Cancelling the Reservation over a Reserve in Parish of Waiuku West, North Auckland Land District.

ORDER IN COUNCIL.
At the Government House at Wellington, this 10th day of December, 1941.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

IN pursuance and exercise of the powers and authorities conferred upon him by subsection one (b) of section seven of the Public Reserves, Domains, and National Parks Act, 1928, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby cancel the reservation for a cemetery over the land described in the Schedule hereto; and doth hereby declare that the said land, being vested in the Crown, is Crown land available for disposal under the Land Act, 1924.


SCHEDULE.

NORTH AUCKLAND LAND DISTRICT.

ALLOTMENT 134A, Waiuku West Parish, Block VII, Maioro Survey District: Area, 2 acres 1 rood 7 perches, more or less.

Changing the Purpose of the Reservation over Portion of the New Lynn Domain, North Auckland Land District.

ORDER IN COUNCIL.
At the Government House at Wellington, this 10th day of December, 1941.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

WHEREAS a notice of intention to issue an Order in Council declaring that the portion of the New Lynn Domain, described in the Schedule hereto, shall cease to be subject to Part II of the Public Reserves, Domains, and National Parks Act, 1928, and shall be deemed to be a site for a public pound subject to Part I of the said Act, was published in the Gazette of the second day of October, one thousand nine hundred and forty-one:

And whereas such notice of intention was duly laid before both Houses of Parliament in accordance with the provisions of subsection two of section seven of the Public Reserves, Domains, and National Parks Act, 1928:

And whereas the Legislative Council and the House of Representatives, by resolutions dated respectively the ninth and eighth days of October, one thousand nine hundred and forty-one, approved the proposed change of purpose as aforesaid:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the powers and authorities conferred by subsection one of section forty-one of the Public Reserves, Domains, and National Parks Act, 1928, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby declare that from and after the day of the date hereof the portion of the New Lynn Domain, described in the Schedule hereto, shall cease to be subject to Part II of the said Act, and shall be a site for a public pound subject to Part I of the said Act.


SCHEDULE.

NORTH AUCKLAND LAND DISTRICT.—PART NEW LYNN DOMAIN.

ALL that area containing by admeasurement 1 acre 0 roods 10 perches, more or less, being part Allotment 363, Waikomiti Parish, Block III, Titirangi Survey District. As the same is more particularly delineated on the plan marked L. and S. 1/606A, deposited in the Head Office, Department of Lands and Survey, at Wellington, and thereon edged red. HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

WHEREAS a notice of intention to issue an Order in Council declaring that the reservation over the lands described in the Schedule hereto shall be changed from a reserve for public recreation purposes to a reserve for aerodrome purposes was published in the Gazette of the fourth day of September, one thousand nine hundred and forty-one:

And whereas such notice of intention was duly laid before both Houses of Parliament in accordance with the provisions of subsection two of section seven of the Public Reserves, Domains, and National Parks Act, 1928:

And whereas the Legislative Council and the House of Representatives, by resolutions dated respectively the ninth and the eighth days of October, one thousand nine hundred and forty-one, approved the proposed change of purpose as aforesaid:

ALL that area containing by admeasurement 1 acre 1 rood 4 perches, more or less, and being part of Reserve 1858, situated in Block II, Patiti Survey District, and bounded as follows: Commencing at a point on the production, in an easterly direction, of the northern boundary of Lot 62, D.P. 4075, and distant 275·8 links from the north-eastern corner of that lot; thence easterly on the same production a distance of 128·95 links; thence south-westerly bearing 213° 51', a distance of 1336·7 links; thence north-westerly bearing 332° 24', a distance of 109·0 links; and thence north-easterly bearing 38° 51', a distance of 1212·76 links, to the point of commencement. Also all that area containing by admeasurement 1 acre 0 roods 10 perches, more or less, and being part of Reserve 1858, situated in the Borough of Timaru, and bounded as follows: Commencing at a point being distant 500·8 links, bearing 76° 21' 11" from the north-eastern corner of Lot 62, Deposit Plan 4075; thence north-easterly a distance of 40·0 links, bearing 38° 51'; thence easterly generally by right lines parallel to and 100·0 links distant from the northern boundary of the said Reserve 1858, 281·8 links, 1004·7 links, 308·4 links, 401·7 links, 671·4 links, 759·9 links, and 828·8 links; thence south-easterly a distance of 25·8 links, bearing 225° 31'; and thence westerly generally by right lines parallel to and 125·0 links distance from the northern boundary of the said Reserve 1858, 812·7 links, 734·2 links, 677·3 links, 428·9 links, 303·3 links, 995·5 links, and 310·3 links to the point of commencement. As the same are more particularly delineated on the plan marked L. and S. 6/11/81D, deposited in the Head Office, Department of Lands and Survey, at Wellington, and thereon coloured red.
