The South-eastern Side of Portion of Kaikorai Valley Road, in the City of Dunedin, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line.

ORDER IN COUNCIL.
At the Government Buildings at Wellington, this 28th day of February, 1940.
Present:
THE HON. P. FRASER PRESIDING IN COUNCIL.
IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of all other powers in any-wise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Dunedin City Council on the twenty-fifth day of September, one thousand nine hundred and thirty-nine, viz.:
“That the Dunedin City Council, being the local authority having control of the streets in the City of Dunedin, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to the south-eastern side of portion of Kaikorai Valley Road abutting on parts Sections 16, 17, 18, and 19, Block V, Lower Kaikorai Survey District”;
subject to the condition that no building or part of a building shall at any time be erected on the land fronting the south-eastern side of the portion of Kaikorai Valley Road (described in the Schedule hereto) within a distance of thirty-three feet from the centre-line of the said portion of street.
SCHEDULE.
THE south-eastern side of all that portion of street, situated in the Otago Land District, City of Dunedin, known as Kaikorai Valley Road fronting part Sections 16, 17, 18, and 19, Block V, Lower Kaikorai District, being part of the land on plan 926. As the same is more particularly delineated on the plan marked P.W.D. 105429, deposited in the office of the Minister of Public Works at Wellington, and thereon edged red.

“(c) The south-western side of portions of Glen Road, abutting on part Section 6, Block VI, Town District;
“(d) The north-western side of portion of Main South Road, abutting on part Section 6, Block VI, Town District; and
“(e) The north-eastern and south-eastern sides of portions of Leckhampton Court, abutting on part Section 6, Block VI, Town District”;
subject to the condition that no building or part of a building shall at any time be erected on the land, excepting that land as shown edged green on the plan referred to in the Schedule hereto, fronting the portions of streets (described in the Schedule hereto) within a distance of thirty-three feet from the centre-lines of the said streets.
SCHEDULE.
ALL those portions of Haywood Street, Glen Road, Main South Road, and Leckhampton Court, situated in the Otago Land District, City of Dunedin, fronting parts Sections 5 and 6, Block VI, Town District. As the same are more particularly delineated on the plan marked P.W.D. 105137, deposited in the office of the Minister of Public Works at Wellington, and thereon edged red.

Revoking the Declaration of a Main Highway and Declaring Public Highways to be Main Highways.

ORDER IN COUNCIL.
At the Government Buildings at Wellington, this 28th day of February, 1940.
Present:
THE HON. P. FRASER PRESIDING IN COUNCIL.
IN pursuance and exercise of the powers and authorities vested in him by section three of the Main Highways Act, 1922, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby declare that on and after the date of publication of this Order in Council in the Gazette, the portion of main highway described in the First Schedule hereto shall cease to be a main highway, and doth further declare that the roads described in the Second Schedule hereto shall be main highways within the meaning and for the purposes of the Main Highways Act, 1922.
FIRST SCHEDULE.
HIGHWAY DISTRICT NO. 1.
Waimamaku-Ohakawai.—All that main highway in Hokianga County, declared as the Waimamaku-Ohakawai Main Highway, described in Order in Council dated 22nd November, 1939, and published in the Gazette on 23rd November, 1939.
SECOND SCHEDULE.
HIGHWAY DISTRICT NO. 1.
Waimamaku-Ohakawai.—All that road or portion of road in Hokianga County, known as Lowes Bridge Deviation, commencing at its junction with the Waimamaku-Ohakawai Main Highway on the southern boundary of Wairau North 1B 1 Block, Block XLII, Waoku Survey District, and proceeding thence in a westerly direction generally adjoining or passing through Wairau North 1n 1 Block, Waimamaku River-bed, and terminating at its junction with the Waimamaku-Ohakawai Main Highway approximately 4 chains west of the Waimamaku River opposite the south-eastern boundary of Section 16, Waimamaku Village Settlement, in Block IX, Waoku Survey District, being a distance of 35 chains, more or less; also reinforced-concrete bridge on the said road crossing the Waimamaku River, being 155 ft. in length; as the same are more particularly delineated on plan P.W.D. 105768, deposited in the office of the Main Highways Board at Wellington, thereon coloured red, and marked A—B—C.
HIGHWAY DISTRICT NO. 14.
Burwood-Marshlands.—All that road or portion of road in Waimairi County commencing at its junction with the Marshlands—New Brighton Main Highway and proceeding thence generally in a northerly direction via Bottle Lake Road, and thence in a westerly direction via Preston’s Road to its junction with the Christchurch—Chaney’s via Marshlands Main Highway, in Blocks VIII and XII, Christchurch Survey District, being a distance of 3 miles, more or less; as the same is more particularly delineated on plan P.W.D. 106578, deposited in the office of the Main Highways Board at Wellington, and thereon coloured green.
