Order in Council validating Irregularities in Debentures issued
in pursuance of Authority given for the Raising of a Loan
of £7,000 by the Tauranga Hospital Board.

C. L. N. NEWALL, Governor-General.

ORDER IN COUNCIL.

At the Government House at Wellington, this 26th day of
March, 1941.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

WHEREAS the Tauranga Hospital Board (hereinafter
called “the said Board”) on the twenty-second
day of February, one thousand nine hundred and forty,
resolved by way of special order to raise a loan of seven
thousand pounds (£7,000) for building purposes, such loan
to be known as the “Tauranga Hospital Board Building
Loan, 1940, No. 1 of £7,000”:

And whereas on the twenty-eighth day of February, one
thousand nine hundred and forty, the said Board applied
to the Local Government Loans Board for approval to
raise the said loan:

And whereas by an Order in Council bearing date the tenth
day of July, one thousand nine hundred and forty, and
published in the New Zealand Gazette of the eighteenth day
of July, one thousand nine hundred and forty, No. 74, at
page 1704, His Excellency the Governor General of the
Dominion of New Zealand, acting by and with the advice
and consent of the Executive Council of the said Dominion,
and in pursuance and exercise of the powers and authorities
conferred on him by section eleven of the Local Government
Loans Board Act, 1926, as set out in section twenty-nine
of the Finance Act, 1932 (No. 2), consented to the raising
of the said loan of seven thousand pounds (£7,000) by the
said Board, to be known as “Building Loan, 1940,” upon
the terms and conditions in the said Order in Council set forth:

And whereas by an Order in Council bearing date the
eleventh day of September, one thousand nine hundred and
forty, and published in the New Zealand Gazette of the nine-
teenth day of September, one thousand nine hundred and
forty, No. 99, at page 2356, His Excellency the Governor-
General of the said Dominion of New Zealand, acting by and
with the advice and consent of the Executive Council of the
said Dominion, and in pursuance and exercise of the powers
and authorities conferred on him by section eleven of the
Local Government Loans Board Act, 1926, as set out in
section twenty-nine of the Finance Act, 1932 (No. 2), varied
the terms and conditions upon which the said loan of seven
thousand pounds (£7,000) might be borrowed by the said
Board, such loan to be known as “Building Loan, 1940”:

And whereas in pursuance of such authorities the said
Board has issued twenty debentures each for three hundred
and fifty pounds (£350) bearing date the twenty-sixth day
of November, one thousand nine hundred and forty, sealed
with the common seal of the said Board and signed by Albert
Edward Newsham and Lionel Roberts Wilkinson, two
members of the said Board, and has also issued all necessary
interest coupons in accordance with such consents as afore-
said:

And whereas the said debentures and coupons erroneously
referred to the said loan as “Building Loan, 1940, No. 1, of
£7,000,” instead of “Building Loan, 1940,” as named in the
said Orders in Council, and failed to recite the fact that such
debentures were issued under the Local Government Loans
Board Act, 1926, and the Finance Act, 1932 (No. 2), as shown
by the said Orders in Council:

Now, therefore, His Excellency the Governor-General
of the said Dominion of New Zealand, acting by and with the
advice and consent of the Executive Council of the said
Dominion, and being satisfied that the ratepayers have not
been misled, and in pursuance and exercise of the powers
and authorities conferred on him by section one hundred and
twenty-two of the Local Bodies’ Loans Act, 1926, and of
all other powers and authorities enabling him in that behalf,
doth hereby validate the said proceedings and the said
debentures and coupons as given by the said Board for the
said loan of seven thousand pounds (£7,000) and interest
thereon as provided by the said Orders in Council bearing
dates the tenth day of July, one thousand nine hundred and
forty, and the eleventh day of September, one thousand
nine hundred and forty, respectively, such loan being known
as “Building Loan, 1940,” as being proper securities for the
said loan as authorized by the said Orders in Council.
