Consenting to the Raising of the Balance (£8,855) of the Wairoa Borough Council’s Loan of £20,000 and prescribing the Conditions thereof.

ORDER IN COUNCIL.

At the Government House at Wellington, this 18th day of June, 1941.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

WHEREAS by Order in Council made on the thirty-first day of March, one thousand nine hundred and thirty-eight, and subject to the determinations as to borrowing and repayment therein set out, consent was given to the raising by the Wairoa Borough Council (hereinafter called “the said local authority”) of the sum of twenty thousand pounds (£20,000) to be known as “Housing Loan, 1938” (hereinafter called “the said loan”):

And whereas the authority conferred by the said Order in Council has not been exercised to the extent of eight thousand eight hundred and fifty-five pounds (£8,855):

And whereas the authority has lapsed in accordance with the provisions of clause six of the said Order in Council, and it is not now lawful or competent for the said local authority to raise this amount or any portion thereof except in accordance with the provisions of a further Order in Council that may be issued pursuant to section eleven of the Local Government Loans Board Act, 1926 (hereinafter called “the said Act”):

And whereas the said local authority is desirous of raising the balance of the said loan amounting to eight thousand eight hundred and fifty-five pounds (£8,855) (hereinafter called “the said sum”), and it is expedient to authorize the said local authority to raise the said sum on the conditions hereinafter set out:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in pursuance and exercise of the powers and authorities conferred on him by section eleven of the said Act, as set out in section twenty-nine of the Finance Act, 1932 (No. 2), and of all other powers and authorities enabling him in this behalf, doth hereby consent to the raising in New Zealand by the said local authority of the said sum up to the amount of eight thousand eight hundred and fifty-five pounds (£8,855) for the purpose for which the said loan was authorized, and in giving such consent doth hereby determine as follows:—

(1) The term for which the said sum or any part thereof may be borrowed shall not exceed thirty (30) years.

(2) The rate of interest that may be paid in respect of the said sum or any part thereof shall be such as shall not produce to the lender or lenders a rate exceeding three pounds (£3) per centum per annum.

(3) The said sum or any part thereof, together with interest thereon, shall be repaid by equal aggregate annual or half-yearly instalments extending over the term as determined in (1) above.

(4) The payment of such instalments shall be made in New Zealand, and no such instalments shall be paid out of loan-moneys.

(5) The rate payable for brokerage, underwriting, and procurement fees in respect of the borrowing of the said sum or any part thereof shall not in the aggregate exceed one-half per centum of any amount raised.

(6) No moneys shall be borrowed under this consent after the expiration of two years from the date hereof.

Declaring Portion of Road in Block IX, Paekakariki Survey District, to be Government Road.

ORDER IN COUNCIL.

At the Government House at Wellington, this 25th day of June, 1941.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

IN pursuance and exercise of the powers vested in him by the Public Works Act, 1928, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby order and declare that the portion of road described in the Schedule hereto shall, on and after the date of this Order in Council, become Government road.


SCHEDULE.

APPROXIMATE area of the piece of road declared to be Government road: 30 perches.

Adjoining or passing through Section 99, Pahautanui Agricultural Reserve.

Situated in Block IX, Paekakariki Survey District. (S.O. 20270.)

In the Wellington Land District; as the same is more particularly delineated on the plan marked P.W.D. 107683, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured green.

Cancelling the Reservation over a Reserve in Parish of Waiwera, North Auckland Land District.

ORDER IN COUNCIL.

At the Government House at Wellington, this 18th day of June, 1941.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

IN pursuance and exercise of the powers and authorities conferred upon him by subsection one (b) of section seven of the Public Reserves, Domains, and National Parks Act, 1928, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby cancel the reservation for a landing-place over the land described in the Schedule hereto; and doth hereby declare that the said land, being vested in the Crown, is Crown land available for disposal under the Land Act, 1924.


SCHEDULE.

NORTH AUCKLAND LAND DISTRICT.

ALL that area containing by admeasurement 14 acres, more or less, being portion of Allotment 110A, Parish of Waiwera, and being all the land comprised in Certificate of Title, Volume 393, folio 267, Auckland Registry.

Cancelling the Vesting of a Reserve in the Rodney County Council.

ORDER IN COUNCIL.

At the Government House at Wellington, this 18th day of June, 1941.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

WHEREAS the land described in the Schedule hereto is a reserve vested in the Rodney County Council for a site for a public library, mechanics’ institute, and athenæum:

And whereas it is expedient that the vesting of the said land as hereinbefore referred to should be cancelled, and the Rodney County Council has duly consented to such cancellation:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in pursuance and exercise of the powers and authorities conferred upon him by subsection one of section ten of the Public Reserves, Domains, and National Parks Act, 1928, doth hereby cancel the vesting in the Rodney County Council of the land described in the Schedule hereto.
