Authorizing the Laying-off of a Street (Toroa Terrace), in the Borough of Mount Albert, of a Width less than 66 ft. but not less than 46 ft., subject to a Condition as to the Building-line.

At the Government House at Wellington, this 30th day of July, 1941.

Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

IN pursuance and exercise of the powers vested in him by the Municipal Corporations Act, 1933, and the Public Works Act, 1928, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby authorize the Mount Albert Borough Council to permit the laying-off of the proposed street described in the Schedule hereto of a width less than sixty-six feet but not less than forty-six feet, subject to the condition that no building or part of a building shall at any time be erected on the land fronting the south-western side of the said street, within a distance of seventy-one feet from the north-eastern boundary of the said street.

SCHEDULE.

THAT proposed street, in the North Auckland Land District, Borough of Mount Albert, containing by admeasurement 29·1 perches, more or less, being part Allotment 97, Parish of Titirangi. As the same is more particularly delineated on the plan marked P.W.D. 110790, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured red.

The Southern Side of Portion of Wharua Road, in the City of Auckland, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line.

ORDER IN COUNCIL.
At the Government House at Wellington, this 30th day of July, 1941.

Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of every other power in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Auckland City Council on the twenty-seventh day of March, one thousand nine hundred and forty-one, in so far as it affects the side and the portion of street described in the Schedule hereto, viz.:

“ The Auckland City Council, being the local authority having control of the streets in the City of Auckland, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to that portion of Wharua Road, adjoining portions of Allotments 3 and 5, Section 16, Suburbs of Auckland, comprised in Certificates of Title, 601/33 and 431/165 ”;

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the southern side of the portion of Wharua Road (described in the Schedule hereto), within a distance of thirty-three feet from the centre-line of the said portion of street.

SCHEDULE.

THE southern side of all that portion of street situated in the North Auckland Land District, City of Auckland, known as Wharua Road, fronting Lot 58, D.P. 6787, and Lot 11, D.P. 141, being parts Allotment 3; Section 16, Suburbs of Auckland. As the same is more particularly delineated on the plan marked P.W.D. 111236, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured red.

“ That the Dunedin City Council, being the local authority having control of the streets in the City of Dunedin, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to the southern side of the portion of Macandrew Road adjoining Lot 15, Block X, Township of Forbury, such land being comprised and described in Certificate of Title, Register Book, Volume 32, folio 85 ”;

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the southern side of the portion of Macandrew Road (described in the Schedule hereto), within a distance of thirty-three feet from the centre-line of the said portion of street.

SCHEDULE.

THE southern side of all that portion of street, situated in the Otago Land District, City of Dunedin, known as Macandrew Road, fronting Lot 15, Block X, D.P. 8, Township of Forbury. As the same is more particularly delineated on the plan marked P.W.D. 111565, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured red.

The North-western Side of Portion of Long Street, in the City of Christchurch, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line.

“ The Christchurch City Council, having control of the streets in the City of Christchurch, hereby resolves that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to the north-western side of that portion of Long Street adjoining the land comprised in Certificate of Title, Volume 78, folio 49, being Lot 15, D.P. 99, and part of Rural Section 31 ”;

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the north-western side of the portion of Long Street (described in the Schedule hereto), within a distance of forty-eight feet from the centre-line of the said portion of street.
