THE NEW ZEALAND GAZETTE.

by and with the advice and consent of the Executive Council
of the said Dominion, doth hereby approve of the following
resolution passed by the Waimea County Council on the
eleventh day of June, one thousand nine hundred and forty-
one, viz.:
"The Waimea County Council, being the local
authority having control of the roads in the County of
Waimea, by resolution declares that the provisions of
section one hundred and twenty-eight of the Public
Works Act, 1928, shall not apply to the south-western
portion of Ranzau Road adjoining Lot 1, D.P. 785,
being part Section 121, Waimea East, Block IV, Waimea
Survey District, and contained in Certificate of Title,
Volume 43, folio 125 ";
subject to the condition that no building or part of a building
shall at any time be erected on the land fronting the south-
western side of the portion of Ranzau Road (described in
the Schedule hereto) within a distance of thirty-five feet
from the centre-line of the said portion of road.
SCHEDULE.
THE south-western side of all that portion of road, situated
in the Nelson Land District, Waimea County, known as
Ranzau Road, fronting Lot 1, D.P. 785, part Section 121,
Waimea East, Block IV, Waimea Survey District. As the
same is more particularly delineated on the plan marked
P.W.D. 111735, deposited in the office of the Minister of
Public Works at Wellington, and thereon coloured red.

The South-eastern Side of Portion of Gladstone Road Extension
and the North-eastern Side of Portions of Queen Street, in
the Borough of Richmond, exempted from the Provisions of
Section 128 of the Public Works Act, 1928, subject to a
Condition as to the Building-line.

At the Government House at Wellington, this 10th day
of September, 1941.
Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.
IN pursuance and exercise of the powers conferred by the
Public Works Act, 1928, and of every other power in
anywise enabling him in this behalf, His Excellency the
Governor-General of the Dominion of New Zealand, acting
by and with the advice and consent of the Executive Council
of the said Dominion, doth hereby approve of the following
resolution passed by the Richmond Borough Council, viz.:
"That the Richmond Borough Council, being the local
authority having control of the streets in the Borough
of Richmond, by resolution passed this twenty-fifth day
of June, one thousand nine hundred and forty-one,
declares that the provisions of section one hundred and
twenty-eight of the Public Works Act, 1928, shall not
apply to the south-eastern side of the portion of Gladstone
Road Extension and the north-eastern side of the
portions of Queen Street adjoining subdivision of parts
Section 83 and part Section 82, Waimea East, Block VII,
Waimea Survey District (E. Croucher) ";
subject to the condition that no building or part of a building
shall at any time be erected on the land fronting the south-
eastern side of the portion of Gladstone Road Extension,
or the north-eastern side of the portions of Queen Street
(described in the Schedule hereto), within a distance of
thirty-three feet from the centre-lines of the said portions
of streets.
SCHEDULE.
THE south-eastern side of all that portion of street, situated
in the Nelson Land District, Borough of Richmond, known
as Gladstone Road Extension, fronting Lot 1, D.P. 1603,
being part Section 83, District of Waimea East.
Also the north-eastern side of all those portions of street,
situated in the said land district and borough, known as
Queen Street, fronting part Section 83, Lots 1, 2, and 4,
D.P. 1603, being parts Section 82, parts Section 82, and
part Section 82, D.P. 597, District of Waimea East.
As the same are more particularly delineated on the plan
marked P.W.D. 111587, deposited in the office of the Minister
of Public Works at Wellington, and thereon coloured red.

Appointing Members of the Second Division of the Court of
Appeal.

ORDER IN COUNCIL.
At the Government House at Wellington, this tenth day of
September, 1941.
Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.
WHEREAS by Order in Council made on the twenty-
fourth day of October, nineteen hundred and forty,
the Honourable David Stanley Smith and the Honourable
Arthur Fair were appointed members of the Second Division
of the Court of Appeal for the year one thousand nine hundred
and forty-one: And whereas by reason of its being imprac-
ticable to form a quorum from the Division as at present
constituted for the hearing of a certain appeal which has
been fixed for hearing on the eighteenth day of September,
one thousand nine hundred and forty-one, and it is therefore
necessary as on and from the said eighteenth day of September,
one thousand nine hundred and forty-one, to appoint two other
Judges as members of the said Division in place of two of
those members of the Division who are unable to sit to hear
the said appeal and whose appointment it is consequently
necessary to revoke:
Now, therefore, His Excellency the Governor-General of
the Dominion of New Zealand, acting by and with the advice
and consent of the Executive Council of that Dominion,
and in exercise of the authority conferred upon him
by the Judicature Amendment Act, 1913, and in pursuance
of the recommendation of the Right Honourable the Chief
Justice, the Honourable Mr. Justice Ostler, the Honourable
Mr. Justice Smith, the Honourable Mr. Justice Johnston,
and the Honourable Mr. Justice Fair, doth revoke as on and
from the said eighteenth day of September, one thousand nine
hundred and forty-one, the said appointment of the Hon-
ourable David Stanley Smith and the Honourable Arthur Fair,
and doth appoint the Honourable Robert Kennedy, Judge, and
the Honourable Erima Harvey Northcroft, Judge, as on and
from the said eighteenth day of September, one thousand nine
hundred and forty-one, to be members of the said Second
Division of the Court of Appeal in the place of the said
Honourable David Stanley Smith and the Honourable Arthur
Fair.

Fixing the Date and Place for Payment of Land-tax and
Income-tax under the Land and Income Tax (Annual)
Act, 1941.

ORDER IN COUNCIL.
At the Government House at Wellington, this 10th day of
September, 1941.
Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.
IN pursuance and exercise of the powers and authority
vested in him under the Land and Income Tax Act,
1923, and the Land and Income Tax (Annual) Act, 1941,
His Excellency the Governor-General of the Dominion of
New Zealand, acting by and with the advice and consent
of the Executive Council of the said Dominion, doth hereby
order and determine that the respective duties leviable under
the said Acts by way of land-tax and income-tax shall be
paid on the days and dates set forth hereunder:
Land-tax under section two of the Land and Income Tax
(Annual) Act, 1941: In one sum on Tuesday, the thirtieth
day of September, one thousand nine hundred and forty-one.
Income-tax under section three of the Land and Income
Tax (Annual) Act, 1941: In one sum on Thursday, the
twelfth day of February, one thousand nine hundred and
forty-two.
And, in further pursuance and exercise of the powers and
authority aforesaid, and with the like advice and consent
as aforesaid, His Excellency doth also determine that the
place where the said duties of land-tax and income-tax shall
be payable shall be the office of the Commissioner of Taxes,
Wellington, and that notice to the aforegoing effect shall be
given by the said Commissioner accordingly.
