SCHEDULE.

THE northern side of all that portion of street, situated in the Taranaki Land District, Borough of New Plymouth, known as Filiis Street, fronting Section 1100 and part Section 1099, Town of New Plymouth. Also the western side of all that portion of street, situated in the said land district and borough, known as Gover Street, fronting Section 1100, Town of New Plymouth. As the said portions of streets are more particularly delineated on the plan marked P.W.D. 111821, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured red.

The Northern and Southern Sides of Portions of Wordsworth Street, in the City of Christchurch, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line.

ORDER IN COUNCIL.

At the Government House at Wellington, this 3rd day of September, 1941.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of every other power in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Christchurch City Council on the fourteenth day of July, one thousand nine hundred and forty-one (the sides and portions of the street affected being more particularly described in the Schedule hereto), viz.:

"The Christchurch City Council, having control of the streets in the City of Christchurch, hereby declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to the southern side and portion of the northern side of Wordsworth Street between Durham and Harper Streets fronting Lot 81, D.P. 2, part R.S. 79, contained in Certificate of Title, Volume 3, folio 177, and fronting Lot 83, D.P. 2, part R.S. 79, contained in Certificate of Title, Volume 7, folio 77, and fronting part Lot 2, D.P. 2666, part R.S. 79, contained in Certificate of Title, Volume 452, folio 269";

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the southern side and the northern side of the portions of Wordsworth Street (described in the Schedule hereto), within a distance of thirty-three feet from the centre-lines of the said portions of street.

SCHEDULE.

THE southern side of all that portion of street, situated in the Canterbury Land District, City of Christchurch, known as Wordsworth Street, fronting Lot 83, D.P. 2, and Lot 2, D.P. 2566, being parts Rural Section 79.

Also the northern side of all that portion of the said street fronting Lot 81, D.P. 2, being part Rural Section 79.

As the same are more particularly delineated on the plan marked P.W.D. 111809, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured red.

"The New Plymouth Borough Council, being the local authority having control of the streets in the Borough of New Plymouth, by resolution declares that the provisions of section one hundred and twenty-eight, subsection one of the Public Works Act, 1928, shall not apply—

"(a) To the western side of the portion of Weymouth Street, adjoining Section 63, Town of New Plymouth, Certificate of Title, Volume 124, folio 79, Taranaki Registry; nor

"(b) To the southern side of the portion of Hine Street, adjoining the said Section 63, Town of New Plymouth";

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the western side of the portion of Weymouth Street and the southern side of the portion of Hine Street (described in the Schedule hereto), within a distance of thirty-three feet from the centre-lines of the said portions of streets.

Declaring Road in Block IX, Waiwera Survey District, to be Government Road.

ORDER IN COUNCIL.

At the Government House at Wellington, this 3rd day of September, 1941.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

IN pursuance and exercise of the powers vested in him by the Public Works Act, 1928, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby order and declare that the portions of road described in the Schedule hereto shall, on and after the date of this Order in Council, become Government road.
