SCHEDULE.
AUCKLAND LAND DISTRICT.

The parcels of land situate in the Kawhia County containing together an area of 279 acres, more or less, being Sections 11 and 12, Block VII, Kawhia North Survey District (formerly Section 1a, Block VII, Kawhia North Survey District), as the same are delineated on the plan lodged in the office of the Chief Surveyor at Auckland under No. 30834, and being the whole of the land comprised in forfeited license, Volume 182, folio 169, Auckland Registry.

Given under the hand of His Excellency the Governor-General of the Dominion of New Zealand, and issued under the Seal of that Dominion, this 20th day of August, 1940.

Varying the Determinations in respect of Portion (£2,500) of Waitomo Electric-power Board’s Loan of £95,000.

ORDER IN COUNCIL.

At the Government House at Wellington, this 14th day of August, 1940.

Present :

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

WHEREAS by Order in Council made on the first day of September, one thousand nine hundred and thirty-eight, and subject to the determinations as to borrowing and repayment therein set out, consent was given to the raising by the Waitomo Electric-power Board (hereinafter called “the said local authority”) of the sum of twenty-five thousand pounds (£25,000) by a loan to be known as “ Reticulation Loan, 1938 ” (hereinafter called “the said loan”); And whereas the authority conferred by the said Order in Council has not yet been fully exercised and it is expedient to vary certain of the determinations aforesaid in respect of portion of the said loan, being the sum of two thousand five hundred pounds (£2,500) (hereinafter called “the said sum”): Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in pursuance and exercise of the powers and authorities conferred on him by section eleven of the Local Government Loans Board Act, 1926, as set out in section twenty-nine of the Finance Act, 1932 (No. 2), and of all other powers and authorities enabling him in this behalf, doth hereby vary the determinations aforesaid in respect of the said sum by prescribing as follows :—
(1) In lieu of a rate of interest not exceeding three pounds ten shillings (£3 10s.) per centum per annum the rate of interest that may be paid in respect of the said sum shall not exceed four pounds (£4) per centum per annum.
(2) In lieu of repayment by equal aggregate annual or half-yearly instalments of principal and interest as specified in clause three of the aforesaid Order in Council the said sum shall be repaid by annual instalments of principal of not less than one hundred pounds (£100) each.

Consenting to the Raising of a Loan of £4,438 by the Ashburton Borough Council and prescribing the Conditions thereof.

ORDER IN COUNCIL.

At the Government House at Wellington, this 21st day of August, 1940.

Present :

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

WHEREAS the Ashburton Borough Council (hereinafter called “the said local authority”) proposes, pursuant to the terms of a requisition issued under section twenty-two of the Health Act, 1920, to raise the sum of four thousand four hundred and thirty-eight pounds (£4,438) by a loan to be known as “ Netherby Drainage Loan, 1940 ” (hereinafter called “the said loan”), for the purpose of providing drainage and sewerage works for the Netherby area of the Borough:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in pursuance and exercise of the powers and authorities conferred on him by section eleven of the Local Government Loans Board Act, 1926, as set out in section twenty-nine of the Finance Act, 1932 (No. 2), and of all other powers and authorities enabling him in this behalf, doth hereby consent to the raising in New Zealand by the said local authority of the said loan for the said purpose up to the amount of four thousand four hundred and thirty-eight pounds (£4,438), and in giving such consent doth hereby determine as follows :—
(1) The term for which the said loan or any part thereof may be raised shall not exceed thirty-five (35) years.
(2) The rate of interest that may be paid in respect of the said loan or any part thereof shall be such as shall not produce to the lender or lenders a rate exceeding four pounds (£4) per centum per annum.
(3) The said local authority shall, before raising the said loan or any part thereof, make provision for the repayment thereof by establishing a sinking fund under the Local Bodies’ Loans Act, 1926, or under such other statutory enactment as may be applicable, and shall make payments to such sinking fund at intervals of not more than one year, at a rate or rates per centum which shall be not less than one pound ten shillings (£1 10s.), such payments to be made in respect of every part of the said loan for the time being so borrowed and not repaid, the first such instalment to be paid not later than one year after the first day from which interest to the lender or lenders is computed on the said loan or any part thereof so raised.
(4) The payment of interest and the repayment of principal in respect of the said loan shall be made in New Zealand.
(5) No amount payable as either interest or sinking fund in respect of the said loan shall be paid out of loan-moneys.
(6) The rate payable for brokerage, underwriting, and procurement fees in respect of the raising of the said loan or any part thereof shall not in the aggregate exceed one-half per centum of any amount raised.
(7) No moneys shall be borrowed under this consent after the expiration of two years from the date hereof.

Consenting to Additional Land being taken for a Hospital in the City of Auckland.

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

IN pursuance and exercise of the powers and authorities conferred by the Public Works Act, 1928, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby consent to the land described in the Schedule hereto being taken for a hospital.

APPROXIMATE area of the piece of land permitted to be taken: 17·19 perches.

Being portion of Allotment 17, Section 18, Suburbs of Auckland.

Situated in Block VIII, Rangitoto Survey District (City of Auckland) (Auckland R.D.). (S.O. 31047.)

In the North Auckland Land District; as the same is more particularly delineated on the plan marked P.W.D. 108133, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured red.

PURSUANT to section forty-nine of the Native Land Amendment Act, 1936, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby revoke the Order in Council made on the twenty-ninth day of June, one thousand nine hundred and thirty-three, and published in the Gazette on the sixth day of July, one thousand nine hundred and thirty-three, at page 1863, and affecting Ilohotaka 2a Block and other blocks.
