dated the twenty-ninth day of September, one thousand nine hundred and thirty-seven, and published in the Gazette of the seventh day of the following month at page 2270, licensing and permitting Lawford Godfrey Reeves to use and occupy a part of the foreshore and land below low-water mark at Bon Accord Harbour, Kawau Island, for the purpose of maintaining thereon a wharf.

SCHEDULE.

CLAUSE 3 of the First Schedule of the hereinbefore-recited Order in Council dated the 29th day of September, 1927, is amended by deleting the figures “£2 10s.” and substituting the figure “£1.”

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

PURSUANT to the Harbours Act, 1923, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby license and permit Lane and Sons, Limited, of Totara North (hereinafter called “the company,” which term shall include its successors or assigns, unless the context requires a different construction) to use and occupy a part of the foreshore and land below low-water mark at Tametame, Whangaroa Harbour, as shown on approved plan marked M.D. 674, and deposited in the office of the Marine Department at Wellington, for the purpose of maintaining thereon a wharf as shown on the said plan, such license to be held and enjoyed by the company upon and subject to the terms and conditions set forth in the Schedule hereto.

SCHEDULE.

(1) This license is subject to the Foreshore License Regulations 1940, and the provisions of those regulations shall, so far as applicable, apply hereto.

(2) The term of the license shall be fourteen years from the 24th day of July, 1941.

(3) The premium payable by the company shall be one pound (£1), and the annual sum so payable, five pounds (£5).

(4) The master of every vessel discharging ballast at the said wharf shall deposit such ballast above high-water mark, or at such place as may be approved by the Minister or by any person appointed by the Minister for that purpose.

Authorizing the Laying-off of a Street, off Dunn Street, in the City of Christchurch, of a Width less than 66 ft. but not less than 43 ft. 5 in.

At the Government House at Wellington, this 3rd day of September, 1941.

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

IN pursuance and exercise of the powers vested in him by the Municipal Corporations Act, 1933, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby authorize the Christchurch City Council to permit the laying off of the proposed street (described in the Schedule hereto) of a width less than sixty-six feet but not less than forty-three feet five inches.

SCHEDULE.

That proposed street, in the Canterbury Land District, City of Christchurch, containing by admeasurement 1 rood 3 perches, more or less, being part Lot 19 on D.P. 1969 and parts Lots 65 and 67 on D.P. 515, being parts of Rural Section 154. As the same is more particularly delineated on the plan marked P.W.D. 111003, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured red.

Authorizing the Laying-off of a Street between Hunter Street and Wrigley Street, in the Borough of Tauranga, of a Width less than 66 ft. but not less than 50 ft., subject to a Condition as to the Building-line.

ORDER IN COUNCIL.

At the Government House at Wellington, this 3rd day of September, 1941.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

IN pursuance and exercise of the powers vested in him by the Municipal Corporations Act, 1933, and the Public Works Act, 1928, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby authorize the Tauranga Borough Council to permit the laying-off of the proposed street described in the Schedule hereto of a width less than sixty-six feet but no less than fifty feet, subject to the condition that no building or part of a building shall at any time be erected on the land fronting the said proposed street within a distance of forty-eight feet from the centre-line of such street: Provided, however, that in respect of Lots 7 and 12 of the subdivision as shown on the plan marked P.W.D. 104038, mentioned in the Schedule hereto, this condition shall be forty-five feet from the centre-line of such street.

SCHEDULE.

That proposed street in the Auckland Land District, Borough of Tauranga, containing by admeasurement 2 roods 17 perches, more or less, being part Lot 25, D.P. 27968, being portion of Allotments 681 and 682, Section 2, Town of Tauranga. As the same is more particularly delineated on the plan marked P.W.D. 104035, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured red.

The Northern Side of Portion of Fillis Street, and the Western Side of Portion of Gover Street, New Plymouth, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line.

ORDER IN COUNCIL.

At the Government House at Wellington, this 3rd day of September, 1941.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of every other power in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the New Plymouth Borough Council on the twenty-third day of June, one thousand nine hundred and forty-one, viz:—

“The New Plymouth Borough Council, being the local authority having control of the streets in the Borough of New Plymouth, by resolution declares that the provisions of section one hundred and twenty-eight, subsection one of the Public Works Act, 1928, shall not apply—

“(a) To the northern side of the portion of Fillis Street adjoining Sections 1099 and 1100, Town of New Plymouth, Certificates of Title, Volume 126, folio 34, and Volume 126, folio 35, Taranaki Registry; nor

“(b) To the western side of the portion of Gover Street adjoining Section 1100, Town of New Plymouth, Certificate of Title, Volume 126, folio 35, Taranaki Registry”;

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the northern side of portion of Fillis Street and the western side of the portion of Gover Street (described in the Schedule hereto), within a distance of thirty-three feet from the centre-lines of the said portions of streets.
