resolution passed by the Dunedin City Council on the sixth day of November, one thousand nine hundred and thirty-nine, viz. :

"That the Dunedin City Council, being the local authority having control of the streets in the City of Dunedin, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to the undermentioned portions of streets, viz. :

"(a) The south-western side of portion of Dalkeith Street abutting on Allotments 1 and 18, Block II, Township of Dalkeith, D.P. 179, and

"(b) The north-western side of portion of Douglas Street, abutting on Allotment 18 and part Allotment 17, Block II, Township of Dalkeith, D.P. 179 ";

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the south-western side of the portion of Dalkeith Street or the north-western side of the portion of Douglas Street (described in the Schedule hereto) within a distance of thirty-three feet from the centre-lines of the said portions of streets.


SCHEDULE.

THE south-western side of all that portion of street situated in the Otago Land District, City of Dunedin, known as Dalkeith Street, fronting Lots 1 and 18, Block II, Township of Dalkeith, D.P. 179.

Also the north-western side of all that portion of street in the said land district and city, known as Douglas Street, fronting Lot 18 and part Lot 17, Block II, Township of Dalkeith, D.P. 179.

As the same are more particularly delineated on the plan marked P.W.D. 106026, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured red.

The Eastern Side of Portion of Nevis Street, in the Borough of Petone, exempted from the Provisions of Section 128 of the Public Works Act, 1928.

ORDER IN COUNCIL.

At the Government Buildings at Wellington, this 25th day of January, 1940.

Present :

THE HON. W. NASH PRESIDING IN COUNCIL.

IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Petone Borough Council on the twentieth day of November, one thousand nine hundred and thirty-nine, in so far as it affects the portion and side of street described in the Schedule hereto, viz. :

"The Petone Borough Council, being the local authority having control of the street hereinafter mentioned, hereby resolves and declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to that portion of Nevis Street in the Borough of Petone fronting Lots 3 and 5 on Deposited Plan 11793, Wellington Registry."


SCHEDULE.

THE eastern side of all that portion of street situated in the Wellington Land District, Borough of Petone, known as Nevis Street, fronting Lots 3 and 5, D.P. 11793, of Subdivision 5A of Sections 2 and 3, Hutt District. As the same is more particularly delineated on the plan marked P.W.D. 106273, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured red.

Notice bringing certain Lands within the Operation of the Mining Act, 1926.


GALWAY, Governor-General.

IN pursuance and exercise of the powers conferred on me by section twenty-five of the Mining Act, 1926, and of every other power and authority in this behalf enabling, I, George Vere Arundell, Viscount Galway, Governor-General of the Dominion of New Zealand, do hereby declare that the lands described in the Schedule hereto shall be brought within the operation of the Mining Act, 1926, as from the date of the publication hereof in the New Zealand Gazette, and do hereby further declare that no mining privilege shall be granted in respect of any portion of the said lands except with the consent of the Alexandra Borough Council and except with the consent of the Minister of Mines and subject to such conditions as he may impose.


SCHEDULE.

PARTS OF RESERVE FOR TREE-PLANTING PURPOSES.

ALL that area in the Otago Land District, containing 29 acres and 8 poles, more or less, being part of Section 88, Block VII, Leaning Rock Survey District, bounded: Towards the north-east by part of said Section 88, 2410 links and 3306 links; towards the south-east by a public road 450 links; towards the south-west by Section 84, 3305·7 links; again towards the south-east by said Section 84, 500 links; and towards the west and north-west by Crown lands, 1548·9 links and 1510·6 links respectively.

Also all that area containing 5 acres and 32 poles, more or less, being part of Section 9, Block XXXV, Town of Alexandra, bounded: Towards the north-east by other part of said Section 9, 369 links; towards the south-east and north-east by Ventry Street, 100 links and 175·9 links respectively; and again towards the south-east by Sections 4 and 5, Block XXXV, the abuttal of Perseverance Street, and Section 1, Block XLIV, 392 links, 339·1 links, 100 links, and 600 links; towards the south-west by Section 1, Block XIX, 142·1 links and 160·3 links; and towards the north-west by Section 3, Block XIX, and Town Belt (Alexandra Domain), 1547 links.

Also all that area containing 5 acres 2 roods, more or less, being part of Section 88, Block VII, Leaning Rock Survey District, commencing at a point 985·9 links north-west of the first-described area and bounded towards the south-west by Crown land 1730·8 links, 797·7 links, and 1219·5 links; and towards the north-east by part of said Section 88, 3690 links.

Also all that area containing 1 rood, more or less, being part of Section 88, Block VII, Leaning Rock Survey District, commencing at the apex of the last-described area and bounded towards the south-west by Crown lands 510 links; towards the north-west and north-east by part of said Section 88, 100 links and 500 links respectively; be all the aforesaid linkages more or less. As the same are delineated on the plan marked Mines N. 10/12/35, deposited in the Head Office, Mines Department, at Wellington, and thereon bordered red.

PART OF ALEXANDRA DOMAIN.

All that area in the Otago Land District, containing 15 acres and 1 rood, more or less, being part of Alexandra Domain and being part of Alexandra Town Belt, bounded: Towards the north-west by a public road, 1530 links; towards the north-east by another part of said domain, 1000 links; towards the south-east by Section 9, Block XXXV, 1427 links; and towards the south-west by Section 3, Block XIX, and another part of aforesaid domain 200 links and 820 links respectively; be all the aforesaid linkages more or less. As the same is delineated on the plan marked Mines N. 10/12/35, deposited in the Head Office, Department of Mines, at Wellington, and thereon bordered red.

As witness the hand of His Excellency the Governor-General, this 24th day of January, 1940.
