The North-eastern Side of Portion of Nelson Street and the North-western Side of Portion of Nicholson Street, in the City of Dunedin, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line.

ORDER IN COUNCIL.
At the Government House at Wellington, this 10th day of September, 1941.
Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.
IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of every other power in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Dunedin City Council on the ninth day of June, one thousand nine hundred and forty-one, viz. :
“ That the Dunedin City Council, being the local authority having control of the streets in the City of Dunedin, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to the undermentioned portions of streets, viz. :
“ (a) The north-eastern side of the portion of Nelson Street adjoining Allotment 15, Block XX, Township of Forbury Extension;
“ (b) The north-western side of the portion of Nicholson Street adjoining Allotments 14 and 15, Block XX, Township of Forbury Extension ;
such land being comprised and described in Certificate of Title, Register Book, Volume 29, folio 16 ” ;
subject to the condition that no building or part of a building shall at any time be erected on the land fronting the north-eastern side of the portion of Nelson Street or the north-western side of the portion of Nicholson Street (described in the Schedule hereto) within a distance of thirty-three feet from the centre-lines of the said portions of streets.
SCHEDULE.
THE north-eastern side of all that portion of street situated in the Otago Land District, City of Dunedin, known as Nelson Street, fronting Allotment 15, Block XX, Township of Forbury Extension.
Also the north-western side of all that portion of street in the said land district and city, known as Nicholson Street, fronting Allotments 14 and 15, Block XX, Township of Forbury Extension.
As the same are more particularly delineated on the plan marked P.W.D. 111433, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured red.

The Western Side of Portion of an unnamed Road, in the County of Waitaki, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line.

At the Government House at Wellington, this 10th day of September, 1941.

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.
IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of every other power in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Waitaki County Council on the twenty-seventh day of June, one thousand nine hundred and forty-one, viz. :
“ The Waitaki County Council, being the local authority having control of the roads in the Waitaki County, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to the western side of the road abutting on the eastern boundary of Allotment 1, on plan deposited in the Land Registry Office, Dunedin, as number 3836, being also part of Section 94 on the public maps of the Ardgowan Settlement (Block II, Oamaru District), and being all the land in Certificate of Title, 232/210, Otago Land Registry ” ;
subject to the condition that no building or part of a building shall at any time be erected on the land fronting the western side of the portion of the road (described in the Schedule hereto) within a distance of thirty-three feet from the centre-line of the said portion of road.
SCHEDULE.
THE western side of all that portion of an unnamed road situated in the Otago Land District, County of Waitaki, fronting Lot 1, D.P. 3836, being part Section 94, Ardgowan Settlement, Block II, Oamaru Survey District. As the same is more particularly delineated on the plan marked P.W.D. 111932, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured red.

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the southern side of the portion of Carnarvon Street or the western side of the portion of Newport Street (described in the Schedule hereto) within a distance of thirty-three feet from the centre-lines of the said portions of streets.
SCHEDULE.
THE southern side of all that portion of Carnarvon Street and the western side of all that portion of Newport Street, situated in the Otago Land District, City of Dunedin, fronting Lot 7, Block VI, D.P. 444, Belleknowes Estate, being part Sections 84 and 85, Block VI, Town District. As the same are more particularly delineated on the plan marked P.W.D. 111564, deposited in the office of the Minister of Public Works at Wellington, and thereon edged red.
