedule hereto, such land being no longer required for the public work for which it was taken.

SCHEDULE.

APPROXIMATE area of the piece of land directed to be sold : 4 acres 1 rood 4·6 perches.

Being part of Lot O of Subdivision 4, Mangatu No. 1 Block. Situated in Block VII, Mangatu Survey District (Gisborne R.D.). (S.O. 4134, blue.)

In the Gisborne Land District; as the same is more particularly delineated on the plan marked P.W.D. 110551, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured orange.

Boundaries of City of Christchurch and County of Heathcote altered.

ORDER IN COUNCIL.

At the Government House at Wellington, this 11th day of March, 1942.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

WHEREAS in pursuance of section one hundred and thirty-six of the Municipal Corporations Act, 1933, a petition was presented to the Governor-General praying that a certain area of land be excluded from the County of Heathcote and included in the City of Christchurch:

And whereas it is deemed expedient to make such alteration of the boundaries of the said city:

Now, therefore, in pursuance and exercise of the powers and authorities vested in him by the said Municipal Corporations Act, 1933, and of all other powers and authorities enabling him in that behalf, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby declare that as on and from the first day of April, one thousand nine hundred and forty-two, the area described in the Schedule hereto shall be excluded from the County of Heathcote and included in the City of Christchurch.

SCHEDULE.

AREA EXCLUDED FROM THE COUNTY OF HEATHCOTE AND INCLUDED IN THE CITY OF CHRISTCHURCH.

ALL that area in the Canterbury Land District, bounded by a line commencing at a point on the intersection of the south-eastern side of Avonside Drive with the north-western side of Wainoni Road, being a point on the existing boundary of the City of Christchurch; thence proceeding south-westerly along the said north-western side of Wainoni Road to a point opposite the northernmost corner of Lot 1, Deposited Plan
