At the Government Buildings at Wellington, this 23rd day of April, 1940.

BY virtue of the powers and authorities vested in me by the thirty-fourth section of the Public Reserves, Domains, and National Parks Act, 1928, I, George Vere Arundell, Viscount Galway, Governor-General of the Dominion of New Zealand, by and with the advice and consent of the Executive Council of the said Dominion, do hereby order and declare that the reserve for recreation in the North Auckland Land District described in the Schedule hereto shall be and the same is hereby brought under the operation of and declared to be subject to the provisions of Part II of the said Act, and such reserve shall hereafter form part of the Shelly Beach Domain, and be managed, administered, and dealt with as a public domain by the Shelly Beach Domain Board.
SCHEDULE.
NORTH AUCKLAND LAND DISTRICT.
All that area in Waitemata County, containing by admeasurement 3 roods 5 perches, more or less, situated in Block V, Kaipara Survey District, being part of Aotearoa Block, bounded : Commencing at the south-eastern corner of part of Aotearoa Block on D.P. 8688 ; thence towards the west by aforesaid part of Aotearoa Block, 546Β·1 links and 80 links; towards the north by another part of Aotearoa Block following a right line bearing 65Β° 55', distance 110 links; and towards the west and south by the Kaipara Harbour. As the same is more particularly delineated on the plan marked L. and S. 1/478A, deposited in the Head Office, Department of Lands and Survey, at Wellington, and thereon bordered red. Vesting the Control of a Reserve for Gravel Purposes in the Waimarino County Council.

ORDER IN COUNCIL.
At the Government Buildings at Wellington, this 23rd day of April, 1940.

WHEREAS the land described in the Schedule hereto has been duly set apart as a reserve for gravel purposes: And whereas it is expedient that the control of the said reserve should be vested in the Waimarino County Council:
Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in exercise of the powers and authorities conferred upon him by section seventeen of the Public Reserves, Domains, and National Parks Act, 1928, doth hereby vest the control of the said reserve in the Waimarino County Council.

SECTION 9, Block XV, Manganui Survey District: Area, 3 acres 1 rood, more or less.

Withdrawing Land from the Operation of the Kauri-gum Industry Act, 1908.

WHEREAS by section one hundred and sixty-two of the Land Act, 1924, it is enacted that the Governor-General may, by Order in Council, on the recommendation of the Land Board, declare that any land comprised in a kauri-gum reserve shall, from a date to be specified in the Order, cease to be subject to the Kauri-gum Industry Act, 1908, and on and after the date so specified the land to which the Order relates shall become subject to the provisions of the Land Act, 1924:
And whereas the Land Board of the North Auckland Land District has duly passed a resolution recommending that the portion of the Rotoroa Kauri-gum Reserve Extension, as described in the Schedule hereto, be excepted from the operations of the Kauri-gum Industry Act, 1908, and it is expedient to give effect to such recommendation:
Now, therefore, I, George Vere Arundell, Viscount Galway, Governor-General of the Dominion of New Zealand, in pursuance and exercise of the power and authority conferred upon me by section one hundred and sixty-two of the Land Act, 1924, and acting by and with the advice and consent of the Executive Council of the said Dominion, do hereby order and declare that the portion of the Rotoroa Kauri-gum Reserve Extension, as described in the Schedule hereto, shall, from the thirtieth day of April, one thousand nine hundred and forty, cease to be subject to the Kauri-gum Industry Act, 1908.
SCHEDULE.
NORTH AUCKLAND LAND DISTRICT.
All that area in the Mangonui County, containing by admeasurement, a total of 147 acres 1 rood 35 perches, more or less, being part of Rotoroa Kauri-gum Reserve Extension, situated in Block VIII, Opoe Survey District, bounded : Commencing at the easternmost corner of Section 17, Block VIII, Opoe Survey District; towards the north-east generally by a public road, the crossing of a public road, and again by the first-mentioned public road; towards the east by Lots 6 and 8 on D.P. 27209; towards the south generally by Section 44, Block VIII, Opoe Survey District, a reserve along the generally northern foreshore of Roto Kawau, a public road, and Sections 26 and 21, Block VIII, Opoe Survey District; and towards the west generally by a public road, the crossing of that road, and Sections 19, 34, and 17, all of aforesaid Block VIII, to the point of commencement; save and excepting four intersecting public roads. As the same is more particularly delineated on the plan marked L. and S. 22/1747D, deposited in the Head Office, Department of Lands and Survey, at Wellington, and thereon bordered red. Authorizing the Laying-off of Bain Street, Valley Road, and Riverton Road, in the Mount Maunganui Town District, of a Width less than 66 ft., but not less than 50 ft., subject to a Condition as to the Building-line.

IN pursuance and exercise of the powers vested in him by the Municipal Corporations Act, 1933, and the Public Works Act, 1928, and of all other powers in anyway enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby authorize the Mount Maunganui Town Board to permit the laying-off of the proposed streets described in the Schedule hereto of a width less than sixty-six feet, but not less than fifty feet, subject to the condition that no building or part of a building shall at any time be erected on the land fronting the said streets within a distance of forty-eight feet from the centre-lines of the said streets.
