A PROCLAMATION.

BY virtue and in exercise of the powers and authorities conferred upon me by section eighteen of the Forests Act, 1921–22, I, Cyril Louis Norton Newall, the Governor-General of the Dominion of New Zealand, do hereby set apart the Crown land described in the Schedule hereto as a permanent State forest.

SCHEDULE.

MARLBOROUGH LAND DISTRICT.—NELSON CONSERVANCY.

ALL those areas in the Marlborough Land District, Marlborough County, containing by admeasurement 241 acres 3 roods 10 perches, more or less, and being Lots 1 and 3 of Section 8, Block III, Wakamarina Survey District. As the same are more particularly delineated on plan No. 104/33, deposited in the Head Office of the State Forest Service at Wellington, and thereon bordered red. (Marlborough plan S.O. 1718/78.)

Given under the hand of His Excellency the Governor-General of the Dominion of New Zealand, and issued under the Seal of that Dominion, this 30th day of October, 1941.

BY virtue and in exercise of the powers and authorities conferred upon me by section eighteen of the Forests Act, 1921–22, I, Cyril Louis Norton Newall, the Governor-General of the Dominion of New Zealand, do hereby set apart the Crown land described in the Schedule hereto as a provisional State forest.

SCHEDULE.

NELSON LAND DISTRICT.—NELSON CONSERVANCY.

ALL those areas in the Nelson Land District, Buller County, containing a total of 1,757 acres 0 roods 34 perches, more or less, and described as follows :—

All that area containing 694 acres, more or less, and being Sections 1 and 2, Block VI, Otumahana Survey District.

Also all that area containing 537 acres 1 rood 34 perches, more or less, being Section 4 and portions of Sections 10 and 11, Block VI, Otumahana Survey District, and bounded generally as follows : Towards the north by Section 2 (provisional State forest, Gazette, 1925, page 2887), Block II, and by a provisional State forest (20,470 acres, Gazette, 1920, page 2115) ; towards the east by the last-mentioned provisional State forest, 5730 links ; towards the south by the other portion of Section 11, 4154·1 links, bearing 267° 56′ 25″, Section 8 (gravel reserve), a public road, and by the other portion of Section 10, 3865·5 links, bearing 274° 51′ 40″, to a point on the eastern side on Macpherson’s Road, 4019·7 links from the southern end of that road ; and towards the west by Macpherson’s Road and Section 2, Block VI aforesaid : save and excepting the intersecting public roads.

Also all that area containing 257 acres 3 roods, more or less, being Section 7 and portion of Section 5, Block VI, Otumahana Survey District, and bounded generally as follows : Towards the east and south respectively by Sections 6 and 3 (provisional State forest, Gazette, 1925, page 2887), Block VI aforesaid, and again towards the south by a public road ; towards the west by Section 13 (provisional State forest, Gazette, 1925, page 2887), Block V ; and towards the north by a branch of Hodge’s Creek.

Also all that area containing 260 acres, more or less, being portion of Section 12, Block V, Otumahana Survey District, and bounded generally as follows : Towards the north by Hodge’s Creek ; towards the east by Section 13 (provisional State forest, Gazette, 1925, page 2887), Block V aforesaid ; towards the south by a public road ; and towards the west by Sections 20 and 18 (provisional State forest, Gazette, 1925, page 2887), Block V aforesaid, and a public road.

As the same are more particularly delineated on plan No. 101/7, deposited in the Head Office of the State Forest Service, at Wellington, and thereon bordered green. (Nelson S.O. plan 9252.)

Given under the hand of His Excellency the Governor-General of the Dominion of New Zealand, and issued under the Seal of that Dominion, this 28th day of October, 1941.

All that area containing 160 acres 3 roods, more or less, and being Lot 1 of Section 4, Block II, Tennyson Survey District.

Also all that area containing 120 acres, more or less, and being Lot 2 of Section 9, Block II, Tennyson Survey District.

Also all that area containing 172 acres, more or less, and being Lot 1 of Section 5, Block II, Tennyson Survey District.

Also all that area containing 1 acre 1 rood, more or less, being part of Section 5, Block II, Tennyson Survey District, and bounded generally as follows : Towards the east by Lot 2 of Section 5, Block II aforesaid ; towards the south by a public road along the left bank of Running Creek ; towards the west by Running Creek ; and towards the north by Lot 1 of Section 5, Block II aforesaid.

As the same is more particularly delineated on plan No. 104/32, deposited in the Head Office of the State Forest Service at Wellington, and thereon bordered red. (Marlborough plan S.O. 1719/24.)

Given under the hand of His Excellency the Governor-General of the Dominion of New Zealand, and issued under the Seal of that Dominion, this 30th day of October, 1941.

Authorizing Ralph Forlong, of Kiwitahi, Farmer, to use Water for the Purpose of generating Electricity and to erect certain Electric Lines.

ORDER IN COUNCIL.

At the Government House at Wellington, this 5th day of November, 1941.

Present :

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

PURSUANT to the Public Works Act, 1928, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby grant to Ralph Forlong, of Kiwitahi, Farmer (hereinafter referred to as “the licensee”), a license subject to the conditions hereinafter set forth to obstruct, impound, or divert the waters of a stream known as Topehahae Stream situated in part 2c No. 1 Kiwitahi Block, Cambridge Survey District, in the Land District of Auckland, and to take and use therefrom for the purposes hereinafter set forth a stream of water not exceeding 10 cubic feet per second at any one time, and to erect the electric lines hereinafter described.

CONDITIONS.

  1. IMPLIED CONDITIONS.

THE conditions directed to be implied in all licenses by the Water-power Regulations 1934, and the Electrical Supply Regulations 1935, shall be incorporated in and shall form part of this license except in so far as the same may be inconsistent with the provisions hereof.

  1. LICENSE SUBJECT TO REGULATIONS.

This license is issued under the Water-power Regulations 1934, the Electrical Supply Regulations 1935, and the Electrical Wiring Regulations 1935, and is subject thereto and to any regulations made or to be made in amplification or amendment thereof or in substitution therefor.

  1. UTILIZATION OF WATER AND LOCATION OF HEADWORKS.

Water shall be used under this license solely for the purpose of generating electricity, and shall be taken from the stream at the point in part 2c No. 1 Kiwitahi Block, Cambridge Survey District, indicated on the plan marked P.W.D. 111649, deposited in the office of the Minister of Public Works.
