The Eastern Side of Portion of Glen Avenue and the Southern Side of Portion of Aitken Place, in the City of Dunedin, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line.

ORDER IN COUNCIL.
At the Government House at Wellington, this 22nd day of October, 1941.

Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of every other power in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Dunedin City Council on the first day of September, one thousand nine hundred and forty-one (the sides and portion of streets affected being more particularly described in the Schedule hereto) viz.:

“ That the Dunedin City Council, being the local authority having control of the streets in the City of Dunedin, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to the undermentioned portions of streets, viz.:

“ (a) The eastern side of the portion of Glen Avenue adjoining Lot 327, Glen Estate, and part of Lot 62, Township of West Dunedin;

“ (b) The southern side of the portion of Aitken Place adjoining part of Lot 63, Township of West Dunedin;

such land being comprised and described in Certificate of Title, Register-book, Volume 306, folio 3 ”;

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the eastern side of portion of Glen Avenue or the southern side of the portion of Aitken Place (described in the Schedule hereto), within a distance of thirty-three feet from the centre-lines of the said portions of streets.

SCHEDULE.

THE eastern side of all that portion of street situated in the Otago Land District, City of Dunedin, known as Glen Avenue, fronting part Glen Estate and part Township of West Dunedin, being Lot 2, D.P. 2953, and being part Section 93, Block VI, Town District. Also the southern side of all that portion of street in the said land district and city known as Aitken Place fronting part Township of West Dunedin, being Lot 2, D.P. 2953, and being part Section 93, Block VI, Town District.

As the same are more particularly delineated on the plan marked P.W.D. 112261, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured red.

The North-eastern Side of Portion of Thornycroft Street, in the County of Waimairi, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line.

IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of every other power in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Waimairi County Council on the seventeenth day of September, one thousand nine hundred and forty-one, viz.:

“ The Waimairi County Council, being the local authority having control of the roads in the County of Waimairi, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to the north-eastern side of portion of Thornycroft Street, fronting part of Lot 104, D.P. 971, being part of Rural Section 188, Block X, Christchurch Survey District ”;

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the north-eastern side of the portion of Thornycroft Street (described in the Schedule hereto), within a distance of thirty-three feet from the centre-line of the said portion of road.

SCHEDULE.

THE north-eastern side of all that portion of road, situated in the Canterbury Land District, Waimairi County, known as Thornycroft Street, fronting part of Lot 104, D.P. 971, being part of Rural Section 188, Block X, Christchurch Survey District. As the same is more particularly delineated on the plan marked P.W.D. 111858, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured red.

SCHEDULE.

THE southern side of all that portion of street situated in the Otago Land District, City of Dunedin, known as Durham Street, fronting part Lot 20, Block III, Deeds Plan 26, and Lots 17, 18, and 19, Deeds Plan 129, Township of Richmond Hill, and being part Section 77, Block VI, Town District.

Also the north-western side of all that portion of street situated in the said land district and city, known as Kenmure Road, fronting part Lot 20, Block III, Deeds Plan 26, Township of Richmond Hill, and being part Section 77, Block VI, Town District.

As the same are more particularly delineated on the plan marked P.W.D. 112265, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured red.
