by and with the advice and consent of the Executive Council
of the said Dominion, doth hereby approve of the following
resolution passed by the Waimea County Council on the
thirteenth day of October, one thousand nine hundred and
thirty-nine, viz.:-
"That the Waimea County Council, being the local
authority having control of the roads within the Waimea
County, by resolution declares that the provisions of
section one hundred and twenty-eight of the Public
Works Act, 1928, shall not apply to the north-eastern
side of the road fronting the south-western side of
part Section 15, Waimea East, Block VI, Waimea Survey
District, as shown on plan prepared by C. M. Houlf,
Registered Surveyor, and coloured red thereon (W.
Buschl)");
subject to the condition that no building or part of a building
shall at any time be erected on the land fronting the north-
eastern side of the portion of road (described in the Schedule
hereto) within a distance of thirty-three feet from the centre-
line of the said portion of road.
SCHEDULE.
THE north-eastern side of all that portion of road, situated
in the Nelson Land District, County of Waimea, fronting
part Section 15, District of Waimea East. As the same is
more particularly delineated on the plan marked P.W.D.
105599, deposited in the office of the Minister of Public
Works at Wellington, and thereon coloured red.

The North-eastern Side of Portion of the Blenheim-Nelson
Main Highway exempted from the Provisions of Section
128 of the Public Works Act, 1928, subject to a Condition
as to the Building-line.

ORDER IN COUNCIL.
At the Government Buildings at Wellington, this 28th day of
February, 1940.

THE HON. P. FRASER PRESIDING IN COUNCIL.
IN pursuance and exercise of the powers conferred by the
Public Works Act, 1928, and of all other powers in
anywise enabling him in this behalf, His Excellency the
Governor-General of the Dominion of New Zealand, acting
by and with the advice and consent of the Executive Council
of the said Dominion, doth hereby approve of the following
resolution passed by the Main Highways Board on the
twenty-first day of February, one thousand nine hundred
and forty, viz.:-
"The Main Highways Board, being the local authority
having control of the No. 52 Blenheim-Nelson Main
Highway, by resolution declares that the provisions of
section one hundred and twenty-eight of the Public
Works Act, 1928, shall not apply to the portion of the
north-eastern side of the said highway fronting part
Section 10, District of Suburban North";
subject to the condition that no building or part of a building
shall at any time be erected on the land fronting the north-
eastern side of the portion of the Blenheim-Nelson Main
Highway (described in the Schedule hereto) within a distance
of thirty-three feet from the centre-line of the said portion of
road.
SCHEDULE.
THE north-eastern side of all that portion of road in the
Nelson Land District, County of Waimea, known as the
Blenheim-Nelson Main Highway, fronting part Section 10,
District of Suburban North. As the same is more particularly
delineated on the plan marked P.W.D. 105762, deposited in
the office of the Minister of Public Works at Wellington, and
thereon coloured red.

Wellington, exempted from the Provisions of Section 128
of the Public Works Act, 1928, subject to a Condition as to
the Building-line.

one hundred and twenty-eight of the Public Works
Act, 1928, shall not apply to that part of the eastern
side of Ohiro Road fronting Lot 2, D.P. 392";
subject to the condition that no building or part of a building
shall at any time be erected on the land fronting the eastern
side of the portion of Ohiro Road (described in the Schedule
hereto) within a distance of thirty-five feet from the centre-
line of the said portion of street.
SCHEDULE.
THE eastern side of all that portion of street, situated in the
Wellington Land District, City of Wellington, known as
Ohiro Road, fronting Lot 2, D.P. 392, of part Section 12,
Ohiro District. As the same is more particularly delineated
on the plan marked P.W.D. 105598, deposited in the office
of the Minister of Public Works at Wellington, and thereon
coloured red.

The Southern Side of Portion of Glade Avenue, in the City of
Christchurch, exempted from the Provisions of. Section 128
of the Public Works Act, 1928, subject to a Condition as to
the Building-line.

thirty-nine, viz.:-
"The Christchurch City Council, being the local
authority having control of the streets in the City of
Christchurch, by resolution declares that the provisions
of section one hundred and twenty-eight of the Public
Works Act, 1928, shall not apply to that portion of the
southern side of Glade Avenue passing through the land
comprised in Certificate of Title, Volume 388, folio 122,
Canterbury Registry, part R.S. 41";
subject to the condition that no building or part of a building
shall at any time be erected on the land fronting the southern
side of portion of Glade Avenue (described in the Schedule
hereto) within a distance of thirty-five feet from the centre-
line of the said portion of street.
SCHEDULE.
THE southern side of all that portion of street situated in
the Canterbury Land District, City of Christchurch, fronting
part Rural Section 41. As the same is more particularly
delineated on the plan marked P.W.D. 105449, deposited in
the office of the Minister of Public Works at Wellington, and
thereon coloured red.
