Regulations under the Naval Defence Act, 1913, amended.

ORDER IN COUNCIL.

At the Government House at Wellington, this 18th day of June, 1941.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

IN pursuance and exercise of the powers and authorities conferred on him by section twenty-five of the Naval Defence Act, 1913, and of all other powers and authorities enabling him in that behalf, His Excellency the Governor-General, with the advice of the Executive Council, doth hereby amend and supplement the regulations referred to in the Schedule hereto as shown therein.

SCHEDULE.

Regulations for the Government and Payment of the New Zealand Naval Forces, 1899.

Article 390, paragraph 1: Cancel and substitute:—

  1. Director of Naval Medical Services.—The Medical Officer in charge of the sick quarters at Devonport Naval Base is appointed to be the Naval Board’s adviser on medical questions in addition to his normal duties. For this purpose he will be appointed to the depot ship for ship duties and in charge of the sick quarters, and as Director of Naval Medical Services.

Restricting the Grant of Dredging Claims of 30 Acres or Less.

PURSUANT to section thirty-four of the Statutes Amendment Act, 1940, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby declare that from and after the date hereof no dredging claim of 30 acres or less shall be granted over any lands in New Zealand without the previous written consent of the Minister of Mines.

Restricting the Grant and Disposal of Mining Privileges over certain Lands in the Nelson Land District.

IN pursuance and exercise of the powers vested in him by section thirty-four of the Statutes Amendment Act, 1940, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby declare that from and after the date hereof no mining privileges shall be granted or transferred in respect of the lands described in the Schedule hereto without the previous written consent of the Minister of Mines.

Order in Council as to Superannuation Rights of Helmore Henry Brown and Madeline Shaw, Employees of the New Zealand Post and Telegraph Employees’ Association and Officers’ Guild (Incorporated).

ORDER IN COUNCIL.

At the Government House at Wellington, this 25th day of June, 1941.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

WHEREAS the persons whose names are set out in the Schedule hereto are exclusively engaged as employees of the New Zealand Post and Telegraph Employees’ Association and Officers’ Guild (Incorporated) (hereinafter referred to as “the Association”), being an approved organization within the meaning of section fifteen of the Finance Act (No. 2), 1940, and have been continuously so engaged since the respective dates specified in the said Schedule:

And whereas immediately before becoming so engaged with the Association each of the said persons was a contributor to the Public Service Superannuation Fund and was then contributing to the said fund five per centum of his or her salary:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the power and authority conferred on him by section fifteen of the Finance Act (No. 2), 1940, and of every other power and authority enabling him in that behalf, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby order and declare as follows:—

  1. This Order in Council shall come into force on the first day of July, one thousand nine hundred and forty-one (hereinafter referred to as “the date of readmission”).

  2. Each of the persons named in the said Schedule (hereinafter referred to as “the contributor”) shall be deemed to have been and to be a contributor to the Public Service Superannuation Fund during and in respect of the period of engagement of the contributor with the Association, subject, however, to the provisions of the aforesaid section fifteen of the Finance Act (No. 2), 1940, and to the following express conditions, namely:—

(a) Each contributor shall pay to the credit of the Public Service Superannuation Fund on or before the date of readmission:—

(i) In respect of his service as an employee of the Government prior to his engagement by the Association, a sum to be calculated by the Government Actuary as being equal to the amount of contributions refunded to the contributor from the Public Service Superannuation Fund on his resignation from the Government Service, together with interest thereon computed at the rate of four per centum per annum with yearly rests from the date of such resignation to the date of readmission; and

(ii) In respect of the period between the date of the resignation of the contributor from the Government Service and the date of readmission (during which period he was an employee of the Association), a sum calculated by the Government Actuary as being equal to five per centum of the annual salary received by him from the Association during that period, together with interest thereon computed at the rate of four per centum per annum with yearly rests up to the date of readmission.

(b) The Association shall in respect of the service of each contributor with the Association between the date of his resignation from the Government Service and the date of readmission pay to the credit of the Public Service Superannuation Fund on or before the date of readmission a sum calculated by the Government Actuary as being:—

(i) In the case of a male contributor sixty per centum; and

(ii) In the case of a female contributor one hundred per centum

of the amount to be paid to the credit of the fund by that contributor pursuant to the provisions of paragraph (ii) of the preceding clause (a) hereof.

(c) From the date of readmission there shall be payable to the fund at such times and in such instalments as may be determined by the Public Service Superannuation Board:—

(i) By the contributor (in accordance with the said section fifteen) a contribution of five per centum of the salary for the time being payable to the contributor by the Association; and

(ii) By the Association, in the case of a male contributor sixty per centum and in the case of a female contributor one hundred per centum of the amount required by the preceding paragraph (i) to be paid by the contributor.

  1. If any contributor is re-employed by the Association while in receipt of a retiring-allowance from the Public Service Superannuation Fund, no more of such retiring-allowance shall be paid in respect of any month than is equivalent, when added to the remuneration so received by him in that month, to one-twelfth of the annual salary on the basis of which he was contributing to the fund at the date of his retirement.
