Price Order No. 37.
IN pursuance of the powers conferred upon the Price Tribunal by the Control of Prices Emergency Regulations 1939, and with the authority of the Minister of Industries and Commerce, the Price Tribunal hereby makes the following Price Order :—

This Order may be cited as Price Order No. 37.

In this Order the expressions “dairyman” and “milk-vendor” shall have the meanings given to them by section 2 of the Auckland Metropolitan Milk Amendment Act, 1935, and “milk” and “cream” mean and refer to milk and cream falling under or affected by the provisions of the Auckland Metropolitan Milk Act, 1933, or the said amendment thereof.

The prices to be paid by a milk-vendor to a dairyman for milk and cream shall be as follows :—
Per lb. Butterfat.
(1) (a) For separated cream bought for the cream trade : On the basis of s. d.
If delivery of such cream takes place elsewhere than at the dairy premises (i.e., the farm) or at a collection stand, the cost of transport to be borne by the purchaser. 2 4
(b) For milk for separation into cream for the cream trade—
Per Gallon. s. d.
(1) If delivery is taken at the dairy premises or at a collection stand.. 0 10½
(2) If delivery is taken elsewhere 0 11⅓
(c) For all milk except as provided in subclause (b) hereof 1 5¼
Subject to such one or more of the following deductions as may be applicable, namely—
(1) In the case of milk purchased by a milk-vendor, delivery whereof is taken at the dairy premises or at a collection stand, a deduction of 0 0⅞
(2) In the case of milk purchased by a milk-vendor and chilled but not pasteurized by him, a deduction of 0 0⅞
(3) In the case of milk purchased by a milk-vendor and pasteurized by him, a deduction of .. 0 2⅛
- The prices to be charged by a milk-vendor for milk and cream sold in the Auckland Metropolitan Milk District (as constituted by the aforesaid Acts) shall be as follows :—
(1) For Cream save only in any Case where a Different Price is specifically fixed : (Price in each Case to include Delivery)—
(a) Sold by Wholesale for resale s. d.
(1) Where sold loose (per gallon) 12 6
(2) Where sold in sealed bottles, for each ¼ pint 0 5
(3) Where sold in cartons or other containers of a like nature (not being bottles)—
(a) For each carton or container holding 4 oz. 0 5
(b) For each carton or container holding 8 oz. 0 10
(b) Sold to any person for any purpose other than for resale—
(1) Where the quantity sold is not less than 5 gallons in any one day (per gallon) 12 3
(2) Where the quantity sold is less than 5 gallons and not less than 1 quart in any one day (per gallon) 13 3
(3) Where sold loose or in sealed bottles in quantities of less than 1 quart in any one day—
(a) For ¼ pint 0 6
(b) For ½ pint 0 11
(c) For 1 pint 1 8
(4) Where sold in cartons or other containers of a like nature (not being bottles) in quantities of less than 1 quart in any one day—
(a) For 4 oz. 0 6
(b) For 8 oz. 0 11
(c) For 16 oz. 1 8
(d) In a quantity not specified above the price to be in proportion to that fixed for the nearest lower specified quantity.
(2) For Cream sold in Cartons to Proprietors of Fruit Shops licensed to sell Cream in Cartons : (Price in each Case to include Delivery)—

(a) For each carton containing 4 oz. 0 5
(b) For each carton containing 8 oz. 0 10
(3) To any Hospital Board constituted under the Hospitals and Charitable Institutions Act, 1926 : For milk sold to such Board for consumption or use in any hospital or infirmary in the milk district controlled by such Board (this price to include delivery within the milk district) Per Gallon. s. d.

(4) To any Shipping Company or Agent thereof in the Milk District—
(a) For cream containing not more than 30 parts per cent. by weight of milk-fat (this price to include delivery within the milk district) 8 2
(b) For other cream the prices fixed by subclause (b) of clause (1) above.
(5) For Milk—
(a) Bought by a roundsman for resale on a milk round or by a milk-vendor for resale by wholesale—
(1) Where bought in quantities of not less than 20 gallons in any one day 1 6
(2) Where bought in quantities of not less than 10 gallons in any one day by a purchaser who was a daily customer of the vendor throughout the whole of the period from September to January last (both inclusive) and whose daily purchase from the vendor during such months averaged not less than 10 gallons.. 1 6
(3) In all other cases.. 1 8¾
Subject in each of the above cases to a deduction of ½d. per gallon if delivery of the milk takes place at the depot of the milk-vendor from whom the milk is bought.
“Depot” for this purpose means the premises at which the milk-vendor chills or pasteurizes milk, or, if he does not engage in such work, means his principal depot within the district.
If in any of the above cases the milk bought is bottled milk, the price thereof shall be increased—
(1) Where the purchaser supplied the bottles and crates by 0 1¼
(2) Where the purchaser does not supply the bottles and crates by 0 2
(b) Bought by the proprietor of a milk-shop for resale in such shop or used therein (price to include delivery at such shop)—
(1) Where bought in quantities of not less than 10 gallons in any one day 1 8
(2) Where bought in quantities of less than 10 gallons in any one day 1 9
For the purpose hereof “milk-shop” means any shop, room, building, or part of a building, or place in or at which any person is licensed by the Auckland Metropolitan Milk Council to sell milk by retail.
(c) Bought by any person save only in any case where a different price is specifically fixed (price to include delivery)—
(1) In quantities of 100 gallons or over in any one day 1 7
(2) In quantities of under 100 gallons and not less than 75 gallons in any one day 1 8
(3) In quantities of under 75 gallons and not less than 40 gallons in any one day 1 9
(4) In quantities of under 40 gallons and not less than 10 gallons in any one day 1 10
(5) In quantities of under 10 gallons and not less than 3 gallons in any one day 1 11
(6) In quantities of under 3 gallons and not less than 1 gallon in any one day 2 1
Bottled milk in each of the foregoing cases to be 2d per gallon extra.
