Licensing Trustees to use and occupy a Part of the Foreshore at Mercury Bay, Whitianga Harbour, as a Site for a Wharf.

At the Government House at Wellington, this 26th day of March, 1941.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

PURSUANT to the Harbours Act, 1923, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby license and permit William Lee, William H. Heald, Albert Bowman, George W. Pooley, and Alfred Lupton Lee, all of Whitianga, as trustees for certain residents of the district (hereinafter called “the trustees,” which term shall include their executors, administrators, or assigns, unless the context requires a different construction), to use and occupy a part of the foreshore and land below low-water mark at Mercury Bay, Whitianga Harbour, as shown on plan marked M.D. 2639, approved on the twenty-eighth day of July, one thousand nine hundred and three, and deposited in the office of the Marine Department at Wellington, for the purpose of maintaining thereon a wharf, as shown on the said plan, such license to be held and enjoyed by the trustees upon and subject to the terms and conditions set forth in the Schedule hereto.


SCHEDULE.

(1) This license is subject to the Foreshore License Regulations 1940, and the provisions of those regulations shall, so far as applicable, apply hereto.

(2) The term of the license shall be fourteen years from the date hereof.

(3) The annual sum payable by the trustees shall be 1s. payable on demand.

Authorizing the Exchange of Portion of a Reserve in Town of Picton, Marlborough Land District, for other Land.

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

WHEREAS the land described in the First Schedule hereto is portion of a public utility reserve: And whereas it is expedient that the said land should be exchanged for the land described in the Second Schedule hereto, which the Governor-General deems of equal value and more suitable for the purposes of the reserve:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in exercise of the powers and authorities conferred upon him by section eight of the Public Reserves, Domains, and National Parks Act, 1928, doth hereby declare that the land described in the First Schedule hereto may be exchanged for the land described in the Second Schedule hereto.


FIRST SCHEDULE.

MARLBOROUGH LAND DISTRICT.

Description of Reserve authorized to be exchanged.

SECTIONS 62, 63, 65 to 69 (inclusive), and 75 to 80 (inclusive), Town of Picton: Area, 3 acres 1 rood, more or less.


SECOND SCHEDULE.

MARLBOROUGH LAND DISTRICT.

Description of Land to be obtained in exchange therefor.

SECTIONS 1039 to 1047 (inclusive), and 1054 to 1060 (inclusive), Town of Picton: Area, 4 acres, more or less.

Recreation Reserve in Canterbury Land District brought under Part II of the Public Reserves, Domains, and National Parks Act, 1928.

At the Government House at Wellington, this 2nd day of April, 1941.

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

BY virtue of the powers and authorities vested in me by the thirty-fourth section of the Public Reserves, Domains, and National Parks Act, 1928, I, Cyril Louis Norton Newall, Governor-General of the Dominion of New Zealand, by and with the advice and consent of the Executive Council of the said Dominion, do hereby order and declare that the reserve for recreation in the Canterbury Land District described in the Schedule hereto shall be and the same is hereby brought under the operation of and declared to be subject to the provisions of Part II of the said Act, and such reserve shall hereafter form part of the Waitaki North Domain, and be managed, administered, and dealt with as a public domain by the Waitaki North Domain Board.


SCHEDULE.

CANTERBURY LAND DISTRICT.

ALL that area containing by admeasurement 1 rood 35·5 perches, more or less, and being part Reserve 3723, Block XIV, Waitaki Survey District, and bounded as follows: Towards the north-east by the Main South Road, 588·85 links, and towards the south-west and north-west by Reserve 4426, 428·63 links and 249·65 links respectively. As the same is more particularly delineated on the plan marked L. and S. 6/7/218F, deposited in Head Office, Department of Lands and Survey, at Wellington, and thereon bordered red.

IN pursuance and exercise of the powers conferred by section forty-four of the Public Reserves, Domains, and National Parks Act, 1928, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby appoint

John Hammond,
Charles Thomas William Baines,
William John Schaare,
Walter John Meldon, and
Thomas Fothergill

to be the Makotuku Domain Board, having control of the land described in the Schedule hereto; and doth hereby appoint Friday, the ninth day of May, one thousand nine hundred and forty-one, at eight o’clock p.m., as the time when, and the Makotuku Public Hall, as the place where, the first meeting of the Board shall be held.


SCHEDULE.

MAKOTUKU DOMAIN.—HAWKE’S BAY LAND DISTRICT.

SECTION 13, Block IX, Takapau Survey District: Area 5 acres, more or less.
