The Eastern Side of Portion of Smart Road, in the County of Taranaki, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line.

ORDER IN COUNCIL.
At the Government House at Wellington, this 27th day of August, 1941.
Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.
IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of every other power in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Taranaki County Council on the seventh day of April, one thousand nine hundred and forty-one, viz.:
"That the Taranaki County Council, being the local authority having control of the roads in the County of Taranaki, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to the eastern side of the portion of Smart Road adjoining Section 2, Native Reserve B 1, Hua District, Paritutu Survey District, being all the land in Certificate of Title, Volume 31, folio 133 (Taranaki Register)";
subject to the condition that no building or part of a building shall at any time be erected on the land fronting the eastern side of the portion of Smart Road (described in the Schedule hereto), within a distance of thirty-three feet from the centre-line of the said portion of road.
SCHEDULE.
THE eastern side of all that portion of road situated in the Taranaki Land District, County of Taranaki, known as Smart Road, fronting Lot 2, D.P. 880, being part Native Reserve B 1, Hua District, Block VI, Paritutu Survey District. As the same is more particularly delineated on the plan marked P.W.D. 111877, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured red.

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.
IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the New Plymouth Borough Council on the fourth day of August, one thousand nine hundred and forty-one, viz.:
"The New Plymouth Borough Council, being the local authority having control of the streets in the Borough of New Plymouth, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to the southern side of Harris Street adjoining Section 818 and part Section 817, Town of New Plymouth, Certificate of Title, Volume 65, folio 228, Taranaki Register";
the side of street affected by such resolution being described in the Schedule hereto.
SCHEDULE.
THE southern side of all that street, situated in the Taranaki Land District, Borough of New Plymouth, known as Harris Street, fronting Section 818 and part Section 817, Town of New Plymouth. As the same is more particularly delineated on the plan marked P.W.D. 111588, deposited in the office of the Minister of Public Works at Wellington, and thereon edged red.

Variation of Order in Council prohibiting Alienation of Native Land.

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.
PURSUANT to section one hundred and sixty-seven of the Native Land Act, 1931, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby vary an Order in Council made on the fourth day of April, one thousand nine hundred and thirty-two, and published in the Gazette on the seventh day of April, one thousand nine hundred and thirty-two, at page 735, and affecting Hauturu East B 2, Section 2A 1A and other blocks, by excluding therefrom the land described in the Schedule hereto.

Extending the Open Season for the taking or killing of Opossums, Marlborough Acclimatization District.

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.
IN pursuance of the powers conferred on him by the Animals Protection and Game Act, 1921–22, and of all other powers and authorities enabling him in this behalf, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby amend the Order in Council made under the said Act, dated the thirtieth day of April, one thousand nine hundred and forty-one, and appearing in the New Zealand Gazette, number thirty-seven, of the first day of May, one thousand nine hundred and forty-one, at page 1081, by deleting the words “1st September” appearing under the heading “Marlborough Acclimatization District” in the Schedule to such Order in Council, and contained in Condition Number One under the said heading, and by inserting in lieu thereof the words “15th September”:
And all licenses issued to take or kill opossums in the Marlborough Acclimatization District under the authority of the said Order in Council are hereby further extended until noon on the said fifteenth day of September, one thousand nine hundred and forty-one.
