ORDER IN COUNCIL.
At the Government House at Wellington, this 22nd day of October, 1941.
Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.
WHEREAS by section four of the Public Service Act, 1912, it is enacted that nothing in that Act shall apply to any officer or class of officers to whom or to which, on the recommendation of and for special reasons assigned by the Commissioner, the Governor-General in Council declares that the said Act shall not apply:
And whereas the Acting Commissioner appointed under section 23 (4) of the Finance Act, 1919, has recommended that the Public Service Act, 1912, should not apply to the class of officers described in the Schedule hereto for the special reasons assigned by him:
Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby declare that nothing in the Public Service Act, 1912, shall apply to the class of officers described in the Schedule hereto.

Licensing the Hokianga Timber Company, Limited, to use and occupy a part of the Foreshore at Horeke, Hokianga Harbour, as a Site for a Jetty.

ORDER IN COUNCIL.
At the Government House at Wellington, this 22nd day of October, 1941.

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.
PURSUANT to the Harbours Act, 1923, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby license and permit the Hokianga Timber Company, Limited, of Kaikohe (hereinafter called “the Company,” which term shall include its successors or assigns, unless the context requires a different construction) to use and occupy a part of the foreshore and land below low-water mark at Horeke, Hokianga Harbour, as shown on approved plan marked M.D. 6386, and deposited in the office of the Marine Department at Wellington, for the purpose of maintaining thereon a jetty as shown on the said plan, such license to be held and enjoyed by the company upon and subject to the terms and conditions set forth in the Schedule hereto.

SCHEDULE.
(1) This license is subject to the Foreshore License Regulations 1940, and the provisions of those regulations shall, so far as applicable, apply hereto.
(2) The term of the license shall be fourteen years from the 29th day of August, 1941.
(3) The premium payable by the company shall be one pound (£1), and the annual sum so payable five pounds (£5).
(4) The ballast of all vessels trading at the said jetty shall be taken away by the company and deposited above high-water mark or at such place as may be approved by the Minister or by any person appointed by the Minister for that purpose.

Vesting the Management of the Wharf at Te Kopuri, Kaipara Harbour, in the Hobson County Council.

ORDER IN COUNCIL.
At the Government House at Wellington, this 22nd day of October, 1941.
Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.
PURSUANT to the Harbours Act, 1923, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council, doth hereby vest in the Hobson County Council (hereinafter called “the Council,” which term shall include its successors or assigns unless the context requires a different construction) the management of the wharf at Te Kopuru, Kaipara Harbour, as shown on plan marked M.D. 8108, and deposited in the office of the Marine Department at Wellington, such vesting to be subject to the terms and conditions set forth in the Schedule hereto.

SCHEDULE.
(1) The vesting is subject to the Foreshore License Regulations 1940, and the provisions of those regulations shall, so far as applicable, apply hereto.
(2) The term of the vesting shall expire on the 12th day of December, 1941.

Consenting to the Raising of portion (£2,000) of the Te Kuiti Borough Council’s Loan of £30,000 and Prescribing the Conditions thereof.

ORDER IN COUNCIL.
At the Government House at Wellington, this 22nd day of October, 1941.
Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.
WHEREAS by Order in Council made on the tenth day of May, one thousand nine hundred and thirty-nine, and subject to the determinations as to borrowing and repayment therein set out, consent was given to the raising by the Te Kuiti Borough Council (hereinafter called “the said local authority”) of a loan of thirty thousand pounds (£30,000) to be known as “Waterworks Improvement Loan, 1939” (hereinafter called “the said loan”):
And whereas the authority conferred by the said Order in Council has not been exercised to the extent of twenty thousand pounds (£20,000):
And whereas the authority has lapsed in accordance with the provisions of clause seven of the said Order in Council, and it is not now lawful or competent for the said local authority to raise this amount or any portion thereof except in accordance with the provisions of a further Order in Council that may be issued pursuant to section eleven of the Local Government Loans Board Act, 1926 (hereinafter called “the said Act”):
And whereas the said local authority is desirous of raising a further portion of the said loan amounting to two thousand pounds (£2,000), (hereinafter called “the said sum”) and it is expedient to authorize the said local authority to raise the said sum on the conditions hereinafter set out:
Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in pursuance and exercise of the powers and authorities conferred on him by section eleven of the said Act, as set out in section twenty-nine of the Finance Act, 1932 (No. 2), and of all other powers and authorities enabling him in this behalf, doth hereby consent to the raising in New Zealand by the said local authority of the said sum up to the amount of two thousand pounds (£2,000) for the purpose for which the said loan was authorized and in giving such consent doth hereby determine as follows:—
(1) The term for which the said sum or any part thereof may be borrowed shall not exceed twenty (20) years.
(2) The rate of interest that may be paid in respect of the said sum or any part thereof shall be such as shall not produce to the lender or lenders a rate exceeding three pounds twelve shillings and sixpence (£3 12s. 6d.) per centum per annum.
(3) The said sum or any part thereof, together with interest thereon, shall be repaid by equal aggregate annual or half-yearly instalments extending over the term as determined in (1) above.
(4) The payment of such instalments shall be made in New Zealand, and no such instalments shall be paid out of loan-moneys.
(5) The rate payable for brokerage, underwriting, and procurement fees in respect of the borrowing of the said sum or any part thereof shall not in the aggregate exceed one-half per centum of any amount raised.
(6) No moneys shall be borrowed under this consent after the expiration of two years from the date hereof.
