Authorizing Thomas Arthur Wright and Cecil Mervyn Hore,
both of Dansey's Pass, Livingstone, Sheep-farmers, to use
Water for the Purpose of generating Electricity and to erect
certain Electric Lines.

ORDER IN COUNCIL.
At the Government House at Wellington, this 22nd day of
May, 1940.
Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.
PURSUANT to the Public Works Act, 1928, His Excellency
the Governor-General of the Dominion of New Zealand,
acting by and with the advice and consent of the Executive
Council of the said Dominion, doth hereby grant to Thomas
Arthur Wright and Cecil Mervyn Hore, both of Dansey's
Pass, Livingstone, Sheep-farmers (hereinafter referred to as
“the licensees”), a license subject to the conditions hereinafter
set forth to obstruct, impound, or divert the waters of
the north branch of the Maruwenua River, situated in Section 2,
Block II, Domet Survey District, in the Land District of
Otago, and to take and use therefrom for the purposes herein-
after set forth a stream of water not exceeding ten cubic
feet per second at any one time, and to erect the electric
lines hereinafter described.
CONDITIONS.
- IMPLIED CONDITIONS.
The conditions directed to be implied in all licenses by
the Water-power Regulations, 1934, and the Electrical
Supply Regulations, 1935, shall be incorporated in and shall
form part of this license, except in so far as the same may be
inconsistent with the provisions hereof.
- LICENSE SUBJECT TO REGULATIONS.
This license is issued under the Water-power Regulations,
1934, and is subject thereto and to the Electrical Supply
Regulations, 1935, and the Electrical Wiring Regulations,
1935, and to any regulations made or to be made in amplifica-
tion or amendment thereof or in substitution therefor.
- UTILIZATION OF WATER AND LOCATION OF HEADWORKS.
Water shall be used under this license solely for the purpose
of generating electricity, and shall be taken from the said
stream at a point in Section 2, Block II, Domet Survey
District, in the Otago Land District, as indicated on the
plan marked P.W.D. 106414, deposited in the office of the
Minister of Public Works.
- GENERAL DESCRIPTION OF WORKS.
The licensees are hereby authorized, subject to the conditions
hereof, to construct, maintain, and use the following works
for the purposes of this license, the positions of the said works
being indicated on the said plan P.W.D. 106414:-
(a) Headworks consisting of a weir and intake giving a
static head of approximately 28 ft.
(b) Head-race and pipe-line from such headworks to the
power-house hereinafter described.
(c) Power-house with all necessary equipment for gene-
rating electricity, all situated in Section 2, Block
II, Domet Survey District.
(d) (1) Electric lines leading from the power-house aforesaid
across Maruwenua River to Cecil Mervyn Hore's
dwelling, situated in Run 17B, Domet Survey
District.
(2) Electric lines leading from the power-house aforesaid
across Maruwenua River and public road to Thomas
Arthur Wrights' dwelling, situated in Run 510,
Domet Survey District: The said lines being
shown by means of red lines on the said plan P.W.D.
106414.
- DURATION OF LICENSE.
This license shall continue in force until the 31st day of
March, 1961, or until electrical energy is available from an
Electric-power Board or other public source of supply,
whichever is the earlier.
- SYSTEM OF SUPPLY.
The system of supply shall be as described in paragraph (d)
of clause 21-01 of the Electrical Supply Regulations, 1935.
The generating voltage and the transmission voltage shall
be approximately 230 volts direct current.

- RENTAL.
For the purpose of assessing the rental or annual sum
payable in respect of this license, the licensees may install a
suitable maximum-demand indicator to the satisfaction of
the Inspecting Engineer of the Public Works Department,
and, failing such installation, the rental shall be determined
on the maximum capacity of the generating plant installed.
The present plant is rated at 12 kilowatts.

Authorizing the Tauranga Harbour Board to reclaim Land
in Tauranga Harbour.

ORDER IN COUNCIL.
At the Government House at Wellington, this 22nd day of
May, 1940.
Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.
WHEREAS it is provided by section one hundred and
sixty-eight of the Harbours Act, 1923 (hereinafter
called “the said Act”), that the Governor-General may from
time to time, by Order in Council, authorize any local
authority or Harbour Board to reclaim from the sea areas
not exceeding five acres in extent in any case where he
considers that the reclamation will not affect navigation
and is for the benefit of the public:
And whereas the Tauranga Harbour Board (hereinafter
called “the Board”) is desirous of reclaiming from the sea
certain land in Tauranga Harbour, and the said reclamation
is of such nature as aforesaid, and the Board has applied
to the Governor-General in Council for an order authorizing
the execution of the said harbour-works:
And whereas it has been made to appear to the Governor-
General in Council that the proposed work will not be or tend
to the injury of navigation, and is for the benefit of the
public:
Now, therefore, His Excellency the Governor-General of
the Dominion of New Zealand, in pursuance and exercise
of the power and authority vested in him by the said Act,
and acting by and with the advice and consent of the
Executive Council of the said Dominion, doth hereby authorize
and empower the Board to reclaim from the sea in Tauranga
Harbour the area of land coloured red and green on plan
marked M.D. 7970 and deposited in the office of the Marine
Department at Wellington, such reclamation to be carried
out and constructed in accordance with the said plan
marked M.D. 7970.

Revoking Order in Council of the 23rd September, 1936, Licensing
the Tangowahine Sawmills, Limited, to use and occupy a
Part of the Foreshore and Land below Low-water Mark at
Tangowahine, Northern Wairoa River, as a Site of a
Wharf.

WHEREAS by Order in Council dated the twenty-third
day of September, one thousand nine hundred and
thirty-six, and published in the Gazette of the first day of the
following month, at page 1811, the Tangowahine Sawmills,
Limited (hereinafter called “the company”), was licensed
to occupy a part of the foreshore and land below low-water
mark at Tangowahine on the Northern Wairoa River,
Kaipara Harbour, in order to maintain a wharf thereon:
And whereas the company has applied to have the herein-
before-recited Order in Council revoked and it is desirable
to revoke the same:
