Increasing Borrowing-powers of Wanganui Fire Board.

GALWAY, Governor-General.

ORDER IN COUNCIL.

At the Government House at Wellington, this 21st day of August, 1940.

Present:

His Excellency THE GOVERNOR-GENERAL IN COUNCIL.

WHEREAS it is provided by section thirty-one of the Fire Brigades Act, 1926 (hereinafter called "the said Act"), that the Governor-General in Council may, on the application of any Fire Board established under the Fire Brigades Act, 1926, extend the powers of that Board to borrow moneys in excess of the limits fixed by the said section:

And whereas by Order in Council dated the twelfth day of January, one thousand nine hundred and twenty-five, and published in the Gazette on the fifteenth day of January, one thousand nine hundred and twenty-five, at page 62, the powers of the Wanganui Fire Board were extended, but not so as to exceed the sum of thirty thousand pounds:

And whereas application has been made by the Wanganui Fire Board for further extension of borrowing-powers and it is desirable to grant such request:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the powers and authorities vested in him by the said Act, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby declare that the powers of the said Board to borrow moneys in excess of the limits fixed by the said section thirty-one are hereby extended, but so as not to exceed the sum of thirty-three thousand pounds: Provided that no moneys as aforesaid shall be borrowed except subject to the provisions of the Fire Brigades Act, 1926, and its amendments.

The Western Side of Portion of Scott Street, in the Borough of Blenheim, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line.

ORDER IN COUNCIL.

At the Government House at Wellington, this 28th day of August, 1940.

Present:

His Excellency THE GOVERNOR-GENERAL IN COUNCIL.

IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of all other powers in anyway enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Blenheim Borough Council on the twenty-seventh day of June, one thousand nine hundred and forty, in so far as it affects the portion and side of street described in the Schedule hereto, viz. :-

"The Blenheim Borough Council, being the local authority having control over the streets in the Borough of Blenheim, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to that portion of Scott Street fronting part Allotments 584, 585, 586, 587, and 588 of Section 1, District of Omaka, being the land contained in Certificate of Title, Vol. 31, folio 36, Blenheim Registry, the frontage being 389.55 links";

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the western side of the portion of Scott Street (described in the Schedule hereto) within a distance of thirty-three feet from the centre-line of the said portion of street.

SCHEDULE.

THE western side of all that portion of street situated in the Marlborough Land District, Borough of Blenheim, known as Scott Street, fronting parts Lots 584 and 585, Town of Blenheim, being part Section 1, Omaka District, D.P. 1082. As the same is more particularly delineated on the plan marked P.W.D. 108326, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured brown.

The South-eastern Side of Portion of Seaview Terrace, in the City of Dunedin, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line.

At the Government House at Wellington, this 28th day of August, 1940.

IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of all other powers in anyway enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Dunedin City Council on the fifteenth day of July, one thousand nine hundred and forty, viz. :-

"That the Dunedin City Council, being the local authority having control of the streets in the City of Dunedin, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to the south-eastern side of portion of Seaview Terrace abutting on part Allotment 28, D.P. 69, Township of Allandale";

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the south-eastern side of the portion of Seaview Terrace (described in the Schedule hereto) within a distance of thirty-three feet from the centre-line of the said portion of street.

SCHEDULE.

THE south-eastern side of all that portion of street in the Otago Land District, City of Dunedin, known as Seaview Terrace, fronting part Lot 28, Plans 69 and 3590, Township of Allandale, being part Sections 8 and 9, Ocean Beach District. As the same is more particularly delineated on the plan marked P.W.D. 108250, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured red.

The Northern Side of Portion of Rogers Street, in the Borough of Blenheim, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line.

At the Government House at Wellington, this 28th day of August, 1940.

Present:

His Excellency THE GOVERNOR-GENERAL IN COUNCIL.

IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of all other powers in anyway enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Blenheim Borough Council on the twenty-third day of May, one thousand nine hundred and forty, in so far as it affects the portion and side of street described in the Schedule hereto, viz. :-

"The Blenheim Borough Council, being the local authority having control of the streets in the Borough of Blenheim, hereby declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to that portion of Rogers Street adjoining part Section 6, Omaka, 725 links, as shown on the plan produced at this meeting and being land contained in Certificate of Title, Volume 32, folio 219, Blenheim Registry";

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the northern side of the portion of Rogers Street (described in the Schedule hereto) within a distance of thirty-three feet from the centre-line of the said portion of street.

SCHEDULE.

THE northern side of all that portion of street situated in the Marlborough Land District, Borough of Blenheim, known as Rogers Street, fronting part Section 6, District of Omaka. As the same is more particularly delineated on the plan marked P.W.D. 107819, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured brown.
